Notional Appointment to IAS – Amar Deep Singh and Dr. Subhita Dhaka

ORDER

WHEREAS, Central Government in consultation with the State Government of Haryana had determined 08 (eight) and 10 (ten) vacancies to be filled through amongst from State Civil Services officers of Haryana to the IAS Cadre from the Select List of 2022 and 2023 respectively.

AND WHEREAS, the Selection Committee Meeting (SCM) for preparation of Select Lists of 2020 to 2024 was convened on 14.07.2025 by UPSC.

AND WHEREAS, Shri Amar Deep Singh and Dr Subhita Dhaka were considered by the Selection Committee and were recommended for the appointment by promotion to the IAS Cadre from the Select List of 2022 and 2023 respectively. Shri Amar Deep Singh was placed at SI. No. 7 of the Select List of 2022 and Dr. Subhita Dhaka was placed at SI. No. 10 of the Select List 2023.

AND WHEREAS, the recommendations of the Selection Committee were agreed to by the State Government of Haryana, the Central Government and finally approved by the UPSC on 01.08.2025.

AND WHEREAS, upon receiving the approval of the UPSC on the recommendations of the Selection Committee, this Department notified the Select List of 2020 to 2024 vide notification no. 14015/07/2025-AIS-I(S.II&III)-A dated 04.08.2025 wherein the name of Shri Amar Deep Singh was at SI. No. 7 of the Select List of 2022 and Dr. Subhita Dhaka was at SI. No. 10 of the Select List of 2023.

AND WHEREAS, this Department also notified appointments of officers included unconditionally therein and who were the members of State Civil Service (SCS) at the relevant point of time vide Notification No. 14015/07/2025-AIS-I(S.II&III)-B dated 04.08.2025.

AND WHEREAS, while considering the appointment of SCS officers included in the Select List of 2020 to 2024, it was observed that Shri Amar Deep Singh (DoB: 15.02.1966), included at SI. No. 7 of the Select List of 2022 and Dr. Subhita Dhaka (DoB: 30.03.1967), included at SI. No. 10 of the Select List of 2023 had ceased to
be members of the State Civil Service, after attaining the age of superannuation therein.

AND WHEREAS, it was observed that in terms of Regulation 9(1) of IAS (Appointment by Promotion) Regulations, 1955, only a member of the State Civil Service could be appointed to IAS.

AND WHEREAS, in view of the above provision, the appointment of Shri Amar Deep Singh and Dr Subhita Dhaka could not be notified.

AND WHEREAS, aggrieved from not being appointed to the IAS Cadre, Shri Amar Deep Singh and Dr. Subhita Dhaka filed OA 815/2025 and OA 816/2025 respectively before CAT, Chandigarh Bench.

AND WHEREAS, Ld. CAT, vide Orders dated 08.08.2025 in the respective OAs has set out the following directions:

Order dated 08.08.2025 in OA 815/2025

“… direction to the competent authority among the respondents to consider and decide the contention of applicant vide representation dated 25.07.2025 (Annexure A-11) within eight weeks from the date of receipt of certified copy of the order by passing a reasoned and speaking order as per the relevant rules on the subject and the dictum of orders being relied upon by the applicant”

Order dated 08.08.2025 in OA 816/2025

“… direction to the competent authority among the respondents to consider and decide the contention of applicant vide representation dated 25.07.2025 (Annexure A-11) within eight weeks from the date of receipt of certified copy of the order by passing a reasoned and speaking order as per the relevant rules on the subject and the dictum of orders being relied upon by the applicant”

NOW THEREFORE, in pursuance of Orders dated 08.08.2025 of Ld. CAT, Chandigarh Bench in OA 815/2025 and OA 816/2025, Shri Amar Deep Singh (DoB: 15.02.1966) and Dr. Subhita Dhaka (DoB: 30.03.1967) will be deemed to have been notionally appointed to the IAS of Haryana cadre on the basis of inclusion of their names at Sl. No. 7 of the Select List of 2022 and Sl. No. 10 of the Select List of 2023 respectively not later than their immediate juniors viz Shri Sushil Kumar – I (DoB: 29.07.1972) appointed from Select List of 2022 and Shri Jaideep Kumar (DoB: 14.04.1969) appointed from Select List of 2024 respectively vide Notification No. 14015/07/2025-AIS-I(S.II&III)-B dated 04.08.2025.
The period between their superannuation in State Services and their present appointment to IAS shall deem to be continued as service subject to vigilance clearance by the State Government.
