सा.का.नि. 20(अ).—अखिल भारतीय सेवा अधिनियम, 1951 (1951 का 61) की धारा 3 की उप-धारा (1) द्वारा प्रदत्त शक्तियाँ का प्रयोग करते हुए, केन्द्र सरकार, संबंधित राज्य सरकारों के साथ परामर्श करने के पश्चात् अखिल भारतीय सेवाएँ (मृत्यु सह-सेवानिवृत्ति लाभ) नियमावली, 1958 में और आगे संशोधन करने के लिए एतद्वारा, निम्नलिखित नियम बनाती हैं, अर्थात् :—

1. (i) इन नियमों को अखिल भारतीय सेवाएँ (मृत्यु सह-सेवानिवृत्ति लाभ) संशोधन नियमावली, 2007 कहा जाए ।
2. (ii) ये सरकारी राजपत्र में इनके प्रकाशन की तिथि से लागू होंगे ।
3. अखिल भारतीय सेवाएँ (मृत्यु सह-सेवानिवृत्ति लाभ) नियमावली, 1958 (इसके बाद उक्त नियमावली के रूप में संदर्भित) में नियम 26 में :—
4. (क) उप-नियम (1) में, “दो वर्ष” शब्दों के लिए “एक वर्ष” शब्द को प्रतिस्थापित किया जाएगा ।
5. (ख) उप-नियम (1) के दूसरे परन्तुक में “पांच वर्ष” शब्दों की जगह “तीन वर्ष” शब्द को प्रतिस्थापित किया जाएगा ।
6. (ग) उप-नियम (3) के लिए निम्नलिखित उप-नियम को प्रतिस्थापित किया जाएगा, अर्थात् :—
7. (3) किसी पेंशनभोगी को कोई रोजगार शुरू करने के लिए उप-नियम (1) अथवा उप-नियम (2) के अंतर्गत अनुमति देने या अनुमति न देने में केन्द्र सरकार या राज्य सरकार, जैसा भी मामला हो, निम्नलिखित पहलुओं का ध्यान रखेगी, अर्थात् :—
8. (i) क्या वह संगठन, जिसको पेंशनभोगी ज्वाइन करने का विचार रखता है, कहीं भारत के विदेशी संबंध के राष्ट्रीय सुरक्षा और घरेलू सद्भावना प्रतिकूल हित का कोई टकराव अथवा गतिविधि से सरोकार रखता है; तथा क्या वह संगठन किसी प्रकार की आसूचना गैदरिंग/सूचना एकत्र करने का कार्य कर रहा है?
9. (ii) क्या पेंशनभोगी अपनी सेवा के आखिरी तीन वर्षों में संवेदनशील अथवा रणनीतिक सूचना का संसर्गी रहा है जो उस संगठन के हित या कार्य के क्षेत्रों से प्रत्यक्ष रूप से संबंधित हो जिससे जुड़ने का वह विचार रखता है या उस से

जिसमें वह व्यवसाय करने/परामर्श देने का विचार रखता है;

• (iii) क्या पेंशनभोगी द्वारा धारण किए गए कार्यालय (कार्यालयों) को नीतियों तथा अभ्यावेदित हितों या उस संगठन (जिसको वह ज्वाइन करने का विचार रखता है) द्वारा शुरू किए गए कार्यों के बीच हितों का टकराव है। इस प्रकार के हितों के टकराव की व्याख्या संकीर्ण ढंग से नहीं की जानी चाहिए जिसका मतलब सरकार या इसके उपक्रमों के साथ सामान्य आर्थिक प्रतियोगिता है।
• (iv) क्या पेंशनभोगी का सर्विस रिकॉर्ड, विशेष रूप से सत्यनिष्ठा तथा गैर-सरकारी संगठनों के साथ काम करने के संदर्भ में स्पष्ट है?
• (v) क्या प्रस्तावित नियोक्ता द्वारा पेंशनभोगी को दी जाने वाली परिलक्ष्यियां तथा प्रस्तावित परिलक्ष्यियां तथा आर्थिक लाभ वर्तमान में उद्योग में प्रचलित परिलक्ष्यियों से काफी अधिक है। “काफी अधिक” शब्द की व्याख्या ऐसे लाभों में वृद्धियों को कवर करने के लिए संकीर्ण ढंग से नहीं दी जानी चाहिए जिनके परिणामस्वरूप पूरे उद्योग या अर्थव्यवस्था में कुल मिलाकर उत्पन्न हो जाए; और
• (vi) कोई अन्य संबंधित पहलू”

