A committee was convened to evaluate the claims, which included arguments regarding his designation as a junior-most OBC category official, his domicile, and the alleged absence of a seniority list. After careful deliberation, the committee concluded that the initial allocation to Uttarakhand was consistent with established guidelines. Furthermore, it determined that the grounds presented by Shri Yadav concerning his domicile and the lack of a seniority list did not fall within the purview of the State Reorganisation guidelines. Consequently, the committee recommended rejecting his representation. The Government has since accepted this recommendation, confirming that Shri Subedar Yadav will continue to serve in Uttarakhand.

Subject: Decision on the representations submitted by Shri Subedar Yadav, Dy. Jailor, Jail Department in compliance of High Court Allahabad, Lucknow Bench order dated 12.12.2007.
Sir,
I am directed to refer to the directions of the Hon’ble High Court, Lucknow Bench order dated 12.12.2007 and to say that the representation of Shri Subedar Yadav, Dy. Jailor was considered by the Committee headed by Dr. S.K. Sarkar, JS in its meeting held on 23.6.2009. The Committee found that his allocation to Uttarakhand under juniormost category of OBC is as per guidelines. Further the ground of his domicile and non existence of seniority list is not covered under the guidelines of State Reorganisation and as such has recommended for rejection of the representation.

The Government of India has accepted the recommendation of the committee and accordingly Shri Subedar Yadav, Dy. Jailor shall continue in Uttarakhand. Officer concerned may kindly be apprised of the position.
