सा.का.नि. 548(अ).—केनुद्रीय सरकार, प्रशासनिक अधिकरण अधिनियम, 1985 (1985 का 13) की धारा 36 के खंड (ख) के साथ पठित धारा 13 की उप-धारा (2) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय प्रशासनिक अधिकरण [कर्मचारीवृन्द] (सेवा की शर्तें) नियम, 1985 को, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, केनुद्रीय प्रशासनिक अधिकरण के अधिकारियों और अन्य कर्मचारियों के वेतन और भत्ते तथा सेवा की शर्तों का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात् :-
- संक्षिप्त नाम और प्रारंभ.-(1) इन नियमों का संक्षिप्त नाम केनुद्रीय प्रशासनिक अधिकरण (अधिकारियों और कर्मचारियों के वेतन, भत्ते और सेवा की शर्तें) नियम, 2015 है।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे। - परिभाषाएं.-(1) इन नियमों में जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-
(क) “अधिनियम” से प्रशासनिक अधिकरण अधिनियम, 1985 (1985 का 13) अभिप्रेत है;
(ख) “अनुसूची” से इन नियमों से संलग्न अनुसूची अभिप्रेत है;
(ग) “अधिकरण” से अधिनियम की धारा 4 की उप-धारा (1) के अधीन स्थापित केन्द्रीय प्रशासनिक अधिकरण अभिप्रेत है। (2) उन शब्दों और पदों के, जो इन नियमों में प्रयुक्त हैं और परिभाषित नहीं हैं किन्तु अधिनियम में परिभाषित हैं, वही अर्थ होंगे जो उस अधिनियम में क्रमशः उनके समनुदेशित हैं। 3. पद-संख्या, वर्गीकरण, वेतन-बैंड और ग्रेड वेतन या वेतनमान.-पद – संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची में यथानिर्दिष्ट हैं। 4. सेवा की शर्तें.-वेतन, भत्ते, छुट्टी, कार्यग्रहण की अवधि, कार्यग्रहण अवधि वेतन, भविष्य निधि, अधिवर्षिता की आयु, यात्रा भत्ता और छुट्टी यात्रा रियायत, पेंशन और सेवानिवृत्ति फायदे, चिकित्सीय सुविधाओं और सेवा की अन्य शर्तों के संबंध में अधिकरण के अधिकारियों और अन्य कर्मचारियों की सेवा की शर्तों को, ऐसे नियमों और विनियमों के अनुसार विनियमित किया जाएगा जो केन्द्रीय सरकार के अधिकारियों और कर्मचारियों की तत्थ्यानी वेतन बैंड और ग्रेड वेतन या वेतनमान यथास्थिति समूह ‘क’, समूह ‘ख’ और समूह ‘ग’ के केन्द्रीय सरकार के अधिकारियों और कर्मचारियों को समय-समय पर लागू होते हैं। 5. अवशिष्ट उपबंध. -अधिकरण के अधिकारियों और कर्मचारियों की सेवा की शर्तों और निबंधनों संबंधी किन्हीं विषयों की बाबत जिनका इन नियमों में कोई स्पष्ट उपबंध नहीं किया गया है, अधिकरण द्वारा इसके विनिश्चय के लिए केन्द्रीय सरकार को विनिर्दिष्ट किया जाएगा। 6. शिथिल करने की शक्ति—केन्द्रीय सरकार को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत इन नियमों के किन्हीं उपबंधों को शिथिल करने की शक्ति होगी। [सं. ए-11013/11/2014-ए.टी] देवेश चतुर्वेदी, संयुक्त सचिव

G.S.R. 548(E).-In exercise of the powers conferred by sub-section (2) of section 13 read with clause (b) of section 36 of the Administrative Tribunals Act, 1985 (13 of 1985) and in supersession of the Central Administrative Tribunal [Staff] (Conditions of Service) Rules, 1985, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the salaries and allowances and conditions of service of the officers and other employees of the Central Administrative Tribunal, namely:-
- Short title and commencement. – (1) These rules may be called the Central Administrative Tribunal (salaries, allowances and conditions of service of the officers and employees) Rules, 2015.
(2) They shall come into force on the date of their publication in the Official Gazette. - Definitions. – (1) In these rules, unless the context otherwise requires,-
(a) “Act” means the Administrative Tribunals Act, 1985 (13 of 1985);
(b) “Schedule” means the Schedule annexed to these rules;
(c) “Tribunal” means the Central Administrative Tribunal established under sub-section (1) of section 4 of the Act.
(2) The words and expression used and not defined in these rules, but defined in the Act shall have the same meanings respectively assigned to them in the Act. - Number of posts, classification, pay band and grade pay or pay scale. – The number of posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in the Schedule annexed to these rules.
- Conditions of Service. – The conditions of service of the officers and employees of the Tribunal in the matters of pay, allowances, leave, joining time, joining time pay, provident fund, age of superannuation, travelling allowance and leave travel concession, pension and retirement benefits, medical facilities and other conditions of service shall be regulated in accordance with such rules and regulations as are from time to time applicable to officers and employees of the Central Government belonging to Group ‘ $A$ ‘, Group ‘ $B$ ‘ and Group ‘ $C$ ‘, as the case may be, of the corresponding pay band and grade pay or pay scale of officers and employees of the Central Government.
- Residuary provision. – Matters relating to the terms and conditions of service of the officers and employees of the Tribunal with respect to which no express provision has been made in these rules, shall be referred by the Tribunal to the Central Government for its decision.
- Power to relax. – The Central Government shall have power to relax the provisions of any of these rules in respect of any class or category of persons.