1. उक्त नियमावली में, अनुसूची “एल” के लिए निम्नलिखित अनुसूची प्रतिस्थापित की जाएगी, अर्थात् :-
   • “अनुसूची एल”
   • [नियम 26 का उप-नियम (1) तथा (2) देखें]

वाणिज्यिक रोजगार स्वीकार करने के लिए आवेदन फार्म

1. नाम (बड़े अक्षरों में)
2. सेवानिवृत्ति की तिथि
3. मंत्रालय/विभाग/कार्यालय जिसमें अधिकारी ने सेवानिवृत्ति के पहले तीन वर्ष के दौरान कार्य किया (अवधि सहित)

मंत्रालय/विभाग/कार्यालय धारित पद अवधि

का नाम से तक

नोट : अनुमति देने से पहले संवर्ग नियंत्रक प्राधिकारी तथा उस कार्यालय जहां से उक्त अधिकारी ने सेवानिवृत्ति ली हो, एक “अनापत्ति प्रमाण पत्र” प्राप्त किया जाए।

1. सेवानिवृत्ति के समय धारित पद तथा वह अवधि जब यह पद धारित किया जाए।
2. सेवानिवृत्ति के समय पद का वेतनमान तथा अधिकारी द्वारा आहरित वेतन
3. पेंशन से संबंधित लाभ-

अनुमानित/स्वीकृत पेंशन ग्रेच्युटी, यदि कोई हो

(कोई संशोधित पेंशन, यदि हो, उल्लेख करें)

1. शुरू किए जाने वाले वाणिज्यिक रोजगार से संबंधित विवरण-
   • (क) फर्म/कम्पनी/सहकारी सोसायटी का नाम।
   • (ख) फर्म/कम्पनी/सहकारी सोसायटी द्वारा कार्यान्वित व्यवसाय निर्मित किए जा रहे उत्पादों या उपलब्ध कराई गई सेवाओं आदि का स्वरूप।
   • (ग) क्या अधिकारी ने अपने सरकारी कैरियर के पिछले तीन वर्षों में फर्म/कम्पनी/सहकारी सोसायटी आदि के साथ कोई कार्य किया है।
   • (घ) फर्म/कम्पनी/सहकारी सोसायटी आदि के साथ सरकारी कार्य की अवधि तथा प्रकृति।

(ङ) फर्म/कम्पनी/सहकारी सोसायटी द्वारा दिए गए कार्य/पद का नाम (च) क्या पद का विज्ञापन दिया गया था, यदि नहीं, तो प्रस्ताव किस प्रकार दिया गया (विज्ञापन का विवरण तथा नियुक्ति प्रस्ताव की एक प्रतिलिपि संलग्न करें) (छ) कार्य/पद से संबंधित ड्यूटी का विवरण (ज) पद/कार्य के लिए प्रस्तावित पारिश्रमिक- (i) यदि व्यवसाय स्थापित करने का प्रस्ताव कर रहे हैं, तो स्पष्ट करें (ii) व्यावसायिक योग्यता/व्यवसाय के क्षेत्र में (ii) प्रस्तावित व्यवसाय की प्रकृति 8. कोई सूचना जो आवेदक अपने अनुरोध के समर्थन में प्रस्तुत करना चाहता हो 9. घोषणा :-

मैं एतद्द्वारा घोषणा करता हूँ कि- (i) रोजगार जिसे शुरू करने का मेरा विचार है, में वे गतिविधियां शामिल नहीं होंगी जो भारत के विदेशी संबंधों, राष्ट्रीय सुरक्षा तथा राष्ट्रीय सौहार्द से पूर्वाग्रह ग्रस्त हों। इसमें पिछले तीन वर्ष के दौरान मेरे द्वारा ग्रहण किए गए कार्यालय (कार्यालयों) की नीतियों के हितों तथा अभ्यावेदित हितों तथा उस संगठन जिसमें मैं ज्वाइन करने का विचार रखता हूँ, द्वारा शुरू किए गए कार्यों के बीच कोई टकराव शामिल नहीं होगा तथा इसकें कारण सरकार की कार्य प्रणाली के साथ मेरा कोई टकराव पैदा नहीं होगा। (ii) मैं सेवा के पिछले तीन वर्षो में ऐसी संवेदनशील अथवा रणनीतिक सूचना का संसर्गी नहीं रहा हूँ जिसका उस संगठन, जिसे ज्वाइन करने का मेरा विचार है, के हित क्षेत्रों या कार्य में मेरे उस क्षेत्र, जिसमें मैं व्यवसाय करने/परामर्श देने का विचार रखता हूँ, से सीधा संबंध हो। (iii) मेरा सर्विस रिकॉर्ड, विशेष रूप से सत्यनिष्ठा तथा गैर-सरकारी संगठनों के साथ कार्य करने के संदर्भ में स्पष्ट है।

