नई दिल्ली, 30 सितम्बर, 2005

सा.का.नि. 617(अ).—अखिल भारतीय सेवाएँ अधिनियम, 1951 (1951 का 61) की धारा 3 की उप-धारा (i) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार, संबंधित राज्य सरकारों से परामर्श के पश्चात् एतदद्वारा अखिल भारतीय सेवाएँ (मृत्यु-सह-सेवानिवृत्ति-प्रसुविधाएँ) नियमावली, 1958 में आगे और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :—

1. (1) इन नियमों का नाम अखिल भारतीय सेवाएँ (मृत्यु-सह-सेवानिवृत्ति-प्रसुविधाएँ) संशोधन नियमावली, 2005 है । (2) ये नियम शासकीय राजपत्र में अपने प्रकाशन की तारीख से लागू होंगे ।
2. अखिल भारतीय सेवाएँ (मृत्यु-सह-सेवानिवृत्ति-प्रसुविधाएँ) नियमावली, 1958 के नियम 16 के उप नियम (1क) के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात् :—

(1) (1क) उप-नियम (1) में किसी बात के होने के बावजूद भी, केन्द्र सरकार, यदि लोक हित में ऐसा करना आवश्यक समझे तो मंत्रिमण्डल सचिव, रक्षा सचिव, गृह सचिव, निदेशक, आसूचना ब्यूरो, सचिव, अनुसंधान तथा विश्लेषण स्कंध और निदेशक, केन्द्रीय अन्वेषण ब्यूरो के पदधारियों का कार्यकाल, मामला दर मामला आधार पर उतनी अवधि के लिए बढ़ा सकती है जितनी वह उचित समझे, बशर्ते कि उपर्युक्त पदों के पदधारी, जिन्हें सेवा में इस तरह की वृद्धि दी गई है, उनका कुल कार्यकाल दो वर्ष से अधिक न हो ।”

MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department of Personnel and Training) NOTIFICATION

New Delhi, the 30th September, 2005 G.S.R. 617(E).- In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Government of the States concerned hereby makes the following rules further to amend the All India Services (Death-Cum-Retirement Benefits) Rules, 1958, namely –

1 (1) These rules may be called the All India Services (DeathCum-Retirement Benefits) Amendment Rules, 2005. (2) They shall come into force from the date of their publication in the Official Gazette.

2 In the All India Services (Death-Cum-Retirement Benefits) Rules, 1958 in rule 16, for sub-rule (1A), the following shall be substituted, namely:-
*(1A) Notwithstanding anything contained in sub-rule (1), the Central Government may, if it considers necessary in the public interest to do so, give extension in service to the incumbents of the posts of the Cabinet Secretary, Defence Secretary, Home Secretary, Director, Intelligence Bureau, Secretary, Research and Analysis Wing and Director, Central Bureau of Investigation for such period as it may deem proper, on case to case basis, subject to the condition that the total term of the incumbents of the aforesaid posts who are given such extension in service, does not exceed two years.”
