कार्मिक, लोक शिकायत और पेंशन मंत्रालय (कार्मिक और प्रशिक्षण विभाग) अधिसूचना नई दिल्ली, 19 मार्च, 2010

सा.का.नि. 197(अ).— राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केंद्रीय सचिवालय सेवा नियम, 2009 के नियम 11 के उप-नियम (4) के अनुसरण में, निम्नलिखित विनियम बनाती है, अर्थात् :—

1. संक्षिप्त नाम और प्रारंभ:— इन नियमों का संक्षिप्त नाम केंद्रीय सचिवालय सेवा (ज्येष्ठ चयन ग्रेड, चयन ग्रेड और ग्रेड 1 में प्रोन्नति) विनियम, 2010 है।

2. परिभाषाएं:— इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,—

(क) “पात्र अधिकारी” से ऐसा अधिकारी अभिप्रेत है, जिसने ऐसे अनिवार्य प्रशिक्षण कार्यक्रम (कार्यक्रमों) में, जो कार्मिक, लोक शिकायत और पेंशन मंत्रालय में कार्मिक और प्रशिक्षण विभाग द्वारा काडर प्रशिक्षण योजना के अधीन विहित किया जाए (किए जाएं), भाग लिया है और उन्हें सफलतापूर्वक पूरा किया है और वह उस कलैण्डर वर्ष में जिसमें चयन सूची तैयार की जाती है, जुलाई मास की पहली तारीख को केंद्रीय सचिवालय सेवा नियम, 2009 के नियम 11 के अधीन, यथास्थिति, सेवा के ज्येष्ठ चयन ग्रेड, चयन ग्रेड और ग्रेड 1 में नियुक्ति के लिए विचार किए जाने के लिए पात्र है।

(ख) “चयन का क्षेत्र” से ऐसे पात्र अधिकारियों की सूची अभिप्रेत है जिससे चयन सूची में सम्मिलित किए जाने के लिए चयन किया जाएगा;

(ग) “सरकार” से भारत सरकार के कार्मिक, लोक शिकायत और पेंशन मंत्रालय का कार्मिक और प्रशिक्षण विभाग अभिप्रेत है;

(घ) “नियम” से केंद्रीय सचिवालय सेवा नियम, 2009 अभिप्रेत है;

(ङ) “चयन समिति” से ऐसी समिति अभिप्रेत है, जो विनियम 4 के अनुसार गठित की गई है;

(च) “चयन सूची” से ऐसे अधिकारियों की सूची अभिप्रेत है, जिन्हें, यथास्थिति, ज्येष्ठ चयन ग्रेड, चयन ग्रेड या ग्रेड 1 में प्रोन्नति के लिए उपयुक्त समझा गया है और जिसे विनियम 5 के अनुसार तैयार किया गया है।

1. चयन सूची की संख्या और चयन का क्षेत्र:— (1) ज्येष्ठ चयन ग्रेड, चयन ग्रेड या ग्रेड 1 के लिए चयन सूची में सम्मिलित किए जाने वाले अधिकारियों की संख्या वह होगी, जो सरकार द्वारा समय-समय पर अवधारित की जाए।

(2) चयन का क्षेत्र वह होगा जो सरकार द्वारा जारी किए गए विभागीय प्रोन्नति समिति मार्गदर्शी सिद्धांतों के अधीन विहित किया जाए।

1. ज्येष्ठ चयन ग्रेड, चयन ग्रेड के लिए चयन समितियों का गठन:— (1) कार्मिक और प्रशिक्षण विभाग, ज्येष्ठ चयन ग्रेड, चयन ग्रेड हेतु चयन सूची के लिए सचिव, कार्मिक और प्रशिक्षण विभाग, भारत सरकार के तीन अन्य सचिव और स्थापन अधिकारी से मिलकर बनने वाली चयन समिति का समय-समय पर गठन करेगा और सचिव, कार्मिक और प्रशिक्षण विभाग, ज्येष्ठ चयन ग्रेड, चयन ग्रेड के लिए चयन समिति की सभी बैठकों को अध्यक्षता करेगा।

1. चयन समिति ग्रेड 1 का गठन :- (1) कार्मिक और प्रशिक्षण विभाग, ग्रेड 1 के लिए चयन सूची को तैयार करने के लिए संघ लोक सेवा आयोग के अध्यक्ष या सदस्य, केंद्रीय सचिवालय सेवा का भास्साधक संयुक्त सचिव, कार्मिक और प्रशिक्षण विभाग तथा भारत सरकार के अन्य संयुक्त सचिवों से मिलकर बनने वाली चयन समिति का समय-समय पर गठन करेगा।
   (2) आयोग का अध्यक्ष या सदस्य ग्रेड 1 के लिए चयन समिति की सभी बैठकों की अध्यक्षता करेगा।

