Appointment of Shri Ashok Kumar to IAS Cadre of Uttarakhand

This order details the reinstatement and promotion of Shri Ashok Kumar to the Indian Administrative Service (IAS) cadre of Uttarakhand. ORDER

Whereas, Sh. Ashok Kumar, a State Civil Service officer of Uttarakhand, was appointed by promotion to the Indian Administrative Service vide this department’s Notification No. 14015/23/2013-AIS.I(B) dated 21.03.2013 from the Select List of 2011;

And whereas, his name was also included at Sl. No. 4 in the consideration zone for the Select List of 2010. However, he was not recommended for inclusion in the Select List as he was assessed by the Selection Committee as ‘Unfit’, due to the penalty of withholding one increment with cumulative effect imposed by the State Government of Uttar Pradesh on 02.09.2004.

And whereas, aggrieved by this penalty order, Shri Ashok Kumar had filed WP No. 45178/2004 before the Hon’ble High Court of Allahabad.

And whereas, The Hon’ble High Court has disposed of the W.P vide its order dated 15.12.2017 with the following directions:

“Accordingly, the writ petition is allowed. The order impugned dated 2nd September, 2004 passed by the disciplinary authority imposing the penalty of withholding one annual increment with cumulative effect is set aside. The petitioner is declared entitled to have all consequential benefits”.

And whereas, in compliance with the above order, a Review Selection Committee Meeting was convened by UPSC on 30.06.2020 to reconsider the name of Shri Ashok Kumar for inclusion in the Select List of 2010 for promotion to IAS, Uttarkhand Cadre.

And whereas, on an overall assessment of his service records, the Review Committee recommended that the name of Shri Ashok Kumar at Sl. No. 3A below the name of Ms. Usha Shukla (SC) (Sl. No. 3) and above the name of Shri Indu Dhar at Sl. No. 4 in the Select List of 2010 prepared on 12.02.2013 for promotion to the IAS, Uttarkhand Cadre.

And whereas, the recommendations of the Review Committee have since been approved by the Union Public Service Commission on 02.09.2020.

Now therefore, in pursuance of directions of Hon’ble High Court, Allahabad contained in its order dated 15.12.2017 in WP No. 45178/2004 Shri Ashok Kumar (Date of Birth: 02.10.1960) shall be deemed to have been appointed to the IAS Cadre of Uttarakhand from the Select List of 2010 w.e.f. 21.03.2013 viz the date from which his immediate junior in the Select List Shri Indu Dhar was appointed to IAS with consequential benefits. His name shall now accordingly be inserted at Sl. No. 3A in this department’s Notification No. 14015/23/2013-AIS(I)B dated 21.03.2013. Consequently, Shri Ashok Kumar would be entitled year of allotment as 2004. As per Rule 4 of IAS (Regulation of Seniority) Rules, 1987, Shri Ashok Kumar shall be placed below Dr. B.V.R.C. Purushottam, junior most RR IAS officer of 2004 batch and above Shri Pankaj Kumar Pandey, the senior most RR IAS officer of 2005 batch of Uttarakhand cadre.
