Allocation of Medical Officers to Uttarakhand following High Court Directives

A recent administrative directive has brought clarity and finality to the allocation of 42 Public Health Medical Service (PMHS) doctors, including 23 who had sought judicial intervention, to the state of Uttarakhand. This decision, driven by explicit directions from the Hon’ble Uttarakhand High Court, resolves a complex personnel matter stemming from the bifurcation of states. An Advisory Committee thoroughly reviewed the cases, confirming that many of these medical professionals, particularly those recruited for the hill regions, were already designated for the Hills Sub-Cadre. This existing framework, combined with a general order from 2001 mandating the allocation of all Hill cadre employees to Uttarakhand, paved the way for the current resolution. As a result, 28 medical officers have been officially assigned to Uttarakhand, ensuring continuity and stability in the state’s vital health services. Further allocation orders are expected to follow, completing this crucial administrative process.

Sub: Consideration of allocation 42 PMHS doctors including 23 petitioners in pursuance of direction of Hon’ble Uttarakhand High Court.

Sir,

I am directed to refer to the directions of Hon’ble Uttarakhand High Court in Writ Petitions No.277, 278, 279 and 282 of 2012 filed by 23 Medical Officers, for their final allocation to either of the successor States of U.P. and Uttarakhand and to say that the matter for allocation has been deliberated in the Advisory Committee in its meeting held on 15.01.2013 and as certified by the Medical and Health Deptt., Uttarakhand, S/ Smt. Sh/ Umed Singh Adhikari, Padma Rawat, Geeta Pant (Tripathi), Bhuvan Chandra Joshi, Manoj Bahukhandi, Bageesh Chandra Kala, R.P. Choudhary, Chandra Prakash Tripathi, Ramesh Chandra Singh Pawar, Ram Chandra Singh Rawat, Dinesh Chandra Semwal, Elam Singh Bhandari, Narendra Chandra, Shankar Ballabh Oli, Rajpal Singh Rana, Ajay Kumar Gairola, Uma Shankar Kandwal, Narendra Raturi, Virendra Singh Chauhan, Gauri Shankar Joshi (he was recruited for hill region), Lalit Mohan Sundariyal and Hira Singh Hayanki are already included in the Hills Sub-Cadre.

  1. The rest of the MOs who are not covered by any court orders, i.e. S/Sh. Dinesh Chandra Nautiyal, Dinesh Kumar Srivastava, Ravindra Pal Singh Negi, Durga Prasad Joshi, Buddhi Singh Bisht and Rajendra Prasad Singh are also certified to be included in the Hill Sub-Cadre by the Medical & Health Department. As per General Order No.27/9/2001-SRS dated 11.09.2001, all Hill cadre employees are deemed to be allocated to the State of

Uttarakhand and accordingly all the 28 Medical Officers brought out in para 1 and 2 above, stand allocated to Uttarakhand. Allocation orders for the rest, are being issued separately.
3. Further necessary action may kindly be taken in the matter. This may also be brought to the notice of all concerned.
