This document announces the dissolution of the Advisory Committee established to handle the allocation of State employees between Madhya Pradesh and Chhattisgarh. The committee was formed in response to a High Court order to review employee representations regarding their allocation after the state reorganization. Over its tenure, the committee successfully considered and disposed of more than 1000 representations and court directives. With no pending matters, the committee is now being wound up. Future allocation issues for employees will be addressed by the Central Government in consultation with the respective State Governments, or on a case-to-case basis as per court orders. The document also clarifies that issues concerning All India Services are excluded from this arrangement.

ORDER
Whereas in compliance of the directions of the Hon’ble High Court of Chhattisgarh in its order dated 17.04.2007 in W.P. No. 445/2001 in the matter of B.R. Godbole and Ors., an Advisory Committee was constituted vide this Department’s Order No. 14/3/CC/2007- SR(S) dated 18.07.2007 under Section 71 of the Madhya Pradesh State Re-organization Act, 2000 (copy enclosed) to consider the representations of petitioner and other employees for allocation.
2. Whereas, 28 meetings of the said Committee have been held since wherein more than 1000 representations/Courts’ directions have been considered and disposed off.
3. Whereas, at present there are no representations/Courts’ directions which are pending with the Govt. of India for consideration of the said Advisory Committee.
4. Now, therefore, with the consent of Successor States of Madhya Pradesh and Chhattisgarh, it has been decided to wind up the said Advisory Committee. Hence, the Advisory Committee for allocation matters of State employees, other than All India Services in respect of Successor States of Madhya Pradesh and Chhattisgarh shall cease to exist from the date of this order.
5. Consequent upon winding up of the aforesaid Advisory Committee, to deal with representation/Courts’ orders, if any, which may arise in future in allocation matters, the following mechanism shall be followed:
(i) The representations of aggrieved employees will be considered by the Central Govt./State Governments, on a case to case basis, in compliance of Court’s directions, if, the Hon’ble Courts pass any specific directions to this effect.(ii) If any issue regarding allocation of employees of erstwhile of State of Madhya Pradesh arises in future, it will be considered by the Central Govt. in consultation with both the Successor State Governments.
(iii) The factum of winding up of the Advisory Committee may be brought to the notice of the Hon’ble High Court.

ORDER
The Hon’ble High Court of Chhattisgarh at Bilaspur, in a bunch of 90 Writ Petitions in the matter of Shri B. R. Godbole & Ors. Vs. Municipal Corporation, Durg & Ors has directed in the judgement dated 17.04.2007 to the Government to appoint a Committee headed by the senior officer belonging to any other state, not from the state of M.P. and C.G., for processing and deciding the representations of petitioners.
In pursuance of above judgement of Hon’ble High Court of Chhatisgrh and in exercise of the powers conferred by Section 71 of Madhya Pradesh Reorganization Act, 2000 Central Government hereby constitutes a Committee in regard to the allocation matters of State employees other than All India Services. The Committee will review and decide the allocation of petitioners covered by the judgement dated 17.04.2007 of the Hon’ble High Court as early as possible within three months from the date of constituting the Committee after considering the representations, if their representations were not considered earlier or if their representations have not been considered fairly. The Committee will also advise the Government for the need of issuing fresh guidelines keeping in view fair allocation of the employees, having regarding to residence of the employees, continuity of service in one state, posting of spouses and other similar factors.
