This matter came to light after a High Court directive mandated a review of representations from these personnel, who were seeking re-allocation to Uttar Pradesh following their promotions. The court had previously ruled that they should be permitted to continue working in Uttar Pradesh on their promoted positions, with full salary, while their cases were deliberated. A dedicated committee thoroughly examined the matter, concluding that the promotions granted were honorary rather than substantive. Consequently, the committee recommended against their request for re-allocation to Uttar Pradesh. This recommendation has been formally accepted by the Government of India, affirming that the individuals will remain part of the successor State of Uttarakhand.

Subject: Consideration of representations of S/Shri Jai Prakash Singh, Anirudh Singh, Prem Narain Dubey, Heera Singh, Anirudh Yadav, Ghulam Shabber Farooqui, and Harpal Singh in compliance of the directions dated 17/11/2009 of Hon’ble High Court of Allahabad, Lucknow Bench, Writ Petition No.7238(S/S)/2009 regarding
Sir,
I am directed to refer to the subject noted above and to say that Hon’ble High Court of Allahabad, Lucknow Bench in W.P. No.7238(S/S)/09 directed that “Keeping in view the circular dated 12.11.2007, the instant appeal is disposed of directing the Committee concerned to decide the appellant’s representations in accordance with law by passing a speaking and reasoned order expeditiously and preferably within a period of three weeks from the date of receipt of a certified copy of this order and communicate the decision to the appellant within next one month and during this period the appellant shall be allowed to discharge his duties in the state of U.P. on the post on which he has been promoted and will be paid his salary”.
2. In compliance of the above directions of the Hon’ble Court, no representations were received from S/Shri Jai Prakash Singh, Anirudh Singh, Prem Narain Dubey, Heera Singh, Anirudh Yadav, Ghulam Shabber Farooqui, and Harpal Singh. The matter was, however, considered by the Committee. The Committee was informed that the promotion given to them is honorary and not substantive. The Committee, therefore, recommended for rejection of their cases for revision of allocation to Uttar Pradesh.
3. The Government of India has accepted the recommendation of the Committee and accordingly final allocation of S/Shri Jai Prakash Singh, Anirudh Singh, Prem Narain Dubey, Heera Singh, Anirudh Yadav, Ghulam Shabber Farooqui, and Harpal Singhcontinues to be the successor State of Uttarakhand. The officer/official concerned may kindly be apprised accordingly.
