सा.का.नि. 102(अ).—अखिल भारतीय सेवाएं अधिनियम, 1951 (1951 का 61) की धारा 3 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार, संबंधित राज्य सरकारों से परामर्श के उपरांत, अखिल भारतीय सेवाएं (मृत्यु-सह-सेवानिवृत्ति लाभ) नियमावली, 1958 को आगे और संशोधित करने हेतु निम्नानुसार नियम बनाती है, नामतः—

1. (1) ये नियम अखिल भारतीय सेवाएं (मृत्यु-सह-सेवानिवृत्ति लाभ) संशोधन नियम, 2024 कहलाएंगे।
   (2) ये शासकीय राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे।
2. अखिल भारतीय सेवाएं (मृत्यु-सह-सेवानिवृत्ति लाभ) नियमावली, 1958 में नियम 8 में, उप-नियम (7) के पश्चात, निम्नलिखित उप-नियम अंतर्वेशित किया जाएगा, नामतः—
   “(7क) सेवा का कोई सदस्य, जिसे विदेश सेवा पर संयुक्त राष्ट्र सचिवालय अथवा संयुक्त राष्ट्र के अन्य निकायों अथवा अंतरराष्ट्रीय मुद्रा कोष, अंतरराष्ट्रीय पुनर्निमाण एवं विकास बैंक अथवा एशियाई विकास बैंक अथवा कॉमनवेल्थ सचिवालय अथवा किसी अन्य अंतर्राष्ट्रीय संगठन में प्रतिनियुक्त किया जाता है, निम्मानुसार चयन कर सकता है-

(क) अपनी विदेश सेवा के संबंध में, ऐसी दरों, जो केन्द्र सरकार, समय-समय पर निर्धारित करे, पर पेंशन अंशदान का भुगतान करे और ऐसी सेवा की इन नियमों के तहत सेवानिवृत्ति लाभों हेतु अहैक सेवा के रूप में गणना की जाए; अथवा
(ख) अपनी विदेश सेवा के संबंध में, पेंशन अंशदान का भुगतान ना करे और इन नियमों के तहत सेवानिवृत्ति लाभों हेतु ऐसी सेवा की अहैक सेवा के रूप में गणना ना की जाए।
बशर्ते कि जहां सेवा का कोई सदस्य खंड (ख) का चयन करता है, तो सेवा के सदस्य द्वारा भुगतान किए गए पेंशन अंशदान, यदि कोई हो, उन्हें लौटा दिए जाएंगे।”

टिप्पणीः मूल नियम दिनांक 18 अगस्त, 1958 की अधिसूचना संख्या सा.का.नि. 728 (अ), भाग II, खण्ड 3, उप-खण्ड (i) के माध्यम से भारत के राजपत्र में प्रकाशित किए गए थे और अंतिम बार दिनांक 6 जुलाई, 2023 की अधिसूचना संख्या सा.का.नि. 487 (अ), भाग II, खण्ड 3, उप-खण्ड (i) के माध्यम से संशोधित किए गए थे।

MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department of Personnel and Training) NOTIFICATION

New Delhi the 6th February, 2024
G.S.R. 102(E).- In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Government of the States concerned, hereby makes the following rules further to amend the All India Services (Death-cum-Retirement Benefits) Rules, 1958, namely:-

1. (1) These rules may be called the All India Services (Death-cum-Retirement Benefits) Amendment Rules, 2024.
   (2) They shall come into force on the date of their publication in the Official Gazette.
2. In the All India Services (Death-cum-Retirement Benefits) Rules, 1958, in rule 8, after sub-rule (7), the following sub-rule shall be inserted, namely:-
   ” $(7 \mathrm{~A}) \quad$ A member of service who is deputed on foreign service to the United Nations’ Secretariat or other United Nations’ Bodies or the International Monetary Fund or the International Bank of Reconstruction and Development or the Asian Development Bank or the Commonwealth Secretariat or any other International organisation may opt –
   (a) to pay the pension contributions in respect of his foreign service, at such rates as the Central Government may, from time to time, prescribe and count such service as qualifying for retirement benefits under these rules; or
   (b) not to pay the pension contributions in respect of his foreign service and not to count such service as qualifying for retirement benefits under these rules:
   Provided that where a member of service opts for clause (b), pension contributions, if any, paid by the member of service, shall be refunded to him.”
