This notification introduces amendments to the Central Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Rules, 1985. The key change is the provision for retirement gratuity for members who have completed five years of service. सा.का.नि. 874(अ).—केन्द्रीय सरकार, प्रशासनिक अधिकरण अधिनियम, 1985 (1985 का 13) की धारा 35 की उप-धारा (2) के रूप में, और धारा 36क के साथ पंडित उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों के वेतन और भत्ते तथा सेवा की शर्तें) नियम, 1985 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्—
- (1) इन नियमों का संक्षिप्त नाम केन्द्रीय प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों के वेतन और भत्ते तथा सेवा की शर्तें) (दूसरा संशोधन) नियम, 2009 है।
(2) ये नियम 19 फरवरी, 2007 से पूर्व नियुक्त किए गए केन्द्रीय प्रशासनिक अधिकरण के अध्यक्ष, उपाध्यक्ष और सदस्यों को लागू होंगे।
(3) ये 10 अगस्त, 1985 से प्रवृत हुए समझे जाएंगे।
- उक्त नियमों के नियम 8 में, उप-नियम (2) के पश्चात् निम्नलिखित उप-नियम अंत:स्थापित किया जाएगा, अर्थात्—
“(3) उपदान:—ऐसे सदस्य जिन्होंने केन्द्रीय प्रशासनिक अधिकरण में पांच वर्ष की सेवा पूरी कर ली है परिलब्धियों के अधिकतम साढ़े सोलह गुणा के अध्यक्ष/सदस्य/सदस्य/सदस्य के लिए परिलब्धियों के एक चौथाई के बराबर सेवानिवृत्ति उपदान के लिए हकदार होंगे।
परंतु इस खंड के अधीन किसी सदस्य को संदेश उपदान की कुल रकम तथा केन्द्रीय प्रशासनिक अधिकरण में कार्यभार ग्रहण करने से पूर्व किसी संगठन या विभाग में की गई सेवा की बाबत उसके द्वारा प्राप्त किए गए उपदान की रकम सरकारी सेवा से उसकी सेवानिवृत्ति के समय पर अखिल भारतीय सेवा के अधिकारियों के लिए केन्द्रीय सरकार द्वारा विनिर्दिष्ट उपदान की अधिकतम रकम से अधिक नहीं होगी।”

स्पष्टीकरण ज्ञापन
केन्द्रीय सरकार ने केन्द्रीय प्रशासनिक अधिकरण के ऐसे उप सदस्यों को सेवा निवृत्ति उपदान अनुदत्त करने का विनिश्चय किया है जो केन्द्रीय प्रशासनिक अधिकरण में उनके द्वारा की गई सेवा के लिए 19 फरवरी, 2007 से पूर्व नियुक्त किए गए थे और तदनुसार केन्द्रीय प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों के वेतन और भत्ते तथा सेवा की शर्तें) नियम, 1985 को भूतलक्षी प्रभाव से संशोधित किया जा रहा है।
- यह प्रमाणित किया जाता है कि केन्द्रीय प्रशासनिक अधिकरण के अध्यक्ष, उपाध्यक्ष और सदस्य पर प्रस्तावित संशोधन को भूतलक्षी प्रभाव दिए जाने से कोई प्रतिकूल प्रभाव पड़ने की संभावना नहीं है।

NOTIFICATION
New Delhi, the 9th December, 2009
G.S.R. 874(E).-In exercise of the powers conferred by sub-section (1) read with clause (c) of sub-section (2) of Section 35 and Section 36A of the Administrative Tribunals Act, 1985 (13 of 1985), the Central Government hereby makes the following rules further to amend the Central Administrative Tribunals (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Rules, 1985, namely :-
- (1) These rules may be called the Central Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) (Second Amendment) Rules, 2009.
(2) These rules shall be applicable to the Chairman, Vice-Chairmen and Members of the Central Administrative Tribunal appointed before the 19th February, 2007.
(3) They shall be deemed to have come into force with effect from the 10th August, 1985. - In rule 8 of the said rules, after sub-rule (2), the following sub-rule shall be inserted, namely :-
“(3) Gratuity :-The Members who have completed five years of service in the Central Administrative Tribunal shall be entitled for a retirement gratuity equal to one-fourth of the emoluments for each completed period of six months of service subject to a maximum of sixteen and half time of the emoluments:
Provided that the total amount of gratuity payable to a Member under this clause and the amount of gratuity drawn by him in respect of services rendered in an organisation or department before joining Central Administrative Tribunal shall not exceed the maximum amount of gratuity specified by the Central Government for officers of All India Service at the time of his retirement from Government service.”

Explanatory Memorandum
The Central Government has decided to grant retirement gratuity to the Members of the Centra! Administrative Tribunal who were appointed before 19th February, 2007 for the service rendered by them in the Central Administrative Tribunal and accordingly, the Central Administrative Tribunal (Salaries and Allowance and Conditions of Service of Chairman, Vice-Chairmen and Members) Rules, 1985 are being amended with retrospective effect.
2. It is certified that no Chairman, Vice-Chairman and Member of the Central Administrative Tribunal is likely to be affected adversely by the proposed amendment being given retrospective effect.
