Subject: Compliance of Hon’ble High Court Nainital’s directions in WP No.766/2007- Decision on the representations of Shri Puran Chandra, Jr. Clerk, Irrigation Department regarding
Sir,
I am directed to refer to the direction of the Hon’ble High Court of Uttarakhand at Nainital in W.P. No. 766/2007 dated 31.07.2007 and to say that the representation of Shri Puran Chandra Irrigation Department was considered by the Committee headed by Dr. S.K. Sarker, Joint Secretary in its meeting held on 24.8.2009. The Committee found that against 20 posts of Jr. Clerk, it was decided to allocate 16 personnel and 4 vacancies on proportionate basis. The name of Shri Puran Chandra an optee was deleted from the list as the names of 5 women optees were included in the list of 16 personnel to be allocated to Uttarakhand. As a senior male optee cannot be replaced to adjust a woman optee, the Committee recommended to accept his representation for allocation to Uttarakhand as an optee against the vacancy given to Uttarakhand. With this allocation 17 personnel and 3 vacancies stand allocated to Uttarakhand.
The Government of India has accepted the recommendation of the Committee and accordingly Shri Puran Chandra, Jr. Clerk, Irrigation Department stands allocated to Uttarakhand. Officer concerned may kindly be apprised of the position.
