This document provides clarification regarding a 1999 notification amending Rules 18 and 22B of the All India Services (DCRB) Rules, 1958. The clarification addresses concerns raised by State Governments and individuals regarding the definition of ‘post last held’ for pension/family pension calculations. It specifies that the pension should not be less than 50% of the minimum pay in the revised scale as of January 1, 1996, based on the scale held at the time of retirement. The clarification extends to the provisions of sub-rule (2) of Rule 22B.

Sub: Clarification to this Department’s Notification dated 14.1.1999amendment to Rules 18 and 22B of the AIS (DCRB) Rules, 1958.
Sir,
I am directed to state that this Department had issued a notification No. 14021/5/98-AIS (II) dated 14th January, 1999 making amendments to Rules 18 and 22B of the AIS (DCRB) Rules 1958, for fixation of pension/family pension of the member/deceased members of the All India Services.
- In the course of implementation of the aforesaid notification clarifications have been sought by the State Governments and individuals about the actual connotation of the “post last held” by the pensioner at the time of his/her superannuation. In exercise of powers conferred on the Central Government under Rule 29 of the AIS(DCRB)Rules, 1958, it is clarified that the proviso to Rule 18 (1)(b)(i) ibid, issued in the aforesaid notification i.e. “the pension of all pensioners irrespective of their date of retirement shall not be less than 50 % of the minimum pay in the revised scale of pay w.e.f. 1.1.1996 of the post last held by the pensioner” shall mean that pension of all pensioners irrespective of their date of retirement shall not be less than 50 % of the minimum of the corresponding scale as on 1.1.1996 of the scale of pay held by the pensioner at the time of superannuation/retirement. The provisions of sub-rule (2) of Rule 22B ibid may also be similarly defined
