All India Services (Death-Cum-Retirement Benefits) Amendment Rules, 2006

स.का.नि. 360(अ).-लेन्ड सरकार, अखिल भारतीय सेवाएं अधिनियम, 1951 (1951 का 61) की धारा 3 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, संबंधित राज्य सरकारों ने परामर्श करने के पश्चात् एतद्द्वारा अखिल भारतीय सेवाएं (मृत्यु-सह-सेवानिवृत्ति प्रसुविधाएं) नियमावली, 1958 में आगे और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :-

1 (1) इन नियमों का नाम अखिल भारतीय सेवाएं (मृत्यु-सह-सेवानिवृत्ति प्रसुविधाएं) संशोधन नियमावली, 2006 है ।
(2) ये नियम शासकीय राजपत्र में अपने प्रकाशन की तारीख से लागू होंगे ।
2. अखिल भारतीय सेवाएं (मृत्यु-सह-सेवानिवृत्ति प्रसुविधाएं) नियमावली, 1958 के नियम 16 के उप नियम (1क) के स्थान पर, निम्नलिखित प्रतिस्थापित किया जाएगा अर्थात् :-
” (1क) परंतु यह भी कि उप नियम (1) में निहित किसी भी बात के होते हुए, केन्द्र सरकार, यदि लोक हित में ऐसा करना आवश्यक समझे तो वह मंत्रिमंडल सचिव, रक्षा सचिव, गृह सचिव, निदेशक, आसूचना ब्यूरो, सचिव, अनुसंधान तथा विश्लेषण स्कंध और निदेशक, केन्द्रीय अन्वेषण ब्यूरो के पदधारियों का कार्यकाल उतनी अवधि के लिए बढ़ा सकती है जितनी वह उचित समझे :

परंतु शर्त यह है कि मंत्रिमंडल सचिव जिन्हें सेवा में ऐसा विस्तार मंजूर किया गया है का कुल कार्यकाल तीन वर्ष से अधिक नहीं होगा;

परंतु आगो शर्त यह भी है कि अन्य सचिवों और निदेशकों, जिन्हें इन नियमों के अंतर्गत सेवा में ऐसा विस्तार मंजूर किया गया है, का कुल कार्यकाल दो वर्ष से अधिक नहीं होगा”।

पाद्य टिप्पण: मुख्य नियम भारत के राजपत्र में दिनांक 18.08.1958 की सा.का.नि. संख्या-728 द्वारा प्रकाशित किए गए और तत्पश्चात् निम्नलिखित अधिसूचनाओं द्वारा संशोधित किए गए:-

NOTIFICATION
New Delhi, the 12th June, 2006
G.S.P. 360(E).-In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Government of the States concerned hereby makes the following rules further to amend the All India Services (Death-Cum-Retirement Benefits) Rules, 1958, namely –

1 (1) These rules may be called the All India Services (Death-CumRetirement Benefits) Amendment Rules, 2006.
(2) They shall come into force from the date of their publication in the Official Gazette.

2 In the All India Services (Death-Cum-Retirement Benefits) Rules, 1958 in rule 16, for sub-rule (1A), the following shall be substituted, namely:-
*(1A) Notwithstanding anything contained in sub-rule (1), the Central Government may, if it considers necessary in the public interest to do so, give extension in service to the

incumbents of the posts of the Cabinet Secretary, Defence Secretary, Home Secretary, Director, Intelligence Bureau, Secretary, Research and Analysis Wing and Director, Central Bureau of Investigation for such period as it may deem proper:

Provided that the total term of the Cabinet Secretary who is granted such extensions of service shall not exceed three years;

Provided further that the total term of the other Secretaries and Directors who are granted such extensions of service under these Rules shall not exceed two years”.
