साःका.नि. 538(अ).—राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और केन्द्रीय सचिवालय सेवा नियम, 2009 के नियम 12 के उप-नियम (2) के खंड (क) और खंड (ग) के अनुसरण में, केन्द्रीय सचिवालय सेवा सहायक ग्रेड (सीधी भर्ती प्रतियोगिता परीक्षा) विनियम, 2010 का संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :—
- संक्षिप्त नाम और प्रारम्भ—(1) इन नियमों का संक्षिप्त नाम केन्द्रीय सचिवालय सेवा सहायक ग्रेड (सीधी भर्ती प्रतियोगिता परीक्षा) संशोधन विनियम, 2011 है।
(2) ये 2 मार्च, 2010 को प्रवृत्त हुए समझे जाएंगे।
- केन्द्रीय सचिवालय सेवा सहायक ग्रेड (सीधी भर्ती प्रतियोगिता परीक्षा) विनियम, 2010 के विनियम 4 के खंड (ii) में “परंतु” शब्द के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् :—
“परंतु यदि कोई भर्ती, कर्मचारी चयन आयोग द्वारा संयुक्त परीक्षा के माध्यम से की गई है, जिसके द्वारा अन्य पदों पर भी भर्ती की गई है, आयु-सीमा अवधारित करने के लिए निर्णायक तारीख वह होगी जो कर्मचारी चयन आयोग द्वारा यथा नियत की जाए :
परन्तु यह और कि”।

केन्द्रीय सचिवालय सेवा सहायक ग्रेड (सीधी भर्ती प्रतियोगिता परीक्षा) विनियम, 2010, भारत के राजपत्र में 2 मार्च, 2010 को प्रकाशित किए गए थे। उक्त विनियमों के विनियम 4 के अनुसार आयु-सीमा अवधारित करने के लिए पात्रता उस वर्ष की, जिसको परीक्षा आयोजित की गई है, 1 अगस्त होगी। संयुक्त स्नातक स्तरीय परीक्षा के लिए पुनरीक्षित स्कीम के अनुसार जिसको अंतर्गत सभी पदों के लिए भर्ती है जहां न्यूनतम विहित अर्हता स्नातक है और जिसमें केन्द्रीय सचिवालय सेवा में सहायक भी सम्मिलित है, वहां एकल आरंभिक आवेदन उक्त परीक्षा के लिए अपेक्षित है और आवेदन की प्राप्ति की अंतिम तारीख, आयु-सीमा अवधारित करने के लिए निर्णायक तारीख के रूप में मानी जाएगी। उक्त परीक्षा कर्मचारी चयन आयोग द्वारा आयोजित की जाएगी। संयुक्त स्नातक स्तरीय परीक्षा के ऐसे मामले में, उक्त विनियमों में यथा विहित, सहायकों की आयु-सीमा अवधारित करने के लिए निर्णायक तारीख साध्य नहीं है। अतः विनियम 4 के खंड (ii) में संशोधन किया जा रहा है जिससे यह उपबंध किया जा सके कि यदि कर्मचारी चयन आयोग द्वारा संयुक्त परीक्षा के माध्यम से भर्ती की जाती है, जिसके द्वारा अन्य पदों के लिए भी भर्ती की जाती है, तो आयु-सीमा अवधारित करने के लिए निर्णायक तारीख कर्मचारी चयन आयोग द्वारा यथा नियत होगी। संयुक्त स्नातक स्तरीय परीक्षा, 2010 के लिए आवेदन की प्राप्ति की अंतिम तारीख 2 मार्च, 2010 थी। संशोधित विनियमों को भूतलक्षी प्रभाव दिया जा रहा है, जो 2 मार्च, 2010 को प्रवृत्त हुए समझे जाएंगे तथा संयुक्त स्नातक स्तरीय परीक्षा को लागू होंगे।
- यह प्रमाणित किया जाता है कि कोई भी व्यक्ति इन विनियमों को भूतलक्षी प्रभाव देने से प्रतिकूल रूप से प्रभावित नहीं होगा।

G.S.R. 538(E).-In exercise of the powers conferred by the proviso to article 309 of the Constitution and in pursuance of clauses (a) and (c) of sub-rule (2) of rule 12 of the Central Secretariat Service Rules, 2009, the President hereby makes the following regulations to amend the Central Secretariat Service Assistants’ Grade (Direct Recruit Competitive Examination) Regulations, 2010, namely :-
- Short title and commencement.-(1) These regulations may be called the Central Secretariat Service Assistants’ Grade (Direct Recruit Competitive Examination) Amendment Regulations, 2011.
(2) They shall be deemed to have come into force on the 2nd day of March, 2010. - In the Cemral Secretariat Service Assistants’ Grade (Direct Recruit Competitive Examination) Regulations, 2010, in regulation 4, in clause (ii), for the words “Provided that”, the following shall be substituted, namely :-
‘Provided that if the recruitment is made by the Staff Selection Commission through a combined examination by which recruitment to other posts is also made, the crucial date for determining the agelimit shall be as fixed by the Staff Selection Commission :
Provided further that’.

EXPLANATORY MEMORANDUM
The Central Secretariat Service Assistants’ Grade (Direct Recruit Competitive Examination) Regulations, 2010 were published in the Gazette of India on 2nd March, 2010. As per recilation 4 of the said regulations, the eligibility for detorminins is age-linit shall be the first day of August of the , or in which the examination is held. As per the revised scheme for the Combined Graduate Level Examination which covers recruitment to all posts where minimum prescribed qualification is graduation and which includes Assistants in Central Secretariat Service also, a single initial application is required for the said examination and the closing date of receipt of application is treated as the crucial date for determining the age-limit. The said examination is conducted by the Staff Selection Commission. In such a case of Combined Graduate Level Examination, the crucial date for determining the age-limit for Assistants, as prescribed in the said regulations, is not feasible. Hence amendment is being made in clause (ii) of regulation 4 so as to provide that if the recruitment is made by the Staff Selection Commission through a Combined Examination by which recruitment to other posts is also made, the crucial date for determining the age-limit shall be as fixed by the Staff Selection Commission. The last date of receipt of applications for the Combined Graduate Level Examination, 2010 was 2nd March, 2010. The amended regulations are being given retrospective effect and shall be deemed to have come into force on the 2nd March, 2010 and will be applicable to Combined Graduate Level Examination, 2010.
2. It is certified that no person shall be adversely affected by giving retrospective effect to these regulations.
