G.S.R. 55(E).-In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution, and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Classification, Control and Appeal) Rules, 1965, namely:-
- (1) These rules may be called the Central Civil Services (Classification, Control and Appeal) Amendment Rules, 2009.
(2) They shall come into force on the date of their publication in the Official Gazette. - In the Central Civil Services (Classification, Control and Appeal) Rules, 1965, in rule 11, for clause (vi), the following clause shall be substituted, namely :-
“(vi) reduction to lower time-scale of pay, grade, post or Service for a period to be specified in the order of penalty, which shall be a bar to the promotion of the Government servant during such specified period to the time-scale of pay, grade, post or Service from which he was reduced, with direction as to whether or not, on promotion on the expiry of the said specified period-
(a) the period of reduction to time-scale of pay, grade, post or service shall operate to postpone future increments of his pay, and if so, to what(b) the Government servant shall regain his original seniority in the higher time scale of pay, grade, post or service;”
