सा. का. नि. 225.—राष्ट्रपति, संविधान के अनुच्छेद 309 के
परन्तुक तथा अनुच्छेद 148 के खण्ड (5) द्वारा प्रदत्त शक्तियों का
प्रयोग करते हुए तथा भारतीय लेखा परीक्षा तथा लेखा विभाग में कार्यरत
व्यक्तियों के संबंध में भारत के नियंत्रक तथा महालेखापरीक्षक के परामर्श
से केन्द्रीय सिविल सेवा (वर्गीकरण, नियंत्रण और अपील) नियमावली,
1965 में आगे और संशोधन करने के लिए एतद्द्वारा निम्नलिखित
नियम बनाते हैं, अर्थात् :—

1. (1) इन नियमों का नाम “केन्द्रीय सिविल सेवा (वर्गीकरण,
   नियंत्रण और अपील) संशोधन नियमावली, 2004” है।

(2) ये नियम शासकीय राजपत्र में इनके प्रकाशन की
तारीख से लागू होंगे।

1. केन्द्रीय सिविल सेवा (वर्गीकरण, नियंत्रण तथा अपील)
   नियमावली, 1965 के नियम 14, उप नियम (2) में स्पष्टीकरण से
   पहले, निम्नलिखित परन्तुक शामिल किया जाएगा, अर्थात् :—

“परन्तु यह कि, जहाँ यौन उत्पीड़न की शिकायत, केन्द्रीय सिविल
सेवा (आचरण) नियमावली, 1964 के नियम 3ग के अभिप्राय
के अंतर्गत आती हो, वहां प्रत्येक मंत्रालय अथवा विभाग अथवा
कार्यालय में ऐसी शिकायतों की जाँच-पड़ताल करने के लिए
गठित की गई शिकायत समिति को, ऐसे नियमों के प्रयोजन से
अनुशासनिक प्राधिकारी द्वारा नियुक्त किया गया जाँच प्राधिकारी
समझा जाएगा और यदि, यौन उत्पीड़न की शिकायतों की जाँच-
पड़ताल करने के लिए शिकायत समिति के लिए कोई पृथक
प्रक्रिया निर्धारित नहीं की गई है तो शिकायत समिति, जहाँ तक
हो सके, इन नियमों में निर्धारित की गई प्रक्रिया के अनुसार
व्यवहार्य तरीके से जाँच-पड़ताल करे।”

New Delhi, the 1st July, 2004
G.S.R. 225.-In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution, and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audil and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Classification, Control and Appeal) Rules. 1965, namely :-

1. (1) These rules may be called the Central Civil Services (Classification, Control and Appeal) Amendment Rules, 2004.
   (2) They shall come into force from the date of their publication in the Official Gazette.
2. In the Central Civil Services (Classification, Control and Appeal) Rules, 1965, in rule 14 in sub-rule (2), before the Explanation, the following proviso shall be inserted, namely :-
   “Provided that where there is a complaint of sexual harassment within the meaning of rule 3 C of the Central Civil Services (Conduct) Rules, 1964, the Complaints Committee established in each Ministry or Department or Office for inquiring into such complaints, shall be deemed to be the inquiring authority appointed by the disciplinary authority for the purpose of these rules and the Complaints Committee shall hold, if separate procedure has not been prescribed for the Complaints Committee for holding the inquiry into the complaints of sexual harassment, the inquiry as far as practicable in
   accordance with the procedure laid down in these ruled.”
