आ० आ० (म० 804-राष्ट्रपति, संविधान के अनुच्छेद 148 के
अन्य (5) के साथ पहिया जसके अनुच्छेद 309 के दरमहक द्वारा प्रवक्त
हथियारी का प्रयोग करते हुए तथा भारतीय लेखा परीक्षा और लेखा
विभाग में सेवा करने वाले व्यक्तियों के सम्बन्ध में नियंत्रक महाविद्या-
शोधक के परामर्श करने के दरबाए, केन्द्रीय सिविल मेनः (छुट्टी) नियम,
1972 का और संशोधन करने के लिए निम्नलिखित नियम बनाते
हैं, अर्थात् :-
1. (1) इन नियमों का संक्षिप्त नाम केन्द्रीय सिविल सेवा (छुट्टी)
संपूर्ण संशोधन नियम, 1983 है।
(2) ये राजपथ में प्रकाशन की तारीख को प्रपुत्त होने।
2. केन्द्रीय सिविल सेवा (छुट्टी) नियम, 1972 के नियम, 39 के
अन्वित (3) के स्थान पर निम्नलिखित उन नियम रखा जाएगा,
है, अर्थात् :-
“(3) ऐसे किसी भी सरकारी सेवक के मामले में जो सेवानिवृत्ति
की आयु प्राप्त होने पर उस समय सेवा-विपुत्त होता है जब
वह नितम्बनाधीन है अथवा जब उसके विरुद्ध समुशासनिक
अववा दायित्व कार्यवाहियां लॉन्चर है, और यदि छुट्टी मंजूर
करने के लिए सक्षम प्राधिकारी का यह विचार है कि उसके
विरुद्ध कार्यवाहियों के यवाप्त हो जाते पर उनसे कुछ धन
प्रमूल करने को कोई सम्भावना है तो उक्त प्राधिकारी उसकी
अधित छुट्टी के समतुल्य संपूर्ण नकद राशि अथवा उसका कोई
माल रोक सकता है। कार्यवाहियों की धनाप्ति पर वह सरकारी
देशों के यदि कोई हो, समायोजन के दरबात् एम प्रकार रोकी
गई रकम पाने का पाल हो जाएगा।”

G.S.R. 804—In exercise of the powers conferred by the
proviso to Article 309 of the constitution read with clause
(3) of Article 148 thereof and after consultation with the
Comptroller and Auditor General in relation to persons
serving in the Indian Audit and Accounts Department, the
President hereby makes the following rules further to amend
the Central Civil Services (Leave) Rules, 1972, namely:-
1. (1) These rules may be called the Central Civil Ser-
vices (Leave) (Fourth Amendment) Rules, 1983.
(2) They shall come into force on the date of their pub-
lication to the Official Gazette.
2. In the Central Civil Services (Leave) Rules, 1972, for
sub-rule (3) of Rule 39, the following sub-rule shall be
substituted, namely:-
“(3) The authority competent to grant leave may with-
hold whole or part of cash equivalent of earned
leave in the case of a Government servant who
retires from service on attaining the age of retire-
ment while under suspension or while disciplinary

आज का 894-राष्ट्रपति, मंत्रिपाल के अनुच्छेद 148 के पृष्ठ (5) के साथ पहला उसके अनुच्छेद 309 के पृष्ठ द्वारा प्रदत्त प्रतियोगी का प्रयोग करते हुए तथा भारतीय लेखा परीक्षा और लेखा विभाग में सेवा करते वाले व्यक्तियों के सम्बन्ध में नियंत्रक महाविद्यालय के परामर्श करने के पश्चात्, केन्द्रीय सिविल सेवा (छुट्टी) नियम, 1972 का और संशोधन करने के लिए निम्नलिखित नियम बनाते है उचितः—

1. (1) इन नियमों का संक्षिप्त नाम केन्द्रीय सिविल सेवा (छुट्टी) चतुर्थ संशोधन नियम, 1983 है ।
2. ये राजपथ में प्रकाशन की तारीख को उनसे दोगे ।
3. केन्द्रीय सिविल सेवा (छुट्टी) नियम, 1972 के नियम, 39 के उपनियम (3) के स्थान पर निम्नलिखित उपनियम रखा जाएगा, है, उचितः—

