This Office Memorandum clarifies the process for granting study leave to Central Government employees for periods exceeding 12 months. It states that such leave does not require relaxation of existing rules and can be sanctioned by Ministries/Departments within the delegated powers, up to a maximum of 24 months, provided all other conditions for granting study leave are met. OFFICE MEMORANDUM
Subject:- Grant of study leave to Central Government employees
for a period of 24 months at a time – clarification –
The undereigned is directed to say that a number of
references for grant of study leave for a period of more than
12 months at a time in relaxation of Rule 51(a) of CSS(Leave)
Rules, 1972, are being received in this Department from the
various Ministries/Departments. Doubts have also been raised
whether grant of study leave for a period exceeding 12 months at
a stretch requires the approval of this Department or whether
it can be granted by Ministries/Departments under their powers.
- This issue has been considered in this Department and
it has been held that grant of study leave for a period exceeding
12 months at a time does not involve relaxation of Rule 51(a)
of the CSS(Leave) Rules, 1972. It is, therefore, clarified that
Ministries/Departments are competent to sanction study leave in
exercise of the powers delegated to them under the First
Schedule of the Central Civil Services (Leave) Rules, 1972 for
a period exceeding 12 months upto the maximum limit of 24 months
at a stretch also provided all the other conditions precedent
to grant of study leave are fulfilled. - In so far as persons serving in the Indian Audit and
Accounts Department are concerned, this issues after consulta-
tion with the Comptroller and Auditor General of India. -