मैं इस बात से सहमत हूं कि सरकार द्वारा कभी आपत्ति करने पर मैं वाणिज्यिक रोजगार से अपना नाम वापस ले लूंगा। पता : स्थान : दिनांक :

MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS (Department of Personnel and Training) NOTIFICATION

New Delhi, 12th January, 2007
G.S.R. 20(E).-In exercise of the powers conferred by Sub-section (1) of Section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Governments of the States concerned, hereby makes the following rules further to amend the All India Services (Death-cum-Retirement Benefits) Rules, 1958, namely:

1 (1) These rules may be called the All India Services (Death-cum-Retirement Benefits) Amendment Rules, 2007.
(2) They shall come into force from the date of their publication in the Official Gazette.
2. In the All India Services (Death-cum-Retirement Benefits) Rules, 1958 (hereinafter referred to as the said rules), in rule 26:-
(a) in sub-rule (1), for the words “two years”, the words “one year” shall be substituted;
(b) in second proviso to sub-rule(1), for the words “five years”, the words “three years” shall be substituted;
(c) For sub-rule (3), the following sub-rule shall be substituted namely :-
“(3) In granting or refusing permission under sub-rule (1) or sub-rule (2) to a pensioner for taking up any employment, the Central Government or the State Government, as the case may be, shall have the following factors, namely:-
(i) whether the organisation the pensioner proposes to join has any conflict of interest or activities prejudicial to India’s foreign relations, national security and domestic harmony;

and whether the organisation is undertaking any form of intelligence gathering;
(ii) whether the pensioner has been privy to sensitive or strategic information in the last three years of his service which is directly related to the areas of interest or work of the organisation which he proposes to join or the areas in which he proposes to practice/consult,
(iii) whether there is conflict of interest between policies of the office(s) held by the pensioner during the last three years and the interest represented or work undertaken by the organisations he proposes to join. Such conflict of interest, however, should not be interpreted narrowly to mean normal economic competition with Government or its Undertakings,
(iv) whether the service record of the pensioner is clear, particularly with respect to integrity and dealings with Non-Government Organisations,
(v) the emoluments offered by the proposed employer to the pensioner and whether the proposed emoluments and pecuniary benefits are far in excess of those currently prevalent in the Industry. (The word “far in excess” should not be narrowly interpreted to cover increases in such benefits that may be result of buoyancy in the industry or in the economy as a whole); and
(vi) any other relevant factors.”
3. In the said rules, for Schedule ‘ $L$ ‘, the following Schedule shall be substituted namely:

3. Ministry/Department/Office in which the officer served during the last three years preceding retirement (with duration):

Note : Before granting permission a ‘no objection’ would be obtained from the Cadre Controlling Authority and from the office from where the officer retired.
4. Post held at the time of retirement and period for which held
5. Pay scale of the post and pay drawn by the Officer at the time of retirement
6. Pensionary benefits:

Pension expected/sanctioned
Gratuity, if any
(commutation, if any, should be mentioned)
7. Details regarding commercial employment proposed to be taken up :
(a) Name of the firm/company/co-operative Society, etc.
(b) Type of business carried out and products being manufactured or services being provided by the firm/ company/co-operative Society, etc.
(c) Whether the officer had during the last three years of his official career, any dealings with the firm/ company/cooperative Society, etc.
(d) Duration and nature of the official dealings with the firm/ company/co-operative Society, etc.
(e) Name of the job/post offered by the firm/company/co-operative Society, etc.
(f) Whether post was advertised, if not, how was offer made (attach details of the advertisement, and a copy of the offer of appointment, if any).

(g) Description of the duties of the job/post. (h) Remuneration offered for post/job. (i) If proposing to set up a practice, indicate (i) professional qualification/in the field of practice, (ii) nature of proposed practice. 8. Any information which the applicant desires to furnish in support of his request. 9. Declaration:

I hereby declare that (i) The employment which I propose to take up will not involve activities prejudicial to India’s foreign relations, national security and domestic harmony. It will not involve conflict of interest with the policies of the office(s) held by me during the last three years and the interest represented or work undertaken by the organisations I propose to join and will not bring me into conflict with the working of the Government. (ii) I have not been privy to sensitive or strategic information in the last three years of service which is directly related to the areas of interest or work of the organisation which I propose to join or the areas in which I propose to practice/consult. (iii) My service record is clear, particularly with respect to integrity and dealings with Non-Government Organisations.
