This Office Memorandum details the adjustment of EPF/CPF accumulations for canteen employees who were declared as Government employees in 1991. It clarifies the process for withdrawing and depositing contributions made to the Provident Fund Commissioners, both after and before September 1983. Specifically, employer contributions with interest will be paid to employees, while employee contributions with interest will be transferred to their GPF accounts. OFFICE MEMORANDUM
Subject : Adjustment of EPF/CPF accumulations of Canteen employees.
Canteen employees were declared as Government employees w.e.f. 1.10 .91 and orders to this effect were issued vide this Department’s O.M. No.12/5/91-Dir.(C) dated 29.1.92. Following upon the above deceleration, orders relating to their entitlement for pension/gratuity, provident fund account etc. were issued vide this Department’s O.M. No. 12/3/92-Dir.(C) dated 16.11 .92 and 16.12 .93 .
- As per provisions contained in O.M. No. 12/3/92-Dir.(C) dated 16.11 .92 the concerned departments were required to withdraw the employees and employers’ contributions made to the Provident Fund Commissioners after September, 1983 and deposit the same in the newly opened GPF accounts of the employees and the Government account in a proper manner as indicated therein.
- After the issue of the above instructions the matter relating to the status of the contributions made before September, 1983 has been under consideration. It has now been decided in consultation with the Department of Expenditure, Ministry of Finance that the amount pertaining to pre-Sep; 1983 contributions held with the Provident Fund Commissioners may also be withdrawn and adjusted as under :-
i) the Employers’ (Canteen Management Committee) contributions together with the interest thereon may be paid to the employees,
ii) the Employees’ contributions together with interest thereon be transferred to the GPF accounts opened already. - All the Ministries are requested to bring these instructions to the notice of all Attached/Subordinate offices under them, for further necessary action.
