  3. Both parties filed written-statements in support of their respective cases, it is not necessary to state the contents thereof. Before the hearing was taken up the parties filed a settlement and prayed for passing all award in terms thereof. The terms of the settlement were read over and explained to them and admitted to be correct. I accept the settlement as bona-ide.

  4. Hence I pass this Award in terms of the settlement so far as the terms relate to the dispute. The settlement do form part of this Award.

Messrs Bera Stone Lime Company Limited, P.O. Birmittrapur, District Sundargarh, Orissa.

Their Workmen represented by Gangpur Labour Union, P.O. Birmittrapur, District Sundargarh, Orissa.

The humble petition of the Management of Messrs. Bera Stone Lime Company Limited and their workmen must respectfully be given.

  1. That the following dispute was referred for adjudication by the Central Government in the Ministry of Labour, Employment and Rehabilitation on the 12th February, 1971:

“Whether the action of the Management of M/s. Bera Stone Lime Co. Ltd., P.O. Birmittrapur, District Sundargarh (Orissa) in retiring the under-mentioned workmen with effect from the dates shown against them was unjustified? If so, to what relief the workmen are entitled?

  1. Shri Obed Horo—17th September, 1970.
  2. Shri Sheikh Ansari—27th September, 1970.

  3. Shri Keshrimal Sarogi—17th September, 1970.

  4. Shri Pashu Lakra—17th September, 1970.”

  5. The case is now pending or hearing before the Hon’ble Tribunal.

  6. That the representatives of the Parties above-named discussed at length between themselves the matter and arrived at an amicable settlement regarding the said issues.

Terms of Settlement

  1. The Parties agreed that the workmen concerned will be deemed to have been retired on the dates mentioned in their retirement letters.
  2. In consideration of the Union’s request the management, as a gesture of goodwill, and in the interest of good management employee relationship agrees to pay to the four retired persons ex-gratis amount in addition to the gratuity, as mentioned against each in full settlement of the claim:
