Subject:- Compliance of the directions of the Hon’ble High Court of Patna in C.W.J.C. No. 5381/ 2007, dated 16.01.2009 and L.P.A. No. 889/2009 dated 04.08.2009 – revision of allocation of Shri Suman Gupta, Assistant, Food, Public Distribution and Consumer Affairs Department, Jharkhand Government.

Sir,
I am directed to refer to the subject mentioned above and to say that Shri Suman Gupta, Asstt. Was allocated the State of Jharkhand vide this Department’s communication No. 85B/(Jha)/2008 dated 2.6.2008. In a Writ Petition filed by Shri Suman Gupta against his final allocation, the Hon’ble High Court of Bihar directed the State Advisory Committee/ Central Govt. vide its Judgement dated 16.01.2009 in the C.W.J.C. No. 5381/2007 for taking necessary action within a period of 8 weeks from the date of receipt of proposal from the State Government on the representation of the petitioner.
2. The State Govt. filed a LPA No. 889/2009 against the judgement dated 16.01.2009 of the Hon’ble High Court and it was dismissed on 4.08.2009 in the absence of any merit in the appeal. Aggrieved with the judgement dated 16.01.2009 and 4.08.2009 of the Hon’ble High Court, the Govt. of Bihar filed a SLP in the Hon’ble Supreme Court, which was dismissed on 11-12-2009.
3. Based on the information provided by the State Govt., the Central Govt. had considered the representation of the petitioner in the capacity of general category candidate for his re-allocation from the State of Jharkhand to the State of Bihar in compliance with the directions dated 16.01.2009 of the Hon’ble High Court of Patna and acceded his representation for re-allocation as per his option for Bihar. To this effect the final allocation order No. 85B(Jha)/2008 dated 02.06.2008 of the Central Govt. is deemed to be modified accordingly.
