Annual Leave with Wages for Industrial Workers

This Office Memorandum from the Government of India’s Ministry of Personnel Training, Administrative Reforms, Public Grievances and Pension Department addresses the issue of annual leave for industrial workers in Central Government Ministries/Departments, excluding those in Railways. Following a demand from the Staff Side of the National Council (JCM), the government has decided to increase the permissible number of annual leave spells from three to six within a calendar year. This decision is in accordance with the provisions of the Factories Act, 1948, and allows for liberalized terms through agreement. The memorandum is circulated to all relevant Ministries, Departments, and associated bodies for implementation and information.

OFFICE MEMORANDUM

Subject: Annual Leave with wages – Industrial workers other than Railways – Number of times leave may be taken – increase of three spells to six spells.

The undersigns is directed to say that in accordance with the provisions contained in Section 79(6) of the Factories Act, 1948, an Industrial Worker can avail annual leave only up three spells in calendar year. The Staff Side of the National Council (JCM) have been demanding that in respect of industrial workers in various Central Government Ministries/Departments the above limit may be increased to six spells.

The demand of the Staff Side has been examined in consultation with Ministry of Finance and Ministry of Labour and taking into consideration all the aspects, the President is pleased to decide that industrial workers in Central Government Ministries/Departments, other than Railways, may be allowed to avail annual leave in a Calendar Year up to six spells. This will not be violative of the provisions of the Factories Act, 1948 as subsection (1) of Section 78 of that Act provides for liberalised terms being given by agreement.
