Amendment to State Advisory Committee Minutes Regarding an Extension Training Officer’s Allocation

An important administrative correction has recently been enacted concerning the inter-state allocation of an Extension Training Officer. The officer in question had contested his posting to Uttarakhand, asserting in court that he had never voluntarily opted for the state, despite being categorized as an ‘optee’ in official records. During legal proceedings, the State Government admitted that the State Advisory Committee had made a ‘bonafide error’ by mistakenly listing him as an optee, when in fact, his allocation was based on his status as the junior-most officer in the cadre. Following this, the State Advisory Committee reviewed the matter and recommended an amendment to its previous meeting minutes to accurately reflect the true basis of the officer’s allocation. This recommendation has been accepted by the Government of India, ensuring that official records now correctly portray the circumstances of the allocation. All relevant departments have been notified of this amendment.

Sub: Amendment in the minutes of the State Advisory Committee meeting held on 24.05.2005 – regarding

Sir,

I am directed to refer to the subject noted above and to say that Shri Sanjay Kumar Singh, Extension Training Officer has filed WP No. 29236/2009 in the Hon’ble Allahabad High Court challenging his allocation to Uttarakhand. One of his contention was that although he had never opted for Uttarakhand, he has been allocated to the State as an optee. In the hearing held on 17.05.2010, the Additional Advocate General appearing on behalf of the State Govt. informed the Hon’ble Court that the State Government had correctly sent the recommendation treating the petitioner to be junior most but that the State Advisory Committee by a bonafide error treated the petitioner as an optee in its recommendation to the Central Government. The State Government has made a request to the State Advisory Committee to correct the error.

The State Advisory Committee in its meeting held on 17.06.2010 considered the Case of Shri Sanjay Kumar, Extension Training Officer, Deen Dayal Upadhyay Institute. The representative of the Administrative Department informed the Committee that optee was mentioned against his name due to typographical error. As per the records he was allocated to Uttarakhand being juniormost in the Cadre. The Committee recommended to amend the minutes in r/o Shri Sanjay Kumar Singh as under:-

“श्री संजय कुमार, प्रसार प्रशिक्षण अधिकारी, दीन दयाल उपाध्याय, राज्य ग्राम्य विकास संस्थान, बख्शी का तालाब, लखनऊ के उत्तराखण्ड राज्य आवंटन के संबंध में विभागीय प्रतिनिधि द्वारा अवगत कराया गया है। यह टंकण जुटिवश श्री संजय कुमार के नाम के सम्मुख विकल्पधारी मुद्रित हो गया था, जबकि वास्तव में विभागीय अभिलेखानुसार उनका उत्तराखण्ड राज्य आवंटन कनिष्ठता के आधार पर ही किया गया है। अतः समिति द्वारा तदनुसार कार्यवृत्त में संशोधन किये जाने के निर्देश दिये गये।”

S. AngerThe Government of India has accepted the recommendations of the State Advisory Committee and accordingly the word ‘optee’ against Sl. No. 9 in Column. 3 (Category) w.r.t. allocation of Extension Training Officer, of the minutes shall be replaced by ‘Junior Most’. This amendment in the minutes of the State Advisory Committee meeting dated 24.05.2005, as above may kindly be brought to the notice of all concerned.
