NOTIFICATION

New Delhi, tire 28th July, 1998

G.S.R. No. 412 (E).—In partial modification of this Department’s Notification No. 31011/7/97-Estt. (A) dated the 20th October, 1997 and in exercise of the powers conferred by the proviso lo Article 309 and Clause (5) of Article 148 of the Constitution and in consultation with the Comptroller and Auditor General of India, in regard to persons serving the Indian Audit and Accounts Department, the President hereby makes the following ruler, namely:

  1. These rules may be called the Central Civil Services (Leave Travel Concession) First Amendment Rules, 1998.
  2. They shall come into force from 1-10-98.
  3. In Sub-Rule 4 at (d) the existing definition of the “Family” shall be substituted as Under:
    • (d) ‘Family’ means:
      • (i) the Government servant’s wife or husband, as the case may be, and two surviving unmarried children or step children wholly dependent on the Government servant, irrespective of whether they are residing with the Government servant or not;
      • (ii) married daughters who have been divorced, abandoned or separated from their husbands and are residing with the Government servant and are wholly dependent on the Government servant;
      • (iii) parents and/or step mother residing with and wholly dependent on the Government servant;
      • (iv) unmarried minor brothers as well as unmarried, divorced, abandoned, separated from their husbands or widowed sisters residing with and wholly dependent on the Government servant, provided their parents are either not alive or are themselves wholly dependent on the Government servant.

EXPLANATIONS:

  1. The restriction of the concession to only two surviving children or step children shall not be applicable in respect of (i) these employees who already have more than two children prior to the coming into force of this restriction i.e. 20-10-1997; (ii) children born within one year of the coming into force of this restriction; (iii) where the number of children exceeds two as a result of second child birth resulting in multiple births.

  2. Not more than one wife is included in the term “Family” for the purpose of these Rules. However, if a Government servant has two legally wedded wives and the second marriage is with the specific permission of the Government, the second wife shall also be included in the definition of “Family”.

  3. Though it is not necessary for the spouse and children to reside with the Government servant so as to be eligible for the Leave Travel Concession, the concession in their cases shall, however, be restricted to the actual distanta travelled or the distance between the headquarters/place of posting of the Government servant and the hometown/place of visit, whichever is less.

  4. Children of divorced, abandoned, separated from their husbands or widowed sisters are not included in the term “Family”.5. A member of the family whose income from all sources, including pensinn, temporary increase in pension but excluding dearness refief on pension or stipend etc. does not exceed Rs. 1500 p.m. is deemed to be wholly dependent on the Government servant.
    (4). In Rule 12 for the existing sub-rule 1, the following shall be substituted :-
    (A) Journey by Air/Rail :

Pay Range

  • Rs. 18.400 and above.

Rs. 16,400 and above but less than Rs. 18,400.
Rs. 8,000 and above but less than Rs. 16,400.
Rs. 4,100 and above but less than Rs. 8,000.
Below Rs. 4.100.

Entitlement

Air Economy (Y) Class by National Carriers or AC First Class by train, at their option.
A.C. First Class.

II AC II-Tier Sleeper.
First Class/AC III-Tier Sleeper/AC Chair Car*
Second Sleeper.
*All Government servants who are entitled to travel on L.T.C. by First Class/ AC III-Tier Sleeper/AC Chair Car may, at their discretion, travel by AC II-Tier sleeper in cases where any of the trains connecting the originating and destination stations concerned by the direct shortest mute do not provide these three classes of accommodation.

Travel by Shatabdi Express Trains :

Note : Entitlement by Rajdhani/Shatabdi Trains would be applicablein cases where journey is actually undertaken by these trains and not for determining entitlement on national basis. Both ends of the journey i.c. place of start of the journey and the destination should be directly connected by Rajdhani/Shatabdi Express.
(B). Journey by sea or by River Steamer :

Pay Range

Rs. 8,000 and above
Rs. 6.500 and above but less than Rs. 8,000.
Rs. 4.100 and above but less than Rs. 6,500.
Below Rs. 4,100
Accommodation entitlements for travel between the mainland and the Andaman \& Nicobar Group of Islands and the Lakshadweep Group of Islands by ships operated by the Shipping Corporation of India Limited will be as follows :-

Pay Range

Rs. 8,000 and above.
Rs. 6.500 and above but less than Rs. 8.000 .
Rs. 4,100 and above but less than Rs. 6,500.
Less than Rs. 4,100.
(C) Journey by Road

Pay Range
(1) Rs. 18.400 and above

Entitlement

Deluxe Class
First/’A’ Cabin Class
Second/’B’ Cabin Class
Bunk Class

Entitlement

.. Actual fare by any type of public bus, including airconditioned bus: OR
At prescribed rates for AC Taxi/Taxi (AC Taxi when the journey is actually performed by AC Taxi) for journey to the places not connected by rail subject to wndition that the claim shall be(ii) Rs. 8,000 and above but less than Rs. 18.400.
(iii) Rs. 6.500 and above but less than Rs. 8,000.
(iv) Rs. 4.100 and above but less than Rs. 6.500.
(iv) Below Rs. 4.100 restricted to the bus fare by entitled class or the fare actually paid, whichever is less.
Same as at (i) above with the exception that journeys by AC Taxi will not be permissible.
Same as at (ii) above with thccxceplion that journeys by airconditioned bus will not be permissible.
Actual fare by any type of public bus other than airconditioned bus. OR
At prescribed rate for autorickshaw for journey to places not connected by rail subject to condition that the claim shall be restricted to bus fare by entitled class or the fare actually paid, whichever is less.
As at (iv) above with the condition that the claim shall be re stricted to the bus fare by ordinary bus.
Note : In all cases of travel by AC Taxi. Taxi or Autorickshaw, production of fare receipt will be necessary
