A long-standing personnel matter concerning a Regional Forest Officer, Mr. Satish Chandra Upadhyay, has finally reached a resolution. Following multiple directives from the Nainital High Court stemming from a writ petition and a subsequent amendment, a consultative committee reviewed his case. The core issue revolved around his state allocation, particularly his exclusion from the final list for Uttarakhand despite his preference and eligibility for the Corbett Tiger Reserve. The committee, after careful deliberation, recommended his allocation to Uttarakhand. This recommendation has now been officially accepted by the Government of India, leading to a revised final allocation for Mr. Upadhyay to the state of Uttarakhand. This decision brings closure to a matter that involved judicial intervention and administrative review.

विशय: श्री सतीश चन्द्र उपाध्याय, क्षेत्रीय वन अधिकारी द्वारा दायर डब्लू.पी. संख्या 48(एस0बी0)/2001- में माननीय उच्च न्यायालय, नैनीताल द्वारा पारित आदेश के क्रम में प्रत्यावेदन पर निर्णय ।
महोदय,
मुझे, श्री सतीश चन्द्र उपाध्याय द्वारा योजित डब्लू.पी. संख्या 533748(एस0बी0)/2001, में माननीय उच्च न्यायालय, नैनीताल द्वारा पारित दिनांक 16.06.2004 का आदेश का हवाला देने का निदेश हुआ है । मा0 उच्च न्यायालय द्वारा याचिका की सुनवाई करते हुए दिनांक 16.06.2004 को निम्नलिखित आदेश पारित किया गया:- “In view of the aforesaid statement the writ petition no -48(S/B)/2004 is decided in terms of the writ petition no-4446 (S/S) 2001 decided on 25th March 2004. Liberty is given to the petitioner to move representation afresh before the authorities concerned who shall decided the expeditiously within a period of two months from the date of production of a certified copy of this order.”
पुनः श्री सतीश चन्द्र उपाध्याय द्वारा रिट याचिका संख्या.48(S/B)/2004 में मा0 उच्च न्यायालय नैनीताल द्वारा पारित उक्त आदेश दिनांक 16.06.2004 को संशोधित किये जाने के सम्बन्ध में मा0 उच्च न्यायालय, नैनीताल में संशोधन याचिका सं0-4155/2004 प्रस्तुत किया गया । उक्त संशोधन याचिका की सुनवाई करते हुए मा0 उच्च न्यायालय द्वारा दिनांक 05.08.2004 को निम्नलिखित आदेश पारित किया गया:- “After going through the record and after hearing upon the parties counsel the order dated 16th June 2004 is modified to the extent that till the representation of the petitioner is decided he shall not be relived for the State U.P. order dated 16th June 2004 is modified accordingly.”
माननीय न्यायालय के निर्देशों के अनुसार, श्री सतीश चन्द्र उपाध्याय, क्षेत्रीय वन अधिकारी के उत्तराखण्ड आवंटन सम्बन्धित प्रकरण पर परामर्शी समिति द्वारा दिनांक 15, जून 2011 को आयोजित बैठक में विचार किया गया । यह देखते हुये कि श्री सतीश चन्द्र उपाध्याय, क्षेत्रीय वन अधिकारी, कार्बेट टाईगर रिजर्व रामनगर, नैनीताल का नाम विकल्पधारी होते हुये भी अन्तिम आवंटन सूची में सम्मिलित होने से रह गया था, समिति द्वारा श्री उपाध्याय को उत्तराखण्ड राज्य आवंटन किये जाने की संस्तुति की गई ।
समिति द्वारा जो संस्तुति की गई, उसे भारत सरकार द्वारा मान लिया गया है तथा श्री सतीश चन्द्र उपाध्याय, क्षेत्रीय वन अधिकारी का अंतिम आवंटन उत्तराखण्ड राज्य के लिये संशाधित किया जाता है । अधिकारी को उपर्युक्त आवंटन से अवगत करवा दिया जाए ।
