सा.का.नि. 820(अ).—अखिल भारतीय सेवा अधिनियम, 1951 (1951 का 61) की धारा 3 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा संबंधित राज्य सरकारों के साथ परामर्श करने के बाद केन्द्रीय सरकार अखिल भारतीय सेवा (मृत्यु सह सेवानिवृत्ति प्रसुविधाएँ) नियमावली, 1958 में आगे और संशोधन करने के लिए एतद्द्वारा निम्नलिखित नियम बनाती है, अर्थात् :—

1. (i) इन नियमों का नाम अखिल भारतीय सेवा (मृत्यु सह सेवानिवृत्ति प्रसुविधाएँ) संशोधन नियमावली, 2004 है।

(ii) ये नियम, शासकीय राजपत्र में इनके प्रकाशन की तारीख से लागू होंगे।

1. अखिल भारतीय सेवा (मृत्यु सह सेवानिवृत्ति प्रसुविधाएँ) नियमावली, 1958 (इसके पश्चात् उक्त नियमावली के रूप में उल्लिखित) में नियम 16 के उप नियम (2) में निम्नलिखित परन्तुक जोड़ा जाएगा, अर्थात् :—

“परन्तु यह और कि संबंधित राज्य सरकार, सेवा के किसी सदस्य द्वारा अनुरोध किए जाने पर, संतुष्ट होने और लिखित में दर्ज किए जाने वाले कारणों से नोटिस की अवधि में ढील प्रदान कर सकती है।”

1. उक्त नियमावली में नियम 26 में उप नियम (1) के परन्तुक के लिए निम्नलिखित परन्तुक प्रतिस्थापित किया जाएगा, अर्थात् :—

“परन्तु यह कि संबंधित राज्य सरकार, उसी राज्य सेवा संयर्ग के किसी सदस्य को जो कि अधिकतम 22400-24500/- रुपए के वेतनमान वाले पद को धारण किए हुए है और जिसने सेवा से अपनी सेवानिवृत्ति से 3774 GI/2004

पहले के पांच वर्ष की अवधि के दौरान केन्द्र सरकार के अंतर्गत कार्य नहीं किया है, को पूर्व स्वीकृति प्रदान करे :

परन्तु यह और कि संबंधित पेंशनभोगी को ऐसी घोषणा पर कारण बताने का अवसर दिए बिना ऐसा कोई आदेश जारी नहीं किया जाएगा :

परन्तु यह भी कि किसी ऐसे पेंशनभोगी को, जिसे केन्द्रीय सरकार द्वारा सेवानिवृत्ति पूर्व की छुट्टी के दौरान वाणिज्यिक रोजगार/नियुक्ति प्राप्त करने की अनुमति प्रदान कर दी गई है, तो सेवानिवृत्ति के बाद ऐसे रोजगार/नियुक्ति को जारी रखने के लिए उसे, बाद में अनुमति लेनी अपेक्षित नहीं है।”

पाद टिप्पणी : मूल नियम भारत के राजपत्र में दिनांक 18 अगस्त, 1958 को सा.का.नि. संख्या 728 द्वारा प्रकाशित किए गए और तत्पश्चात् निम्नलिखित संख्याओं द्वारा संशोधित किए गए :—

New Delhi, the 15th December, 2004
G.S.R. 820(E).-In exercise of the powers conferred by Sub-section (1) of Section 3 of the All India Services

Act, 1951 (61 of 1951), the Central Government, after consultation with the Governments of the States concerned, hereby makes the following rules further to amend the All India Services (Death-cum-Retirement Benefits) Rules, 1958, namely :-

1. (1) These rules may be called the All India Services (Death-cum-Retirement Benefits) Amendment Rules, 2004.
   (2) They shall come into force from the date of their publication in the Official Gazette.
2. In the All India Services (Death-cum-Retirement Benefits) Rules, 1958 (hereinafter referred to as the said rules), to sub-rule (2) of rule 16, the following proviso shall be added, namely :-
   “Provided further that the State Government concerned on a request made by the member of the service may, if satisfied and for reasons to be recorded in writing, relax the period of notice”.
3. In the said rules, in rule 26 , for the provisos to sub-rule (1), the following provisos shall be substituted, namel $i$ :-
   “Provided that the previous sanction may be granted by the State Government concerned on whose cadre the member of the service is borne and who is not holding a post higher than a post in the pay scale of Rs. 22400-24500 and has not worked under the Central Government during the preceding five years prior to his retirement from the service:
   Provided further that no such order shall be made without giving the pensioner concerned an opportunity of showing cause against such declaration:
   Provided also that a pensioner who has been permitted by the Central Government to take up a particular commercial employment during leave preparatory to retirement shall not be required to obtain subsequent permission for his continuance in such employment after retirement.”
