These rules further amend the Central Civil Services (Classification, Control and Appeal) Rules, 1965. Specifically, they clarify the authority competent to impose penalties on probationers undergoing training at the Lal Bahadur Shastri National Academy of Administration. The Director of the Academy will now have this authority after following the prescribed procedure. The definition of ‘probationer’ is also clarified for the purposes of this rule.

नई दिल्ली, 1 नवम्बर, 1977
का = आ = 3573 — राष्ट्रपति, मंत्रिपाल के अनुच्छेद 309 के तहत और अनुच्छेद 148 के क्रम (5) द्वारा प्रबल शक्तियों का प्रयोग करते हुए, केन्द्रीय सिविल सेवा (वर्गीकरण, नियंत्रण और प्रगति) नियम, 1965 में और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् —
- (1) इन नियमों का नाम केन्द्रीय सिविल सेवा (वर्गीकरण, नियंत्रण और प्रगति) द्वितीय संशोधन नियम, 1977 है।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रमुख होंगे।
- केन्द्रीय सिविल सेवा (वर्गीकरण, नियंत्रण और प्रगति) नियम, 1965 में, नियम 12 में उपनियम (4) में क्रम (ख) के नीचे के स्पष्टीकरण को स्पष्टीकरण II के रूप में पूरा संस्थांकित किया जाएगा और इस प्रकार पुनः संस्थांकित स्पष्टीकरण से पूर्व निम्नलिखित क्रम और स्पष्टीकरण प्राप्त स्थापित किया जाएगा, अर्थात् —
(ग) लाल बहादुर शास्त्री राष्ट्रीय प्रशासन धरूखमी में प्रशिक्षण प्राप्त कर रहे परिसीक्षाधीन व्यक्तियों की वादन उक्त धरूखमी का निर्देशक नियम 16 में अधिकांश प्रक्रिया का सम्पादन करने के पश्चात् नियम 11 के क्रम (i) और (iii) में विनिर्दिष्ट शक्तियों में से कोई भविष्य अधिरोपित करने के लिए सक्षम प्राधिकारी होगा।
स्पष्टीकरण – 1: क्रम (ग) के प्रयोजनों के लिए परिसीक्षाधीन व्यक्ति से केन्द्रीय सिविल सेवा में परीक्षित पर नियुक्त व्यक्ति समिति है।

S.O. 3573.—In exercise of the powers conferred by the proviso to article 309, and clause (5) of article 148 of the Constitution, the President hereby makes the following rules further to amend the Central Civil Services (Classification, Control and Appeal) Rules, 1965, namely —
- (1) These rules may be called the Central Civil Services (Classification, Control and Appeal) Second Amendment Rules, 1977.
(2) They shall come into force on the date of their publication in the Official Gazette.
- In the Central Civil Services (Classification, Control and Appeal) Rules, 1965, in rule 12, in sub-rule (4), the Ex-planation under clause (b) shall be renumbered as Explanation II. and before the Explanation shall be inserted, namely :-
“ic) in respect of a probationer undergoing training at the Lal Bahadur Shastri National Academy of Administration the Director of the said Academy shall be the authority competent to impose on such probationer any of the penalties specified in clauses
(i) and (iii) of rule 11 after observing the procedure laid down in rule 16 .
Explanation I.-For the purposes of clause (c), probationer means a person appointed to a Central Civil Service on probation.”
