9.THE INDIAN POLICE SERVICE (SPECIAL SALLOWANCE) RULES, 1977
In exercise of the powers conferred by sub-section (1) of section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Governments of the States concerned, hereby makes the following rules, namely :-
- Short title-These Rules may be called the Indian Police Service (Special Allowance) Rules, 1977.
- Definitions-In these rules, unless the context otherwise requires;
(a) “leave” means leave as defined in the All India Services (Leave) Rules, 1955;
(b) “Service” means the Indian Police Service. - Payment of special allowance to certain members of the Service:-(1) A member of the Service appointed as –
(a) Director, Sardar Vallabhabhai Patel National Police Academy, Hyderabad, or Inspector General of Police designated to be in-charge of the State Police in respect of the States of Andhra Pradesh, Assam, Bihar, Gujarat, Haryana, Himachal Pradesh, Jammu and Kashmir, Karnataka, Kerala, Maharashtra, Madhya Pradesh, Orissa, Punjab, Rajasthan, Tamil Nadu, Uttar Pradesh and West Bengal, shall with effect from the 1^{st } of January, 1973; and
(b) { }^{1} The Commissioner of Police designated to be in-charge of Delhi Police, shall with effect from the 1^{st } of July, 1978 be entitled to a special allowance at the rate of Rs. 250 per mensem.
1(2)The special allowance payable under this rule shall also be admissible to a member of the Service referred to in sub-rule (1) when he is on leave for a period not exceeding 120 days, if it is certified that but for his proceeding on leave, he would have continued to hold a post to which the special allowance is admissible, but shall not be admissible during periods of suspension or joining time.
- Interpretation:-If any question arises as to the interpretation of these rules, it shall be referred to the Central Government who shall decide the same.
Explanatory Memorandum
These rules are being framed to implement the decision taken by the Government of India to grant special allowance to the members of Indian Police Service holding posts mentioned in clause (a) of sub-rule (1) of rule 3 of these rules in pursuance of the recommendation of the Third Central Pay Commission and to the Inspector General of Police designated to be incharge of Delhi Police. The special allowance is proposed to be given retrospectively from the dates mentioned in rule 3 of the rules. No officer is likely to be adversely affected by the granting of the special allowance from such retrospective dates.
