सा.का.नि. 105(अ).—केन्द्र सरकार, अखिल भारतीय सेवाएँ, अधिनियम, 1951 (1951 का 61), की धारा 3 की उप-धारा (1क) के साथ पठित उप धारा (i) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, संबंधित राज्य-सरकारों से परामर्श करने के पश्चात्, अखिल भारतीय सेवाएँ (मृत्यु-सह-सेवानिवृत्ति-प्रसुविधाएँ) नियम, 1958 में संशोधन करने के लिए एतदद्वारा निम्नलिखित नियम बनाती है, अर्थात् :—
- (1) ये नियम अखिल भारतीय सेवाएँ (मृत्यु-सह-सेवानिवृत्ति-प्रसुविधाएँ) (द्वितीय संशोधन) नियम, 2003 हैं।
(2) ये जनवरी 01, 2004 से प्रवृत्त होंगे।
- अखिल भारतीय सेवाएँ (मृत्यु-सह-सेवानिवृत्ति-प्रसुविधाएँ) नियम, 1958 के नियम 1, के उप-नियम (2), के खण्ड (ख) में निम्नलिखित प्रावधान अन्तःस्थापित किया जाएगा, अर्थात् :—
“आगे यह भी शर्त है कि इन नियमों में निहित, कोई भी बात, उपर्युक्त सेवा में जनवरी 01, 2004 को या उसके बाद नियुक्त व्यक्तियों पर लागू नहीं होगी “।

NOTIFICATION
New Delhi, the 6th February, 2004
G.S.R. 105(E).-In exercise of the powers conferred by sub-section(1) read with Sub-section (1A) of Section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Governments of the States concerned, hereby makes the following rules further to amend the All India Services (Death-cum-Retirement Benefits) Rules, 1958, namely:-
- (1) These rules may be called the All India Services (Death-cum-Retirement Benefits) Second Amendment Rules, 2003.
(2) They shall come into force on the 1st day of January, 2004.
- In the All India Services (Death-cum-Retirement Benefits) Rules, 1958, in rule 1, in sub-rule (2), in clause (b), the following proviso shall be inserted, namely :-
“Provided further that nothing contained in these rules shall apply to the persons appointed to the service on or after the 1st day of January, 2004.”