6. चयन सूची का तैयार किया जाना :-

क. ज्येष्ठ चयन ग्रेड
(1) ज्येष्ठ चयन ग्रेड के लिए चयन सूची उस ग्रेड की स्वीकृत पद संख्या के अनुसार वर्ष के जुलाई मास की पहली तारीख को प्रत्येक वर्ष प्रकाशित की जाएगी।
(2) चयन का क्षेत्र चयन समिति द्वारा पात्र चयन ग्रेड अधिकारियों की अपेक्षित संख्या को उनकी ज्येष्ठता के क्रम में लेकर अवधारित किया जाएगा।
(3) चयन समिति उन व्यक्तियों को योग्यता का अवधारण करेगी जिनका विहित बेंचमार्क के प्रतिनिदेंश से ज्येष्ठ चयन ग्रेड की चयन सूची में प्रोन्नति के लिए मूल्यांकन किया जाता है और तदनुसार “उपयुक्त” या “अनुपयुक्त” के रूप में ही अधिकारियों को क्रमबद्ध करेगी।
(4) सरकार के आदेशों के अधीन रहते हुए, जहां तक वर्गीकरण का संबंध है, चयन समिति की सिफारिशें स्वीकार की जाएंगी।
(5) केवल उन्हीं व्यक्तियों के नामों को सम्मिलित करके चयन सूची तैयार की जाएगी जिन्हें चयन समिति द्वारा “उपयुक्त” (अर्थात् जो विहित बेंचमार्क को पूरा करते हैं) के रूप में श्रेणीकृत किया जाता है और जिन्हें चयन ग्रेड में उनकी परस्पर ज्येष्ठता के क्रम में चयन सूची में अनुक्रमित किया जाता है तथा उन अधिकारियों को जिन्हें चयन समिति द्वारा “अनुपयुक्त” (विहित बेंचमार्क के निबंधनानुसार) श्रेणीकृत किया जाता है, चयन सूची में सम्मिलित नहीं किया जाएगा और इस प्रकार तैयार की गई चयन सूची कार्मिक, लोक शिकायत और पेंशन मंत्रालय के कार्मिक और प्रशिक्षण विभाग द्वारा जारी की जाएगी।

ख. चयन ग्रेड

(6) चयन ग्रेड के लिए चयन सूची उस ग्रेड की स्वीकृत पद संख्या के अनुसार वर्ष के जुलाई मास की पहली तारीख को प्रत्येक वर्ष प्रकाशित की जाएगी।
(7) चयन का क्षेत्र पात्र ग्रेड-1 अधिकारियों की अपेक्षित संख्या को लेकर उनकी ज्येष्ठता के क्रम में चयन समिति द्वारा अवधारित किया जाएगा।
(8) चयन समिति उन व्यक्तियों को योग्यता का अवधारण

लिए मूल्यांकन किया जाता है और तदनुसार “उपयुक्त” या “अनुपयुक्त” के रूप में ही अधिकारियों को श्रेणीकृत करेगी।
(9) सरकार के आदेशों के अधीन रहते हुए, जहां तक वर्गीकरण का संबंध है, चयन समिति की सिफारिशें स्वीकार की जाएंगी।
(10) केवल उन्हीं व्यक्तियों के नामों को सम्मिलित करके चयन सूची तैयार की जाएगी जिन्हें चयन समिति द्वारा “उपयुक्त” (अर्थात् जो विहित बेंच मार्क को पूरा करते हैं) के रूप में श्रेणीकृत किया जाता है और जिन्हें ग्रेड में उनकी परस्पर ज्येष्ठता के क्रम में चयन सूची में अनुक्रमित किया जाता है तथा उन अधिकारियों को जिन्हें चयन समिति द्वारा “अनुपयुक्त” (विहित बेंच मार्क के निबंधनानुसार) श्रेणीकृत किया जाता है, चयन सूची में सम्मिलित नहीं किया जाएगा और इस प्रकार तैयार की गई चयन सूची कार्मिक, लोक शिकायत और पेंशन मंत्रालय के कार्मिक और प्रशिक्षण विभाग द्वारा जारी की जाएगी।

