The Central Secretariat Service (Amendment) Rules, 2022, have been introduced to modify the existing Central Secretariat Service Rules of 2009. These amendments, enacted by the President under Article 309 of the Constitution, focus on two key areas. Firstly, rule 21 is updated to include the phrase “in consultation with the Commission” after “regulation,” implying that certain regulatory actions will now require consultation with a commission. Secondly, rule 23 is substituted with new provisions regarding the “Power to Relax.” This revised rule empowers the Central Government to dispense with or relax requirements of the rules and regulations, to the extent deemed necessary and subject to specified conditions, if their application causes undue hardship to any class or category of persons or posts. The government will exercise this power in consultation with the Commission. These amendments will come into effect upon their publication in the Official Gazette.

सा.का.नि.-721(अ).—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए,
केन्द्रीय सचिवालय सेवा नियम, 2009 का और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-
- संक्षिप्त नाम और प्रारंभ — (1) इन नियमों का संक्षिप्त नाम केन्द्रीय सचिवालय सेवा (संशोधन) नियम, 2022 है।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे। -
केन्द्रीय सचिवालय सेवा नियम, 2009 में,–
(i) नियम 21 में “अनुकूल,” शब्द के पश्चात् “आयोग के परामर्श से” शब्द अंत:स्थापित किए जाएंगे;
(ii) नियम 23 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात्:–
“23.शिथिल करने की शक्ति—केन्द्रीय सरकार यदि इस बात से संतुष्ट है कि इनमे से किसी नियम और उसके अधीन बनाए
गए विनियमों के लागू होने से व्यक्तियों या पदों के किसी वर्ग या श्रेणी के लिए अनुचित कठिनाई पैदा हो रही है, तो,
आयोग के परामर्श से, इन नियमों और उसके अधीन बनाए गए विनियमों को हटाया जा सकेगा/सकेगी या इस नियम की अपेक्षा में ऐसी सीमा तक और ऐसी शर्तों के अध्यक्षीन रियायत दी जा सकेगी जैसा आवश्यक समझा जाए”।

MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department of Personnel And Training) NOTIFICATION
New Delhi, 22nd September, 2022
G.S.R. 721(E).-In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Central Secretariat Service Rules, 2009 namely:-
- Short title and commencement.-(1) These rules may be called the Central Secretariat Service (Amendment) Rules, 2022.
(2) They shall come into force on the date of their publication in the Official Gazette. - In the Central Secretariat Service Rules, 2009, –
(i) in rule 21, after the word “regulation”, the words “in consultation with the Commission”, shall be inserted;
(ii) for rule 23, the following rule shall be substituted, namely:-
“23. Power to Relax.-Where the Central Government is satisfied that the operation of any of these rules and the regulations made thereunder causes undue hardship in any class or category of persons or posts, it may dispense with or relax, in consultation with the Commission, the requirement of the rules and the regulations made thereunder to such extent and subject to such conditions, as it may consider necessary”.
