A significant administrative decision has been finalized by the Government of India, ensuring the definitive allocation of two junior engineers, Rampal Sharma and Umeed Hasan, to the State of Uttarakhand. This resolution directly stems from a Uttarakhand High Court ruling dated December 27, 2010. The High Court had affirmed that there was no legitimate basis to exclude their names from the final allocation list for Uttarakhand, effectively disposing of the writ petitions and upholding an earlier interim order. Given that these judicial pronouncements were not subsequently challenged, they have attained legal finality. In response, the Ministry of Personnel, Public Grievances and Pensions has directed that both individuals, who serve as Junior Engineers (Civil) within the Irrigation Department, are now formally considered allocated to the State of Uttarakhand, under the existing administrative orders pertaining to state reorganization, with a minor amendment to the previous final order. This action brings clarity and closure to a long-pending matter concerning their service status.

विषय:- रिट याचिका संख्या 734/2006-रामपाल शर्मा बनाम उत्तराखंड राज्य व अन्य तथा रिट याचिका संख्या 735/2006-उम्मीद हसन बनाम उत्तराखंड राज्य व अन्य में माननीय उत्तराखंड उच्च न्यायालय द्वारा पारित निर्णय दिनांक 27.12.2010 के अनुपालन के संम्बन्ध में ।
महोदय,
माननीय उत्तराखंड उच्च न्यायालय द्वारा उपर्युक्त दोनों रिट याचिकाओं में पारित दिनांक 27.12.2010 के निर्णयो में समानार्थक आदेश दिये गये हैं जिसका क्रियाशील अंश निम्नानुसार है :-
“….. we accordingly hold that the name of the Petitioner features in the final allocation list for the State of Uttarakhand as there is no just reason to discard the name of the Petitioner from final allocation list and accordingly dispose of the Writ Petition with the said declaration and by affirming the interim order.”
2. क्योंकि इन आदेशों को किसी न्यायालय में चुनौती नहीं दी गयी है, अतः यह प्रभावी हो गये हैं । अतः भारत सरकार द्वारा इन आदेशों पर विचार किया गया तथा इनके अनुपालनार्थ निर्णय लिया गया है । तदनुसार सर्वश्री रामपाल शर्मा एवं उम्मीद हसन, कनिष्ठ अभियंता (सिविल), सिंचाई विभाग, दिनांक 11.05.2006 के अंतिम
आदेश संख्या 27/2/2006-SRS के तहत उत्तराखंड राज्य आवंटित माने जाएंगे । अंतिम आदेश में इसी सम्बन्ध में आंशिक संशोधन किया जाता है ।
3. दोनो कार्मिकों को इस निर्णय के बारे में सूचित की जाए ।
