The Ministry of Personnel, Public Grievances and Pensions has issued an amendment to the Central Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Rules, 1985. This amendment, effective retrospectively from January 1, 2006, introduces an age-related additional quantum of pension for Chairmen, Vice-Chairmen, and Members appointed before February 19, 2007. The additional pension ranges from 20% to 100% of the basic pension, depending on the pensioner’s age, with those aged 100 or more receiving the full basic pension.
This decision aims to grant these benefits for their service rendered in the Tribunal. An explanatory memorandum confirms that this amendment will not adversely affect any Chairman, Vice-Chairman, or Member of the Central Administrative Tribunal. The notification also lists previous amendments to the principal rules dating back to 1985.

सा.का.नि. 832(अ).—केन्द्रीय सरकार, प्रशासनिक अधिकरण अधिनियम, 1985 (1985 का 13) की धारा 35 की उप-धारा (2) के खंड (ग) और धारा 36क के साथ पंडित उसकी उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों के वेतन और भत्ते तथा सेवा की शर्तें) नियम, 1985 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :—
- (1) इन नियमों का संक्षिप्त नाम केन्द्रीय प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों के वेतन और भत्ते तथा सेवा की शर्तें) संशोधन नियम, 2010 है।
(2) ये नियम 19 फरवरी, 2007 से पूर्व नियुक्त किए गए केन्द्रीय प्रशासनिक अधिकरण के अध्यक्ष, उपाध्यक्ष और सदस्यों को लागू होंगे।
(3) ये 1 जनवरी, 2006 से प्रवृत्त हुए समझे जाएंगे।
- केन्द्रीय प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों के वेतन और भत्ते तथा सेवा की शर्तें) नियम, 1985 के नियम 8 के उप-नियम (2) के पश्चात् निम्नलिखित उप-नियम अंतःस्थापित किया जाएगा, अर्थात् :—
“(2क) पेंशन की आयु संबंधी अतिरिक्त मात्रा.—प्रत्येक अध्यक्ष, उपाध्यक्ष और सदस्य निम्नलिखित मानों के अनुसार पेंशन की अतिरिक्त मात्रा के लिए हकदार होगा :—

| नब्बे वर्ष से पचानवें वर्ष से कम | मूल पेंशन का 40 प्रतिशत |
| पचानवें वर्ष से सौ वर्ष से कम | मूल पेंशन का 50 प्रतिशत |
| सौ वर्ष या उससे अधिक | मूल पेंशन का 100 प्रतिशत |

स्पष्टीकारक ज्ञापन
केन्द्रीय सरकार ने, केन्द्रीय प्रशासनिक अधिकरण के ऐसे अध्यक्ष, उपाध्यक्ष और सदस्यों को, जो 19 फरवरी, 2007 से पूर्व नियुक्त किए गए थे, केन्द्रीय प्रशासनिक अधिकरण में उनको द्वारा की गई सेवाओं के लिए पेंशन की आयु संबंधी अतिरिक्त मात्रा प्रदान करने का विनिश्चित किया है और तदनुसार, केन्द्रीय प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों के वेतन और भत्ते तथा सेवा की शर्तें) नियम, 1985 को भूतलक्षी प्रभाव से संशोधित किया जा रहा है।
- प्रमाणित किया जाता है कि प्रस्तावित संशोधन को भूतलक्षी प्रभाव देने से केन्द्रीय प्रशासनिक अधिकरण के किसी अध्यक्ष, उपाध्यक्ष और सदस्य पर प्रतिकूल प्रभाव पड़ने की संभावना नहीं है।

NOTIFICATION
New Delhi, the 12th October, 2010
G.S.R. 832(E).—In exercise of the powers conferred by sub-section (1) read with clause (e) of sub-section (2) of Section 35 and Section 36A of the Administrative Tribunals Act, 1985 (13 of 1985), the Central Government hereby makes the following rules further to amend the Central Administrative Tribunals (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Rules, 1985, namely:—
- (1) These rules may be called the Central Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Amendment Rules, 2010.
- (2) These rules shall be applicable to the Chairman, Vice-Chairmen and Members of the Central Administrative Tribunal appointed before the 19th February, 2007.
- (3) They shall be deemed to have come into force with effect from the 1st January, 2006.

In the Central Administration Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Rules, 1985, in rule 8, after sub-rule (2), the following sub-rule shall be inserted, namely:—
“(2A) Age related additional quantum of pension.—Every Chairman, Vice-Chairmen and Members shall be entitled to an additional quantum of pension in accordance with the following scale:—

Explanatory Memorandum
The Central Government has decided to grant age related additional quantum of pension to the Chairman, Vice-Chairmen and Members of the Central Administrative Tribunal who were appointed before the 19th February, 2007 for the service rendered by them in the Central Administrative Tribunal and accordingly, the Central Administrative Tribunal (Salaries and Allowance and Conditions of Service of Chairman, Vice-Chairmen and Members) Rules, 1985 are being amended with retrospective effect.
- It is certified that no Chairman, Vice-Chairman and Member of the Central Administrative Tribunal is likely to be affected adversely by the proposed amendment being given retrospective effect.