“(3) ऐसे किसी भी सरकारी सेवक के मामले में जो सेवानिवृत्ति की आयु प्राप्त होने पर उस समय वित्त-विवरण होता है जब वह नियन्त्रणाधीन है अथवा जब उनके विरुद्ध समुपालनिक अथवा दायित्व कार्यवाहिका लॉन्चर है, और यदि छुट्टी मंजूर करने के लिए तसल प्राधिकारी का यह विचार है कि उसके विरुद्ध कार्यवाहिकों के समाप्त हो जाने पर उसके कुछ धन प्रमुख करने की कोई सम्भावना है तो उक्त प्राधिकारी उसकी अद्वित्त छुट्टी के सममूल्य संपूर्ण नकद राशि अथवा उसका कोई सत्य रोक सकता है । कार्यवाहिकों की तनात्त्व पर वह सरकारी वेतों के यदि कोई हो, समायोजन के पश्चात् दस प्रकार रोकने की रकम पाने का पात्र हो जाएगा ।”

साः काः निः 805-संविधान के अनुच्छेद 309 के मास्ट्रिक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, राष्ट्रपति ने एतद्वारा कनिष्ठ वित्त अधिकारी (सामान्य केन्द्रीय सेवा समूह के जरूरतमंद वित्त मंत्रालय) (सामान्य) भर्ती किया, 1959 में और संशोधन करने के लिए निष्क्रिय निर्देश तैयार किए गए।

1. (1) इन नियमों को कनिष्ठ वित्त अधिकारी (सामान्य केन्द्रीय सेवा समूह के जरूरतमंद वित्त मंत्रालय) (संशोधन) भर्ती किया, 1983 कट्ठा जाएगा।

(2) ये नियम सरकारी राजपथ में प्रकाशन होने की तारीख से लागू होंगे।

1. कनिष्ठ वित्त अधिकारी (सामान्य केन्द्रीय सेवा समूह के जरूरतमंद वित्त मंत्रालय) (संशोधन) भर्ती किया, 1978 में —

(1) नियम 1. उप नियम (1) में कोष्ठक तथा शव्द (संशोधन) टूटा दिए जाएंगे।

(2) नियम 4 के स्थान पर निम्नलिखित नियम बनाए जाएंगे, अर्थात्—

“4. अंतर्द्रता : कोई भी व्यक्ति

(क) जिसने ऐसे व्यक्ति के विवाह कर लिया हो या करना, तय किया हो, जिसका पता/पता जीवित हो, अथवा

(ख) जिसने एक पत्नी/पति के जीवित रहते किसी व्यक्ति के विवाह कर लिया हो या करना तय किया हो, उस पर पर नियुक्ति का पालन नहीं होगा।

बजाने कि केन्द्रीय सरकार यदि इस बात से संतुष्ट हो कि विवाह करने वाले व्यक्ति तथा विवाह के दूसरे पत्ते के लागू होने वाले व्यक्तिगत, कानून के अन्तर्गत ऐसा विवाह करना अनुरूप है, और ऐसा करने के लिए और भी कारण है, तो उस व्यक्ति को इस नियम के प्रदर्शन से छूट दे सकती है।

(iii) नियम 5 के बाद निम्नलिखित नियम जोड़ा जाएगा, अर्थात्—

“6. अपवाद : इस संबंध में केन्द्रीय सरकार द्वारा समग्र-समय पर जारी किए गए आदेशों के अनुसरण में अनुपस्थित वाणिज्यिक अनुपस्थित जनजाति तथा अन्य विशेषताओं के व्यक्तियों के लिए किए जाने वाले आरक्षणों, आयु-सीमा में छूट तथा अन्य रिश्तेदारों पर इन नियमों को कोई प्रभाव नहीं पड़ेगा।

(iv) अनुकूली में कालय-6 से की यूपी प्रबिष्टि के स्थान पर निम्नलिखित प्रबिष्टि की जाएगी, अर्थात्—

