द्वारा विधि के अन्तर्गत बनाए और जारी किये गए साधारण सांविधिक नियम (जिनमें साधारण प्रकार के
आदेश, उपनियम आदि सम्मिलित है)
General Statutory Rules (including Orders, Bye-laws etc. of a general
Character) issued by the Ministries of the Government of India (other
than the Ministry of Defence) and by the Central Authorities (other
than the Administration of Union Territories)

आ. का. नि. 236.—राष्ट्रपति संविधान के अनुच्छेद 389 के प्रस्तुके
तथा अनुच्छेद 146 के खण्ड (5) द्वारा प्रदान करिश्यो का प्रक्षेप करते
हुए तथा भारतीय लेखा-परीक्षा एवं लेखा विभाग ने कार्यरत कार्यशैली के
सम्बन्ध में भारत की गणराज्य एवं महानिदेशक परीक्षा के परामर्श में
केंन्द्रीय सिविल सेवा (वर्गीकरण, नियक्षण एवं भविष्य) नियमावली,
1965 में और आगे संयोजन करने के लिये निष्कर्ष (वित्त निधन कराने
के) आयोजन—

1. (1) इन नियमों का नाम केन्द्रीय निर्दिष्ट सेवा (वर्गीकरण,
   नियंत्रण तथा भविष्य) संशोधन नियमावली, 1995 होगा।

(2) ये सरकारी राजस्व में इनके प्रकाशन की तारीख को प्रवृत्त
होंगे। केन्द्रीय सिविल सेवा (वर्गीकरण, नियंत्रण तथा भविष्य) नियमावली, 1965 में,

(क) नियम 15 में, उप नियम (1) के पंरवान् निधन उप नियम
भारत-प्रमाणित किया जायेगा, अर्थात्—

“(1क) धनुप्रासंगिक प्राधिकारी स्वयं द्वारा की गई जांच, यदि
कोई हो, की रिपोर्ट की एक प्रति अथवा जहां धनुप्रासंगिक प्राधिकारी
जांच प्राधिकारी न हो, तो जांच प्राधिकारी की रिपोर्ट की एक प्रति
उन सरकारी कर्मचारी को प्रेषित करेगा अथवा प्रेषित करवायेगा जिनमे
(सरकारी कर्मचारी) यदि वह चाहे तो इन बात को ध्यान में रखे बिना
1249 GI/95—1.

कि रिपोर्ट उनके पक्ष में है अथवा न ही सखद दिन के भीतर धनुप्रासंगिक प्राधिकारी को अपना लिखित धरुपार्करत प्रस्तुत करने की अपेक्षा की जायेगी।”

“(1ख) धनुप्रासंगिक प्राधिकारी उप निधन (2) से (4) तक
में निर्विचित बंव से भागें की कार्रवाई मे पूर्व सरकारी कर्मचारी द्वारा
प्रस्तुत धरुपार्करत प्रति कोई हो, पर विचार करेगा।”

(ख) नियम 17 के लिये, निष्कर्षाधिकृत नियम प्रतिस्थापित किया जायेगा, अर्थात्—

“17 भारोपों का सम्मेलन—

धनुप्रासंगिक प्राधिकारी द्वारा लिये गये धार्मिक सरकारी कर्मचारी
की संबंधित किये जायेगे तथा उसे भारतीय की प्रार्थक पद पर
धनुप्रासंगिक प्राधिकारी के निष्कर्षों की प्रति भी भेजी जायेगी अथवा
जहां धनुप्रासंगिक प्राधिकारी जांच प्राधिकारी न हो, वहां धनुप्रासंगिक
प्राधिकारी के निष्कर्षों का विवरण उनकी असहनीति के मॉडल्स कारणों
महित यदि कोई हो, जांच प्राधिकारी के निष्कर्ष तथा धार्मिक द्वारा
दिये गये परामर्श यदि कोई हो, की प्रति भी तथा जहां धनुप्रासंगिक
प्राधिकारी ने धार्मिक के परामर्श को नहीं माना है वहां परामर्श न
मालने के कारणों का मॉडल विवरण भी सरकारी कर्मचारी की
भेजा जायेगा।”

G.S.R. 276. -In exercise of the powers conferred by the proviso to article 30 y , and clause (5) in article 148 of the Constitution, and after consultation with the Comptroller and Auditor General of India in Relation to persons serving in the Indian Aud $i$ and Accounts Dipartment, the President hereby makes the following rules further to amend the (Central Civil Services (ClassiEcation, Control and Appeal) Rules, 1965, namely :-

1. (1) These: rules may be called the Central Civil Services (Classification, Control and Appeal) Amendment Rules, 1995.
   (2) They shall coms into force on the date of their publ cation in the offe al Gazette.
2. In the Central C vil Services (Classifcation, Control and Appeal) Rules, 1965.
   (a) in rule 15 , after sub-rule (1), the following sub-rules shall be inserted, namely :-
   “(IA) The disciplinary authority shall forward or cause to be forwarded a copy of the report of the inquiry, if any, held by the disciplinary authority of where the disciplinary authority is not the inquiring nulhority a copy of the report of the inquiring authority to the Government servant who shall be required to submit, if he so desires, his written representation or submission to the disciplinary authority within fifteen days, irrespective of whether the report is favourable or not to the Givemment servant.”
   “(IB) The disciplinary authority shall consider the representation, if any, submitted by the Government servant before proceeding further in the manner specified in subrules (2) to (4).”
   (b) Por rule 17, the following rule shall be substituted namely :-
   “17 Communication of orders.
   Orders made by the disciplinary authority shall be communicated to the Government servant who shall also be supplied with a copy of its finding on each article of chage,

or where the disciplinary authority is not the inquiring authority, a statement of the findings of the disciplinary authority together with brief reasons for it= d’sagreement if any, with the fadings of the inquiring authority and slso a copy of the advice, if any, given by the Commission, and where the disciplinary authority has not acespted the advice of the Comm’ssion, a brief statement of the reasons of such non-acceptance.”
