His representation cited concerns such as his initial temporary appointment status since 1983, the lack of options provided during the reorganization process, and limited time to object to the tentative final allocation list. However, a State Advisory Committee, convened to address the High Court’s order, determined that Shri Pandey’s services had been regularized as a Junior Assistant since October 1997. The committee concluded that his other grounds for requesting a change in allocation did not align with the established guidelines for reorganization. Consequently, the Government of India accepted the committee’s recommendation, maintaining the junior assistant’s original allocation to the successor State of Uttarakhand.

Subject: Compliance of directions dated 18-9-2009 of the Allahabad High Court, Lucknow Bench in Writ Petition No.4166/05 – Decision on the representation of Shri Kishore Chandra Pandey, Junior Assistant, Evaluation Department regarding.
Sir,
I am directed to refer to order dated 18-9-2009 of Hon’ble Allahabad High Court, Lucknow Bench vide which the Hon’ble Court had directed State Advisory Committee to consider the representation of Shri Kishore Chandra Pandey, Junior Assistant, Evaluation Department for re-allocation from Uttarakhand to Uttar Pradesh, and to say that representation of Shri Pandey has been considered by the State Advisory Committee headed by Joint Secretary (SR) in its meeting held on 1-12-2010. Shri Pandey has mentioned the following grounds in his representation:-
i) He was appointed as temporary employee in 1983 and is still continuing on temporary basis
ii) Option not sought from him
iii) He was given only two days time to represent against Tentative Final Allocation List (TFAL)
iv) His representation against TFAL clearly mentioned that since he is not being given the benefit of regular appointment, he cannot be allocated to Uttarakhand.
2. It was brought to the notice of the Committee that the services of the petitioner were regularized with effect from 17-10-1997 as Junior Assistant. Since the other grounds mentioned by Shri Pandey in his representation, as brought out above, were not covered under the guidelines on Reorganisation, the Committee recommended to reject his representation seeking revision of allocation from Uttarakhand to Uttar Pradesh.3. Government of India has accepted the recommendations of the Committee and accordingly the allocation of Shri Kishore Chandra Pandey remains unchanged and he continues to be allocated to the successor State of Uttarakhand. The official concerned may kindly be apprised of the position.