ग. ग्रेड-I

(11) ग्रेड 1 के लिए चयन सूची उस ग्रेड की स्वीकृत पद संख्या के अनुसार वर्ष के जुलाई मास की पहली तारीख को प्रत्येक वर्ष प्रकाशित की जाएगी।
(12) सभी पात्र अनुभाग अधिकारियों के नाम कार्मिक और प्रशिक्षण विभाग द्वारा वार्षिक रूप से नियत किए गए उस ग्रेड में उनकी ज्येष्ठता के क्रम के अनुसार अनुक्रमित किए जाएंगे।
(13) चयन का क्षेत्र उप-विनियम (12) के अधीन तैयार की गई सूची से व्यक्तियों की अपेक्षित संख्या को लेकर उस सूची में उनके समावेशन के क्रम में चयन समिति द्वारा अवधारित किया जाएगा।
(14) चयन समिति उन व्यक्तियों को योग्यता का अवधारण करेगी जिनका विहित बेंच मार्क के प्रतिनिदेंश से चयन सूची में सम्मिलित किए जाने के लिए मूल्यांकन किया जाता है और तदनुसार “उपयुक्त” या “अनुपयुक्त” के रूप में ही अधिकारियों को श्रेणीकृत करेगी।
(15) संबद्ध अधिकारियों की अद्यतन गोपनीय रिपोर्टों और ऐसी जानकारी जो सुसंगत हो सहित चयन समिति की सिफारिशों को आयोग को उनकी सलाह के लिए अग्रेषित किया जाएगा।
(16) सरकार के आदेशों के अधीन रहते हुए, जहां तक संबद्ध अधिकारी की उपयुक्तता और वर्गीकरण का संबंध है, आयोग की सिफारिशें स्वीकार की जाएंगी।
(17) चयन सूची केवल उन्हीं अधिकारियों के नामों को सम्मिलित करके तैयार की जाएगी जिन्हें चयन समिति

जिन्हें उप-विनियम (12) के अधीन तैयार की गई सूची में उनकी परस्पर ज्येष्ठता के क्रम में चयन सूची में श्रेणीकृत किया जाता है तथा ऐसे अधिकारियों को जिन्हें चयन समिति द्वारा ‘अनुपयुक्त’ (विद्येत बेंचमार्क के निबंधनानुसार) श्रेणीकृत किया जाता है, चयन सूची में सम्मिलित नहीं किया जाएगा और इस प्रकार तैयार की गई चयन सूची कार्मिक, लोक शिकायत और पेंशन मंत्रालय के कार्मिक और प्रशिक्षण विभाग द्वारा जारी की जाएगी ।
7. व्यावृत्तियां :-विनियम 5 में अंतर्विष्ट किसी बात के होते हुए भी, अधिकारी, जिनका इन विनियमों के प्रवृत्त हो जाने से पूर्व अनुमोदन पहले ही कर दिया गया है परंतु, यथास्थिति, ज्येष्ठ चयन ग्रेड, चयन ग्रेड या ग्रेड-I में उन्हें नियुक्त किया गया है, उस में नियुक्ति के लिए पात्र बने रहेंगे ।

NOTIFICATION

New Delhi, the 19th March, 2010
G.S.R. 197(E).-In exercise of the powers conferred by the proviso to article 309 of the Constitution and in pursuance of sub-rule (4) of rule 11 of the Central Secretariat Service Rules, 2009, the President hereby makes the following regulations, namely:-

1. Short title and commencement.-These regulations may be called the Central Secretariat Service (Promotion to Senior Selection Grade, Selection Grade and Grade I) Regulations, 2010.
2. Definitions.- In these regulations, unless the context otherwise requires,-
   (a) “Eligible Officer” means any officer who has undergone and successfully completed such mandatory training programme(s) as may be prescribed under Cadre Training Plan by the Department of Personnel and Training in the Ministry of Personnel, Public Grievances and Pensions and is eligible to be considered for appointment to Senior Selection Grade, Selection Grade and Grade I of the Service, as the case may be, under rule 11 of the Central Secretariat Service Rules, 2009, as on the 1st July of the calendar year in which the Select List is prepared;
   (b) “Field of Selection” means the list of eligible officers from which a selection will be made for inclusion in the Select List;
   (c) “Government” means the Government of India
   in the Ministry of Personnel, Public Grievances and Pensions;
   (d) “Rules” means the Central Secretariat Service Rules, 2009;
   (e) “Selection Committee” means the Committee constituted in accordance with regulation 4;
   (f) “Select List” means the list of eligible officers considered fit for appointment to the Senior Selection Grade, the Selection Grade or the Grade I, as the case may be, and prepared in accordance with regulation 5.
3. Strength of Select List and field of selection.(1) The strength of officers to be included in the Select List for Senior Selection Grade, Selection Grade and Grade I shall be as determined from time to time by the Government.
   (2) The field of selection shall be as prescribed under the Departmental Promotion Committee Guidelines issued by the Government.
4. Constitution of the Selection Committees for Senior Selection Grade and Selection Grade.-(1) The Department of Personnel and Training shall, from time to time, constitute a Selection Committee consisting of the Secretary, Department of Personnel and Training, three other Secretaries to the Government of India and the Establishment Officer, for the preparation of the Select Lists for the Senior Selection Grade and Selection Grade and the Secretary-Department of Personnel and Training shall preside over at all meetings of the Selection Committee for the Senior Selection Grade and the Selection Grade.
5. Constitution of Selection Committee Grade-I.(1) The Department of Personnel and Training shall, from time to time, constitute a Selection Committee consisting of the Chairman or a Member of the Union Public Service Commission, the Joint Secretary in charge of Central Secretariat Service, Department of Personnel and Training and two other Joint Secretaries to the Government of India, for the preparation of the Select List for Grade-I.
   (2) The Chairman or the Member of the Commission shall preside over at all meetings of the Selection Committee for Grade-I.