“30 वर्ष से अधिक नहीं (केन्द्रीय सरकार द्वारा जारी किए गए निर्देशों के अनुसार सरकारी कर्मचारियों के लिए 5 वर्ष की छूट दी जा सकती है)”

स. का. नि. 338 — केन्द्रीय सरकार, बखिल भारतीय सेवा अधिनियम, 1951 (1951 का 61) की धारा 3 की उपधारा (1) द्वारा प्रदत्त प्रक्रियाओं का प्रयोग करते हुए, संबंधित राज्य सरकारों ने परामर्श से, बखिल भारतीय सेवा (छुट्टी) नियम, 1955 का और संशोधन करने के लिए निम्नलिखित नियम बनाए: –

1. (1) इन नियमों का संक्षिप्त नाम बखिल भारतीय सेवा (छुट्टी) संशोधन नियम, 1983 है।

(2) ये प्रकाशन की तारीख को प्रवृत्त होंगे।

1. बखिल भारतीय सेवा (छुट्टी) नियम, 1955 में नियम 13 के उपनियम (5) के पश्चात्, निम्नलिखित उपनियम अन्त:

स्थापित किया जाएगा, अर्थात्:

“(4) जहां सेवा का कोई ऐसा सदस्य, जिसे परिवर्तित छुट्टी मंजूर की गई है, सेवा से त्यागपत्र देता है या उसके अनुरोध पर ट्यूटी पर वापस आए बिना स्वेच्छा से सेवानिवृत्त होने के लिए अनुमति कर दिया जाता है, वहां परिवर्तित छुट्टी अर्धवेतन छुट्टी समाप्ति जाएगी और परिवर्तित छुट्टी तथा अर्धवेतन छुट्टी के सम्बन्ध में छुट्टी वेतन के बीच के अन्तर को ब्याज किया जाएगा।

परन्तु यह कि ऐसी कोई ब्याज नहीं की जाएगी यदि सेवानिवृत्ति, ऐसे सरल स्वास्थ्य के कारण, जो सेवा के सदस्य को आगे सेवा के लिए असमर्थ बनाता है, या उसकी मृत्यु होने पर, हुई है।”

स.क.वि. 350. – संविधान के अनुच्छेद 309 तथा अनुच्छेद 146 के उप सभा 5 के परन्तु के द्वारा प्रदत्त संक्रियाएँ का प्रयोग करते हुए राष्ट्रपति, एतद्वारा राष्ट्रिय परीक्षणज्ञाना, कलकत्ता तथा इसके अन्य यूनिटों में वैज्ञानिक सहायक (इलेक्ट्रॉनिक्स) के पद के लिए भर्ती की पद्धति को विनियमित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात् :-

1. संक्षिप्त नाम और आरम्भ :- (1) ये नियम राष्ट्रिय परीक्षणज्ञाना, कलकत्ता, वैज्ञानिक सहायक (इलेक्ट्रॉनिक्स) भर्ती नियम, 1983 कहे जायेगे ।

(2) ये सरकारी राजपत्र में प्रकाशन की तिथि में लागू होने जायेगे ।

1. संस्था, वर्गीकरण और वेतनमान :- उक्त पदों की संस्था, उसका वर्गीकरण और उसके वेतनमान वे होम जो इन नियमों के साथ लगी अनुसूची के स्तम्भ 2 से 4 में निर्धारित है ।
2. भर्ती की पद्धति, आयु-सीमा तथा बहुताएँ आदि :- उक्त पद के सम्बद्ध में भर्ती की पद्धति, आयु-सीमा, बहुताएँ और तत्ववंशी अन्य बातें वे होमी जो कथित अनुसूची के स्तम्भ 5 से 14 में निर्धारित है ।
3. अनहताएँ :- कोई भी व्यक्ति-

(क) जिसमें किसी ऐसे व्यक्ति से विवाह किया है, जिसमें पत्नी/जिसका पति जीवित है, अथवा,

