साःकार्पि. 699(अ).—अखिल भारतीय सेवाएं अधिनियम, 1951 (1951 का 61) की धारा 3 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार, संबंधित राज्य सरकारों से परामर्श के एतदद्वारा अखिल भारतीय सेवाएं (मृत्यु-सह-सेवानिवृत्ति-प्रसुविधाएं) नियमावली, 1958 में आगे और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् :-
- (i) इन नियमों का नाम अखिल भारतीय सेवाएं (मृत्यु-सह-सेवानिवृत्ति-प्रसुविधाएं) संशोधन नियमावली, 2005 है।
(ii) ये नियम तत्काल प्रभाव से लागू होंगे।
- अखिल भारतीय सेवाएं (मृत्यु-सह-सेवानिवृत्ति-प्रसुविधाएं) नियमावली, 1958 के नियम 16 के उप-नियम (1) में दूसरे परन्तुक के नीचे निम्नलिखित परन्तुक जोड़ा जाए :-
“परन्तु यह भी कि किसी राज्य सरकार में मुख्य सचिव के पद पर कार्यरत सेवा के किसी सदस्य को केन्द्र सरकार के पूर्वानुमोदन से अधिकतम 6 माह की अवधि का सेवा विस्तार प्रदान किया जा सकता है जिसे संबंधित राज्य सरकार द्वारा पूर्ण रूप से न्यायोचित ठहराते हुए और जनहित में संस्तृत किया गया हो।”।

New Delhi, the 30th Noyember, 2005
GSR 699(E).-In exercise of powers conferred by Sub-section (1) of Section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consula-
tion with the Government of the States concerned hereby makes the following rules further to amend the All India Services (Death-Cum-Retirement Benefits) Rules, 1958, namely:- $\square$
- (i) These rules may be called the All India Services (death-Cum-Retirement Benefits) Amendment Rules, 2005:
(ii) They shall come into force forthwith. - In the All India Services (Death-cum-Retirement Benefits) Rules, 1958 in rule 16, sub-rule (1), the following proviso may be inserted below second proviso :-
“Provided also that a Member of the Service holding the post of Chief Secretary to a State Government may be given extension of service for a period not exceeding six months on the recommendations made by the concerned State Government with full justification and in public interest, with the prior approval of the Central Government.”.
