तारीख : पेंशन भोगी के हस्ताक्षर डाक पता : ब्योरे सत्यापित किए हस्ताक्षर पेंशन वितरण प्राधिकारी को रबड़ की मोहर व्याख्यात्मक ज्ञापन केन्द्रीय सरकार ने अखिल भारतीय सेवाओं के बारे में 1983 की रिट याचिका संख्या 3958-61 में भारत के उच्चतम न्यायालय के दिनांक 9 दिसम्बर, 1986 के निर्णय को पहली अप्रैल, 1985 से कार्यान्वित करने का निर्णय लिया है। उपर्युक्त निर्णय को कार्यान्वित किए जाने की दृष्टि से अखिल भारतीय सेवाएं (पेंशन का संराशीकरण) विनियम, 1959 को, तदनुसार पहली अप्रैल, 1985 से संशोधित किया जा रहा है।
यह प्रमाणित किया जाता है कि प्रस्तावित संशोधनों को भूतलक्षो प्रभाव से लागू किए जाने से किसी भी व्यक्ति पर प्रतिकूल प्रभाव नहीं पड़ेगा। [फा. सं. 11025/1/2002-अ.भा.से.-II] संगीता सिंह, निदेशक (सेवा) पाद टिप्पण :—मूल विनियम दिनांक 24-06-1959 को अधिसूचना सा.का.नि. संख्या 714 द्वारा भारत के राजपत्र में प्रकाशित किए गए थे तथा बाद में निम्नलिखित द्वारा इनमें संशोधन किए गए थे :-

NOTIFICATION
New Delhi, the 21st November, 2002
G.S.R. 779 (E).-In exercise of the powers conferred by Sub-section (1), read with Sub-section (1A) of Section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Govemments of the States concerned, hereby makes the following regulation further to amend the All India Services (Commutation of Pension) Rugulations, 1959, namely :-
- (1) These regulations may be called the All India Services (Commutation of Pension) Amendment Regulations, 2002.
(2) They shall be deemend to have come into force with effect from the 1st day of April, 1985. - In the All India Services (Communtation of Pension) Regulations, 1959.
(a) after regulation 4, the following regulation shall be inserted, namely :-
“4A. Members of the All India Services who have commuted a portion of their pension and on 1st April, 1985 or thereafter have completed or will complete fifteen years from their respective dates of retirement will have their commuted portion of pension restored :
Provided that members of the service who got themselves absorbed under Central Public Sector Undertakings/autonomous bodies and have received/or opted to receive commuted value up to forty per cent of pension as well as terminal benefits equal to the commuted
value of the balance amount of pension left after commuting up to forty per cent of pension are not entitled to any benefit under these regulations as they ceased to be a pensioner under the All India Services (Death-CumRetirement Benefits) Rules, 1958 :
Provided further that in a cases where the pensioner had completed fifteen years from the date of retirement on 1-4-1985 or thereafter and had died subsequently his/her legal hear(s) is/are also entitled to receive arrears w.e.f. 1-4-1985 (or from the date of completion of fifteen years from the date of retirement, whichever is later), till the date of the pensioner’s death. For this purpose legal heirs may also apply to the pension disbursing authority, etc. :
Provided also that each pensioner who is eligible for restoration of his commuted portion of pension is required to apply in Form ‘ $F$ ‘ to the pension disbursing authority/ bank/post office who will restore the commuted portion of pension if the commuted amount has been mentioned in the pension payment order and will also pay the arrears, if any. In cases where the Pension Payment Order does not contain information regarding commuted portion, pension disbursing offices will obtain information from Accounts Offices which issued the Pension Payment Order.”

The Central Government has decided to implement the judgement dated 9th December, 1986 of the Supreme Court of India in Writ Petition No. 3958-61 of 1983 in respect of the All India Services w.e.f. 1st April, 1985. With a view to implementing the aforesaid judgement, the All India Services (Commutation of Pension) Regulations, 1959 are being amended accordingly w.c.f. the 1st April, 1985. It is certified that none will be adversely affected by the restrospective operation of the proposed amendments.
