Amendments to Indian Police Service Pay Rules, 1994, Regarding Stagnation Increments

Exciting news for Indian Police Service officers! Recent updates clarify the counting of stagnation increments for pay fixation upon promotion. If you’ve been at the maximum of your Junior, Senior Time, Junior Administrative, Selection Grade, or Supertime Scale, you’re entitled to one stagnation increment for every two years of stagnation, up to a maximum of three increments. Initially, these were considered personal pay and not factored into promotion-related pay fixation. However, new provisions align with changes made for Central Government employees, ensuring these stagnation increments are now indeed counted when determining your pay upon moving to a higher post. These changes are effective retrospectively from September 30, 1993, providing a fair and consistent approach to career progression and remuneration. Rest assured, these amendments have been carefully designed so that no IPS member will be negatively impacted by their retrospective application.

NOTIFICATION

G.S.R. ………………In exercise of the powers conferred by sub-section(1) read with sub-section(1A) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government after consultation with the Governments of the States concerned, hereby makes the following rules further to amend the Indian Police Service (Pay) Rules, 1954, namely:

  1. (1) These rules may be called the Indian Police Service (Pay) 51/21 Amendment Rules, 1994.
    (2) They shall be deemed to have come into force on the 30th September, 1993.

  2. In the Note below rule 54 of the Indian Police Service (Pay) Rules, 1954, the words “for the purpose of fixation of pay on promotion to higher posts or” shall be omitted.

EXPLANATORY MEMORANDUM

The members of the Indian Police Service stagnating at the maximum of the Junior Scale/Senior Time Scale/Junior Administrative Grade/Seliction Grade/Supertime Scale get one Stagnation Increment each for every 2 year of such stagnation, subject to a maximum of three increments. These increments are in the nature of Personal Pay and are not taken into account for fixation of pay on promotion to higher postp and for applying the ceiling on pay plus special pay. This position is based on the Ministry of Finance’ instructions on the subject which are relevant in the cases of the Central Government employees. That Ministry have taken a decision to count stagnation increments for the purpose of pay fixation on promotion also. As their orders became effective on 30th September, 1993, the Indian Police Service (Pay) Rules, 1954 are also being amended accordingly from the same date.It is certified that no member of the Indian Police Service is likely to be adversely affected by this notification being given retrospective effect.
