नए. का. नि. 33(स):—प्रशासनिक स्रोत, प. 8 (दिनियम, 1985 (1985 का 13) की धारा 36 के खंड (क) तथा धारा 35 के खंड (च), धारा 12 द्वार, प्रदत्त जक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार, केन्द्रीय प्रशासनिक अधिकरण (वित्तीय तथा प्रशासनिक जक्तियां) नियमावली, 1985 में संशोधन करने के लिये एतद्वारा निम्नलिखित नियम बनाती है, अर्थात्:—
- संक्षिप्त नाम तथा प्रारम्भ: (1) इन नियमों का नाम केन्द्रीय प्रशासनिक अधिकरण (वित्तीय तथा प्रशासनिक जक्तियां) संशोधन नियमावली, 1987 है।
(2) ये नियम सरकारी राजपथ में इनके प्रकाशन की तारीख को प्रवृत्त होंगे।
- केन्द्रीय प्रशासनिक अधिकरण (वित्तीय तथा प्रशासनिक जक्तियां) नियमावली, 1985 (जिसे इसके बाद उत्तर नियम कहा जायेगा) में (1) नियम 4 के लिये निम्नलिखित प्रतिस्थापित किया जायेगा, अर्थात्:—
“संघर्ष की जक्तियां:—संघर्ष की वही जक्तियां प्रदत्त होंगी जो केन्द्रीय सरकार के किसी विभाग को वित्तीय जक्ति प्रत्यायोजन नियमावली, 1978, सामान्य वित्तीय नियमावली, मूल तथा सनपूरक नियमावली केन्द्रीय मिश्रित सेवा (झुंटूटी) नियमावली, 1972 केन्द्रीय मिश्रित सेवा (कार्यभट्टण) नियमावली, 1979 केन्द्रीय मिश्रित सेवा (संरक्षण) नियमावली, 1964, केन्द्रीय मिश्रित सेवा (वर्गीकरण, नियंत्रण तथा धार्मिक) नियमावली, 1965 तथा सामान्य भविष्य निधि (केन्द्रीय सेवाएँ) नियमावली, 1960 के संबंध में प्रदत्त है।
किन्तु घने यह है कि वित्तीय गतिविधों का प्रयोग सरकार द्वारा समय-समय पर जारी किये जाने वाले क्रियाविधि संबंधी सच्चा सत्य प्रकार के अनुदेशों के सध्यक्षीय और अधिकरण के वित्तीय सलाहकार तथा मुख्य लेखो अधिकारी की सलाह प्राप्त करने के बाद होगा:
किन्तु साये यह भी गर्न है कि जो धाने सध्यक्ष की सधिकारिता के क्षेत्र में नहीं खाती है उनके संबंध में सध्यक्ष द्वारा क्रमिक और प्रशिक्षण विभाग के माध्यम से वित्त मंत्रालय या किसी सत्य प्राधिकारी की सहमति प्राप्त करती होगी।”
(2) उक्त नियमों की समुग्री को विलोपित कर दिया जायेगा।

NOTIFICATION
G.S.R. 33(E).—In exercise of the powers conferred by section 12, clause (f) of section 35 and clause (a) of section 36 of the Administrative Tribunals Act, 1985 (13 of 1985), the Central Government hereby makes the following rules to amend the Central Administrative Tribunal (Financial and Administrative Powers) Rules, 1985, namely:—
- Short title and commencement.—(1) These rules may be called the Central Administrative Tribunal (Financial and Administrative Powers) Amendment Rules, 1987.

In the Central Administrative Tribunal (Financial and Administrative Powers) Rules, 1985 (hereinafter referred to as the said rules),—
(i) for rule 4, the following rule shall be substituted, namely:—
“4. Powers of Chairman.—The Chairman shall have the same powers as are conferred on a Department of the Central Government in respect of the Delegation of Financial Powers Rules, 1978, the General Financial Rules, 1963; the Fundamental and Supplementary Rules, the Central Civil Services (Leave) Rules, 1972, the Central Civil Services (Joining Time) Rules, 1979, the Central Civil Services (Conduct) Rules, 1964, the Central Civil Services (Classification, Control and Appeal) Rules, 1965 and the General Provident Fund (Central Services) Rules, 1960:
Provided that the exercise of the financial powers shall be subject to any procedural or other instructions issued from time to time by the Government and after obtaining the advice of the Financial Adviser and Chief Accounts Officer of the Tribunal:
Provided further that in respect of matters not within the competence of the Chairman, concurrence of the Ministry of Finance or any other authority shall be obtained by the Chairman through the Department of Personnel and Training.”
(ii) the Schedule to the said rules shall be omitted.
