16. THE ALL INDIA SERVICES (REMITTANCES INTO AND PAYAMENTS FROM PROVIDENT AND FAMILY PENSION FUNDS) RULES, 1958

In exercise of the powers conferred by sub-section (1) of Section 3 of the All India Services Act, 1951 (61 of 1951), the Central Government, after consultation with the Governments of the States concerned, hereby makes the following rules, namely:-

  1. Short title and application – (1) These Rules may be called the All India Services (Remittances into the Payments from Provident and Family Pension Funds) Rules, 1958.
    (2) They apply to persons-
    (a) who are members of the Indian Administrative Services and who before becoming members thereof were members of the Indian Civil Service; and
    (b) who are members of the Indian Police Service and who before becoming members thereof were members of the Indian Police.
  2. Definitions – In these rules –
    (a) ‘Fund’ means a Family Pension Fund or a Provident Fund governed by any of the rules specified in the Schedule;
    (b) ‘Officer’ means a member of the Indian Administrative Service or the Indian Police Service to whom these rules apply;
    (c) ‘Schedule’ means the Schedule appended to these rules.
  3. Conversion of existing credits in sterling into rupees – Notwithstanding anything contained in any of the rules specified in the Schedule, the amount standing to the credit of an officer in a Fund at the commencement of these rules shall be converted into rupees at the rate of 1 sh .6 d . to a rupee.
  4. Remittances into and Payments from the Funds – Notwithstanding anything contained in any of the rules specified in the Schedule, on and after the commencement of these rules, all remittances into and payments from a Fund shall be made in India and in rupees:

Provided that, where the payee is of non-Indian domicile, payment from a Fund may be made through the High Commissioner of India in the United Kingdom either in the sterling minimum or in rupees converted into sterling at such rate of exchange as the President may be order prescribe.
{ }^{1} 5. Interpretation – If any question arises as to the interpretation of these rules, the Central Government shall decide the same.
