Approach Paper for Data Protection, Security, and Privacy Norms

The Department of Personnel and Training has released a draft approach paper seeking comments on the need for legislation regarding Data Protection and Security and Privacy Norms. This initiative follows requests from Civil Society Organizations and individuals for more time to provide feedback. The paper, available on the department’s website, invites public input on key issues, including whether legislation is necessary and what considerations should be made to ensure harmony between privacy laws and the Right to Information (RTI). Comments are due by October 27, 2010, and should be sent to Shri R.K. Girdhar.

Ref: Communication of even number dated $18^{\text {th }}$ October, 2010

A number of requests have been received from Civil Society Organizations and Individuals regarding extension of time to furnish comments on the above approach paper which is hosted on the Department of Personnel and Training’s website (www.persmin.nic.in).

It is hereby clarified that this is only a draft approach paper and public, have an occasion to comment on the legislation if and when it is decided to enact a legislation on the subject. At present your considered views may be given on the following key issues:

  • Is there a need for legislation on Data Protection and Security and Privacy Norms?
  • What are the issues that need to be kept in mind while framing any such legislation, so that the harmony is created between the Privacy laws and RTI.
