A significant update has been issued regarding the pay protection for State Forest Service Officers upon their appointment to the Indian Forest Service. Previously, these officers faced challenges despite an amendment in 1994 that aimed to protect their State pay up to the maximum of the Selection Grade (Rs. 5300/-), eliminating the ‘Personal Pay’ concept. This earlier amendment, effective from its publication date of May 9, 1994, still caused hardship. To address this, a new decision mandates that these pay protection amendments will now be notionally effective from January 1, 1986. This aligns with the revised pay scales for All India Services introduced based on the Fourth Central Pay Commission’s recommendations. While promoted IFS officers will have their pay re-fixed from this earlier date, it’s crucial to note that no arrears will be admissible for the period between January 1, 1986, and May 8, 1994. This measure ensures that no member of the Indian Forest Service will be adversely affected by this retrospective application.

NOTIFICATION
GSR— In exercise of the powers conferred under sub-section (1) of Section 3 of the All India Services Act, 1951 (61 of 1951) and in consultation with the State Governments concerned, the Central Government hereby makes the following amendments to the Notification of the Government of India in the Ministry of Personnel, P.G. and Pensions No.GSR 438(E) published in the Gazette of India Part-II, Section 3, Sub-Section (1), dated the 9th May, 1994, namely:
In the said Notification, for sub-rule (2) of rule, 1 the following sub-rule shall be substituted, namely:
“1. (2) They shall come into force on the date of their publication in the Official Gazette. National benefits on account of these amendments shall, however, be admissible from the 1st day of January, 1986.”

EXPLANATORY MEMORANDUM
The State Forest Service Officers appointed in the Indian Forest Service under the Indian Forest Service (Appointment by Promotion) Regulations, 1965 had been demanding protection of pay drawn by them in the State Government, on their appointment in this Service. Such protection was earlier available to the extent of the maximum of the Senior Time Scale of this Service and Personal Pay with the conditions that pay plus personal pay would not exceed Rs.5300/- per month and the personal pay would be absorbed in future increments/increases in pay. The Indian Forest Service (Pay) Rules, 1968 were accordingly amended vide this Department’s Notification number G.S.R.438(E), dated 9th May, 1994 so as to provide for the protection of their State pay to the extent of Rs.5300/- i.e., the maximum of the Selection Grade which is the third and the last component of the Senior Scale of the Indian Forest Service, and the concept of ‘Personal Pay’ was done away with. These amendments were made effective from the date of their publication in the Official Gazette which was 9th May, 1994. As the date of effect of the said Notification is still causing hardship to the State Forest Service Officers appointed in the I.F.S., it has been decided to make these amendments notionally effective from 1.1.86 from when the revised pay scales in respect of the All India Services came into being on the recommendations made by the Fourth Central Pay Commission. Whereas the promoted IFS Officers would get their pay refixed on this basis from 1.1.86, no arrears of pay on account of this amendment for the period from 1.1.86 to 5.5.94 would be admissible.2. It is certified that no member of the Indian Forest Service is likely to be adversely affected by this Notification being given retrospective effect from 1.1.86 on national basis.
