Central Civil Services (Temporary Service) Amendment Rules, 2004

This notification announces amendments to the Central Civil Services (Temporary Service) Rules, 1965, effective January 1st, 2004. The changes involve omitting specific clauses from sub-rule (1-A) of rule 10 and inserting a new sub-rule (7) to rule 10, extending its provisions to government servants appointed on or before December 31st, 2003. A new pension system based on defined contribution has been introduced for those recruited to government service from January 1st, 2004, but this will not affect existing government servants. The notification also lists previous amendments to these rules dating back to 1965. It is distributed to various government ministries, departments, and related organizations for their awareness and implementation.

Notification

GSR—- In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Temporary Service) Rules, 1965, namely:-

  1. (1) These rules may be called the Central Civil Services (Temporary Service) Amendment Rules, 2004.
    (2) They shall be deemed to have come into force on the 1st day of January, 2004.

  2. In the Central Civil Services (Temporary Service) Rules, 1965, in rule 10,-
    (i) in sub-rule (1-A), the words “clause (a) or, as the case may be, clause (b), of” shall be omitted;
    (ii) after sub-rule (b), the following sub-rule shall be inserted, namely:-
    “(7) The provisions of rule 10 shall apply to Government servants appointed on or before the 31st day of December, 2003”.

Explanatory Memorandum

A New Pension System based on defined contribution has been introduced in respect of persons recruited to Government service from the 1st day of January, 2004. As the New Pension System shall not be applicable to existing Government servants, the interest of the existing employees shall not be adversely affected by giving retrospective effect to the amendment.
