Subject: Compliance of directions of the High Court of Allahabad, Lucknow Bench dated 12.12.2007 in W.P. No.58 of 2006- Shri Sher Singh vs Union of India & Ors and linked cases/cases eligible for same treatment -Decision on the representations of the personnel belonging to Jail Department regarding –

Sir,

I am directed to refer to the directions of the Hon’ble High Court of Allahabad, Lucknow Bench ordered dated 12.12.2007 and to say that the representations of the following personnel of Jail Department were considered by the Committee headed by Joint Secretary(AT&A), Department of Personnel & Training, Government of India in its meeting held on 09.07.2010:

The grounds mentioned now as brought out in the adjacent para in the fresh representation submitted in pursuance of the Hon’ble High Court of Allahabad, Lucknow Bench’s directions dated 12.12.2007, do not make him eligible for change in allocation as per the guidelines on allocation of personnel.
2. Rajeev Agnihotri, Jr. Clerk/Typist WP No 8566(S/S)/05 Not junior-most, mother suffering from high blood pressure, requested for reconsideration of earlier representation and for cancellation of allocation to Uttarakhand. His earlier representation has already been considered by SAC and rejected. The grounds mentioned now as brought out in the adjacent para in the fresh representation submitted in pursuance of the Hon’ble High Court of Allahabad, Lucknow Bench’s directions dated 12.12.2007, do not make him eligible for change in allocation as per the guidelines on allocation of personnel.

The Committee recommended to reject the representations of the above personnel for revision of allocation to Uttar Pradesh

The Government of India has accepted the recommendation of the Committee and accordingly the allocation of the above personnel of the Jail Department continues to be the successor State of Uttarakhand. Officers concerned may kindly be apprised of the position.
