सा.का.नि. 875(अ).—केन्द्रीय सरकार, प्रशासनिक अधिकरण अधिनियम, 1985 (1985 का 13) को धारा 35 और धारा 36क को उप-धारा (2) के खंड (ग) के साथ पटित उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, आंध्र प्रदेश प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें) नियम, 1989 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :—

1. (1) इन नियमों का संक्षिप्त नाम आंध्र प्रदेश प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें) संशोधन नियम, 2009 है।

(2) ये 19 फरवरी, 2007 से पूर्व नियुक्त हुए आंध्र प्रदेश प्रशासनिक अधिकरण के अध्यक्ष, उपाध्यक्ष और सदस्यों को लागू होंगे।

1. आंध्र प्रदेश प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें) नियम, 1989 के नियम 8 के उप-नियम (2) में, “सात हजार चौहत्तर रुपए प्रतिवर्ष” शब्दों के स्थान पर 1 जनवरी, 2006 से “चौदह हजार पांच सौ वतीस रुपए प्रतिवर्ष” शब्द रखे जाएंगे।

स्पष्टीकरण ज्ञापन :

केन्द्रीय सरकार ने केन्द्रीय सरकार के कर्मचारियों को पेंशन के संबंध में छठे वेतन आयोग की सिफारिशों को कार्यान्वित करने की दृष्टि से आंध्र प्रदेश प्रशासनिक अधिकरण के ऐसे अध्यक्ष, उपाध्यक्ष और सदस्यों को, जिन्हें 19 फरवरी, 2007 से पहले नियुक्त किया गया था, पेंशन का 1 जनवरी, 2006 से पुनरीक्षण करने का विनिश्चय किया गया है। तदनुसार आंध्र प्रदेश प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और सदस्यों का वेतन और भत्ते तथा सेवा की शर्तें) नियम, 1989 का 1 जनवरी, 2006 से भूतलक्षी प्रभाव से संशोधन किया जा रहा है।

1. प्रमाणित किया जाता है कि आंध्र प्रदेश प्रशासनिक अधिकरण के किसी अध्यक्ष, उपाध्यक्ष और सदस्य पर प्रस्तावित संशोधन को भूतलक्षी रूप से प्रभावी करने से प्रतिकूल प्रभाव पड़ने की संभावना नहीं है।

G.S.R. 875(E).—In exercise of the powers conferred by sub-section (1), read with clause (c) of the sub-section (2) of Section 35 and Section 36A of the Administrative Tribunal Act, 1985 (13 of 1985), the Central Government hereby makes the following rules further to amend the Andhra Pradesh Administrative-Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Rules, 1989 namely :—

1. (1) These rules may be called the Andhra Pradesh Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Amendment Rules, 2009.
   (2) These shall be applicable to the Chairman, ViceChairmen and Members of the Andhra Pradesh Administrative Tribunal appointed before the 19th February, 2007.
2. In rule 8 of the Andhra Pradesh Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Rules, 1989 in sub-rule (2), for the words “rupees seven thousand seventy four per annum”, the words “rupees fourteen thousand five hundred and thirty two per annum” shall be substituted with effect from the 1st day of January, 2006.

Explanatory Memorandum:

With a view to implement the recommendations of the Sixth Pay Commission regarding Central Government employees’ pension, the Central Government has decided to revise the pension of the Chairman, Vice-Chairmen and Members of the Andhra Pradesh Administrative Tribunal who were appointed before the 19th February, 2007 with effect from the 1 st day of January, 2006. Accordingly, the Andhra Pradesh Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, ViceChairman and Members) Rules, 1989 are being amended with retrospective effect from the 1st day of January, 2006.
2. It is certified that no Chairman, Vice-Chairman and Member of the Andhra Pradesh Administrative Tribunal is likely to be affected by the proposed amendment being given retrospective effect.

NOTIFICATION

G.S.R. 882 (E).-In exercise of the powers conferred by sub-section (1), read with clause (c) of the sub-section (2) of Section 35 and Section 36A of the Administrative Tribunal Act, 1985 (13 of 1985), the Central Government hereby makes the following rules further to amend the West Bengal Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, ViceChairmen and Members) Rules, 1994, namely :-

1. (1) These rules may be called the West Bengal Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Amendment Rules, 2009.
   (2) These shall be applicable to the Chairman, Vice-Chairmen and Members of the West Bengal Administrative Tribunal appointed before the 19th February, 2007.
2. In rule 8 of the West Bengal Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairmen and Members) Rules, 1994 in sub-rule (2), for the words “rupees seven thousand seventy four per annum”, the words “rupees fourteen thousand five hundred and thirty two per annum” shall be substituted with effect from the 1st day of January, 2006.

Explanatory Memorandum:

With a view to implement the recommendations of the Sixth Pay Commission regarding Central Government employees’ pension, the Central Government has decided to revise the pension of the Chairman, Vice-Chairmen and Members of the West Bengal Administrative Tribunal who were appointed before the 19th February, 2007 with effect from the 1st day of January, 2006. Accordingly, the West Bengal Administrative Tribunal (Salaries and Allowances and Conditions of Service of Chairman, ViceChairmen and Members) Rules, 1994 are being amended with retrospective effect from the 1st day of January, 2006.
2. It is certified that no Chairman, Vice-Chairman and Member of the West Bengal Administrative Tribunal is likely to be affected by the proposed amendment being given retrospective effect.
