Subject: Consideration of representation of Shri Narendra Kumar Singh in compliance of the directions of Hon’ble High Court of Allahabad, Lucknow Bench in Writ Petition No.3803/2007-Amit Kumar Singh \& Ors. and Vinod Kumar Singh in W.P.No.28876/2007 – regarding
Sir,
I am directed to refer to the subject noted above and to say that Hon’ble High Court of Allahabad, Lucknow Bench in its order dated 19.11.2009 in Writ Petition No. 3803/2007 and 28876/2007 has directed that “The case in which objections are not considered, the same will be considered by the Union of India in consultation with the state/s under section 73 of the Uttar Pradesh Reorganisation Act, 2000 within a period of three months from the date of communication of this order upon giving fullest opportunity of hearing and by passing a reasoned order in the individual cases. At the time of passing order, the authority concerned will give preferential value to the modalities already made known to the parties for the purpose. So far as consequential orders are concerned, since consideration by the Union of India in consultation with the State/s is already over, the consequential orders will be passed also within such period. However the orders which will be passed finally in respect of any of the matters upon consideration of objection or c: “munication of consequential orders will be finally b: ding upon the parties. Accordingly all the writ petitions are disposed of however without imposing any cost.”
2. The representations of S/Shri Narendra Kumar Singh one of the petitioners in W.P. No.3803/2007-Amit Kumar Singh \& Ors. and Vinod Kumar Singh in W.P. No.28876/2007, received in compliance of the directions of Hon’ble High Court of Allahabad, Lucknow Bench, for consideration on the ground of belonging to SC Category and being domicile of Uttar Pradesh, have been considered by the Advisory Committee in its meeting held on 15-06-2011. The Committee recommended for acceptance of their representations for revision of allocation to UP in terms of this Department’s letter No.27/26/2006-SRS dated 29.07.2008 and subsequent amendment of even number dated 24.06.2010 regarding allocation of SC/ST personnel.
- The Government of India has accepted the recommendations of the Committee and accordingly, the allocation of S/Shri Narendra Kumar Singh and Vinod Kumar Singh are revised to the successor State of Uttar Pradesh. The officers concerned may kindly be apprised accordingly.