6. Preparation of the Select List.-

A. Senior Selection Grade

(1) Select List for the Senior Selection Grade shall be published every year on the first of July of the year in accordance with the sanctioned strength of that grade.
(2) The field of selection shall be determined by the Selection Committee by taking the required number of eligible Selection Grade Officers in the order of their seniority.
(3) The Selection Committee shall determine the merit of those being assessed for promotion

the prescribed bench-mark and accordingly grade the officers as ‘fit’ or ‘unfit’ only.
(4) Subject to the orders of the Government, the recommendations of the Selection Committee as regards classification shall be accepted.
(5) The Select List shall be prepared by including the names of only those who are graded as ‘fit’ (i.e. who meet the prescribed bench-mark) by the Selection Committee and arranged in the Select List in the order of their inter-se seniority in the Selection Grade and those officers who are graded ‘unfit’ (in terms of the prescribed bench-mark) by the Selection Committee shall not be included in the Select List and the Select List so prepared shall be issued by the Department of Personnel and Training in the Ministry of Personnel, Public Grievances and Pensions.

B. Selection Grade

(6) Select List for the Selection Grade shall be published every year on the first day of July of the year in accordance with the sanctioned strength of that grade.
(7) The field of selection shall be determined by the Selection Committee by taking the required number of eligible Grade I Officers in the order of their seniority.
(8) The Selection Committee shall determine the merit of those being assessed for inclusion in the Select List for the Selection Grade with reference to the prescribed bench mark and accordingly grade the officers as ‘fit’ or ‘unfit’ only.
(9) Subject to the orders of Government, the recommendations of the Selection Committee as regards classification shall be accepted.
(10) The Select List shall be prepared by including the names of only those officers who are graded as ‘fit’ (i.e. who meet the prescribed bench-mark) by the Selection Committee and arranged in the Select List in the order of their inter-se seniority in the Grade I and those officers who are graded ‘unfit’ (in terms of the prescribed bench-mark) by the Selection Committee shall not be included in the Select List and the Select List so prepared shall be issued by the Department of Personnel and Training in the Ministry of Personnel, Public Grievances and Pensions.

C. Grade I

(11) Select List for the Grade I shall be published every year on the first of July of the year in accordance with the sanctioned strength of that grade.
(12) The names of all eligible Section Officers shall be arranged in accordance with the order of their seniority in that Grade fixed by the Department of Personnel and Training annually.
(13) The field of selection shall be determined by the Selection Committee by taking the required number of persons from the list drawn up under sub-regulation (12), in the order of their inclusion in that list.
(14) The Selection Committee shall determine the merit of those being assessed for inclusion in the Select List with reference to the prescribed bench-mark and accordingly grade the officers as ‘fit’ or ‘unfit’ only.
(15) The recommendations of the Selection Committee, together with the upto date confidential records of the concerned officers and such other information as may be relevant, shall be forwarded to the Commission for their advice.
(16) Subject to the orders of Government, the recommendations of the Commission as regards suitability and classification of the concerned officer shall be accepted.
(17) The Select List shall be prepared by including the names of only those officers who are graded as ‘fit’ (i.e. who meet the prescribed bench-mark) by the Selection Committee and arranged in the Select List in the order of their inter-se seniority in the list prepared under subregulation (12) and those officers who are graded ‘unfit’ ( in terms of the prescribed bench-mark) by the Selection Committee shall not be included in the Select List and the Select List so prepared shall be issued by the Department of Personnel and Training in the Ministry of Personnel, Public Grievances and Pensions.
7. Savings.-Notwithstanding anything contained in regulation 5, officers already approved for but not appointed to the Senior Selection Grade, the Selection Grade or the Grade I, as the case may be, before the coming into force of these regulations, shall continue to be eligible for appointment to that grade.
