ORDER
WHEREAS, inter-alia the name of Smt. Jayshree Jha, a State Civil Service of Jharkhand was recommended by a Review Selection Committee held on 13.05.2014 to be included at SI. No. 4A, below the name of Shri Hansraj Singh ( SI. No.4) and above the name of Shri Samson Soi ( SI. No. 5), in the Select List of 2008-A, prepared by the original Selection Committee on 28.05 .2012 for promotion to IAS Cadre of Jharkhand:
AND WHEREAS, it was observed that in terms of Regulation 9(1) of IAS (Appointment by Promotion) Regulations, 1955 only a member of the State Civil Service could be appointed to IAS;
AND WHEREAS, in view of above rule position, appointment of Smt. Jayshree Jha could not notified.
AND WHEREAS, aggrieved by her non appointment to IAS, Smt. Jayshree Jha filed OA No 203/2016 before the Hon’ble CAT, Patna Bench, Circuit Bench, Ranchi.
AND WHEREAS, the Hon’ ble Tribunal, vide its judgement dated 21.12.2017 has allowed the OA with directions as under:
” 18. Therefore, the OA is allowed. The respondent no. 1, i.e. Union of India, through DoP\&T, is directed to issue the applicant’s promotion order to the IAS w.e.f. the date of her junior on notional basis, within three months of receipt of a copy of this order. On the basis of her notional appointment, her monthly pension shall be revised and fixed accordingly. No order as to back wages or arrears of pension and costs.”
NOW THEREFORE, in pursuance of directions of Hon’ble CAT, Patna Bench, Circuit Bench, Ranchi dated 21.12.2017 in OA No. 203/2016 Smt. Jayshree Jha will be deemed to have been appointed to IAS Cadre of Jharkhand with all consequential

benefits on the basis of inclusion of her name at SI. No. 4A, below the name of Shri Hansraj Singh (SI. No.4) and above the name of Shri Samson Soi (SI. No. 5), in the Select List of 2008-A not later than her immediate junior namely Sh. Samson Soi appointed to IAS on the basis of the same Select List of 2008-A.
