सा.का.नि. 767(अ).—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए मूल नियम, 1922 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:—

1. संक्षिप्त नाम और प्रारंभ.—(1) इन नियमों का संक्षिप्त नाम मूल (दूसरा संशोधन) नियम, 2018 है।

(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे।

1. मूल नियम, 1922 के नियम 56 में खंड (खख) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्:—

“(खख) (i) चिकित्सकों के संबंध में अधिकारिता की आयु, जो –

(i) केंद्रीय स्वास्थ्य सेवा;

(ii) भारतीय रेल चिकित्सा सेवा;

(iii) आयुष और आयुष मंत्रालय के अधीन कार्यरत;

(iv) सशस्त्र बल चिकित्सा सेवा के महानिदेशालय के अधीन सिविलियन चिकित्सक;

(v) भारतीय आयुष कारखाना स्वास्थ्य सेवा के चिकित्सा अधिकारी;

(vi) स्वास्थ्य और परिवार कल्याण विभाग के अधीन दंत चिकित्सक;

(vii) रेल मंत्रालय के अधीन दंत चिकित्सक; और

(viii) भोपाल मेमोरियल हॉस्पिटल और अनुसंधान केंद्र में कार्यरत सामान्य ड्यूटी चिकित्सा अधिकारी, विशेषज्ञ श्रेणी के चिकित्सक और चिकित्सा संकाय शिक्षण,

से संबंधित हैं, बासठ वर्ष होगी जब तक कि वे अपनी विशेषज्ञता और अनुभव के आधार पर शिक्षण, नैदानिक, रोगी देखभाल, स्वास्थ्य कार्यक्रमों के क्रियान्वयन, सलाहकार और परामर्श कार्य सहित सार्वजनिक स्वास्थ्य कार्यक्रमों और कृत्यों के लिए तैनाती के विकल्प का प्रयोग करते हैं, जैसा कि सम्बद्ध मंत्रालय या विभाग में समय-समय पर सक्षम प्राधिकारी द्वारा विनिश्चय किया गया है, यदि वे पैंसठ वर्ष तक अपनी सेवा जारी रखने के इच्छुक है।

परंतु, अधिवार्षिता की आयु, केंद्रीय सशस्त्र पुलिस बल और असम राइफल्स के सामान्य ड्यूटी चिकित्सा अधिकारी उप-काडर तथा केंद्रीय सशस्त्र पुलिस बल और असम राइफल्स के विशेषज्ञ चिकित्सा अधिकारियों से संबंधित चिकित्सकों के संबंध में पैंसठ वर्ष होगी।
(ii) ऐसे सेवारत चिकित्सक, जो उपखंड (i) में निर्दिष्ट सेवाओं से संबंधित है जिन्होंने पहले से ही बासठ वर्ष की आयु प्राप्त कर ली है या राजपत्र में इन संशोधन नियमों के प्रकाशन की तारीख से छ: माह की अवधि के भीतर बासठ वर्ष की आयु प्राप्त कर लेगें, मूल (दूसरा संशोधन) नियम, 2018 के प्रारंभ होने की तारीख से तीस दिन की अवधि के भीतर शिक्षण नैदानिक, रोगी देखभाल, स्वास्थ्य कार्यक्रमों शिक्षण, नैदानिक, रोगी देखभाल, स्वास्थ्य कार्यक्रमों के क्रियान्वयन, जिसके अंतर्गत उपखंड (i) में विनिर्दिष्ट सलाहकार और परामर्श कार्य सहित सार्वजनिक स्वास्थ्य कार्यक्रमों और कृत्यों के लिए तैनाती के विकल्प का प्रयोग कर सकते हैं।
(iii) ऐसे सेवारत चिकित्सक जो शिक्षण नैदानिक, रोगी देखभाल, स्वास्थ्य कार्यक्रमों और कृत्यों जिसके अंतर्गत उपखंड (i) में विनिर्दिष्ट सलाहकार और परामर्शी कृत्य हैं, के संबंध में उपखंड (ii) में विनिर्दिष्ट अवधि के भीतर अपने तैनाती का विकल्प का प्रयोग करने में असफल रहते हैं, को बासठ वर्ष की आयु प्राप्त करने पर, या मूल (दूसरा संशोधन) नियम, 2018 के प्रारंभ होने की तारीख से 30 दिन की अवधि के समाप्ति पर इनमें से जो भी पल्चातवर्ती हो, सेवानिवृत्त हो जाएंगे।”।

MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department of Personnel and Training) NOTIFICATION

G.S.R. 767(E).-In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Fundamental Rules, 1922, namely :-

1. Short title and commencement.-(1)These rules may be called the Fundamental (Second Amendment) Rules, 2018.
   (2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Fundamental Rules, 1922, in rule 56, for clause (bb), the following shall be substituted, namely:-
   “(bb) (i) The age of superannuation in respect of the doctors belonging to-
   (i) Central Health Service;
   (ii) Indian Railways Medical Service;
   (iii) AYUSH and working under the Ministry of AYUSH;
   (iv) Civilian doctors under the Directorate General of Armed Forces Medical Service;
   (v) Medical Officers of the Indian Ordnance Factories Health Service;
   (vi) Dental Doctors under the Department of Health and Family Welfare;
   (vii) Dental doctors under the Ministry of Railways; and
   (viii) General Duty Medical Officers, Specialist Grade doctors and Teaching Medical Faculty working in Bhopal Memorial Hospital and Research Centre,
   shall be sixty-two years unless they exercise the option of posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes and functions including advisory and consultancy depending on their expertise and experience, as decided by the competent authority in the concerned Ministry or Department from time to time, in case they desire to continue in their service upto the age of sixty-five years:
   Provided that the age of superannuation in respect of the doctors belonging to the General Duty Medical Officers sub-cadre of Central Armed Police Forces and Assam Rifles and Specialist Medical officers of Central Armed Police Forces and Assam Rifles shall be sixty-five years.

(ii) The serving doctors belonging to the services referred to in sub-clause (i) who have either already attained the age of sixty-two years or attaining the age of sixty-two years within six months from the date of publication of these amendment rules in the Official Gazette, may exercise their option in regard to their posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes and functions including advisory and consultancy as specified in sub-clause (i), within a period of thirty days from the date of the commencement of the Fundamental (Second Amendment) Rules, 2018.
(iii) The serving doctors who fail to exercise the option in regard to their posting to Teaching, Clinical, Patient Care, Implementation of Health programmes, Public Health programmes and functions including advisory and consultancy as specified in sub-clause (i), within the period specified in subclause (ii), shall be superannuated form their service on attaining the age of sixty-two years or on expiry of a period of thirty days from the date of the commencement of the Fundamental (Second Amendment) Rules, 2018, whichever is later. ${ }^{15}$.
