This Office Memorandum clarifies the procedure for carrying forward leave for employees of non-statutory departmental canteens who were declared Central Government employees on October 1, 1991. Prior to this date, their leave was governed by the Departmental Canteen Employees (Recruitment and Conditions of Service) Rules, 1980. The memorandum states that leave accrued before October 1, 1991, can be carried forward under the CCS(Leave) Rules, 1972, subject to the limits specified in those rules. This clarification is based on a previous ruling by the Establishment Division (Leave Section) and is to be communicated to all subordinate establishments.

OFFICE MEMORANDUM
Subject : Carry – forward of leave of non-statutory canteen employees.
Prior to declaration of employees working in non-statutory departmental canteens as Central Government employees with effect from 1.10.91, their services conditions were governed by “Departmental Canteen employees (Recruitment and Conditions of Service) Rules, 1980 “known as GSR-54 (since repealed w.e.f. 1.10.91 vide Notification No.3/1/93-Dir.(C) dated 15.12.94). After 1.10.91 their leave entitlements are required to be regulated as per provisions of CCS(Leave) Rules, 1972.
- However, the question of carrying forward of the leave standing to the credit of canteen employees as on 1.10 .91 to the new leave accounts under CCS(Leave) Rules had come up for examination in this Department. The undersigned is now directed to say that such carrying forward of the leave may be allowed to be carried forward as per a clarification given by the Establishment Division (Leave Section) of this Department. An extract of the clarification given in a related case by them is appended below for information and necessary action of all concerned.
” It is clarified that with reference to Rule 5(b) of CCS(Leave) Rules and on the lines of instructions issued as per para B of Appendix-I thereof, the leave held at the credit of canteen employees under the Departmental Canteen Employees (Recruitment and Conditions of Service) Rules, 1980 on the date of their coming over to regular Government establishment i.e. 1.10.91 may allowed to be carried forward subject to the limits laid down under the said Rules and Rule 26 of CCS(Leave) Rules”. - The above clarifications may please be brought to the notice of all subordinate Establishments.