(ल) जिसने अपनी पत्नी/अपने पति के औचित रहने हुए किसी अन्य व्यक्ति से विवाह किया हो, उक्त पद पर नियुक्ति का पात्र नहीं होगा ।

परन्तु यदि केन्द्रीय सरकार का समाधान हो जाता है कि ऐसे व्यक्ति पर और जिस व्यक्ति से विवाह किया जाता है, उस पर लागू होने वाले निजी कानून के अन्तर्गत ऐसे विवाह की अनुमति है और यदि ऐसा करने के अन्य आधार है तो वह इस नियम के प्रवर्तन से किसी व्यक्ति को छूट दे सकती है ।

1. विभिन्न करने की शक्ति :-जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आदरवक्ता या समीप्तित है, वहां वह आदेश द्वारा निश्चित रूप में औचित किए जाने वाले कारकों से किसी भी वर्ग या व्यक्तियों के वर्ग के बारे में इन नियमों के उपबन्धों में से किसी को भी सिंचित कर सकती है ।

2. छूट :- इन नियमों की कोई बात केन्द्रीय सरकार दुरारा समय-समय पर जारी किए गए आदेशों के अनुसार अनुमोचित जातियों, अनुमोचित जन जातियों तथा अन्य निर्बाध वर्ग के व्यक्तियों के लिए अपेक्षित आरक्षण, आवृत्तीमा में छूट तथा अन्य रियायतों पर प्रभाव नहीं डालेगी ।

सत्र- क्र. 351-राष्ट्रपति, संविधान के अनुच्छेद 380 के परामुळे द्वारा प्रदत्त व्यक्तियों का प्रयोग करते हुए, पर्यावरण विभाग में लेखा अधिकारी के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात :-

1. संक्षिप्त नाम और प्रारम्भ :- (1) इन नियमों का संक्षिप्त नाम पर्यावरण विभाग लेखा अधिकारी, भर्ती नियम, 1983 है।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रमुख होंगे।

1. पद-संख्या, वर्गीकरण और चेतनमान :-उक्त पद की संख्या, उनका वर्गीकरण और उसका चेतनमान ये होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से 4 में विविधित हैं।

2. भर्ती की पद्धति, आयु-सीमा और अर्हताएं आदि :-उक्त पद पर भर्ती की पद्धति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें ये होंगी जो पूर्वोक्त अनुदानी के स्तम्भ 5 से 13 में विविधित हैं।

3. निरर्हताएं :-यह व्यक्ति-

(क) जिसने ऐसे व्यक्ति थे, जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसके अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है, उस पद पर विद्युक्ति का पात्र नहीं होता। परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार की लागू गरीब विधि के अधीन अनुरूप है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रबंधन से जुड़ दे सकेगी।

1. विभिन्न करने की शक्ति :-जहां केन्द्रीय सरकार की रह राय है कि ऐसे करना आवश्यक या समीचीन है, वहां वह, उसके लिए जो कारण है उसे लेखकত্ব करके तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी धर्म या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा, चित्रित कर सकेगी।

2. व्यावसाय :-इन नियमों को कोई भी बात ऐसे आरक्षणों, आयु-सीमा में जुड़े और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस सम्बन्ध में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना आवश्यक अपेक्षित है।

1. (1) These rules may be called the President’s Secret-
   ariat (Recruitment and Conditions of Service) (Fourth
   Amendment) Rules, 1984.

(2) They shall be deemed to have come into force with
immediate effect.

1. The following shall be added as desirable qualification
   in column 8 against Serial Nos. 30, 46 and 49 in Schedule
   I to the President’s Secretariat (Recruitment and Conditions
   of Services) Rules, 1976—

“Desirable: (a) ‘3 years’ service as Home Guards/Civil
Defence Volunteers and (b) training in at least
‘Basic’ and ‘Refresher’ courses in Home Guards
and Civil Defence.”

साःकाः-नि: 865—राजपति, संविधान के अनुच्छेद 309 के नरसुक द्वारा प्रथम सच्ची का प्रयोग करते हुए काविक और प्रशासनिक सुधार विभाग (अनुसंधान अधिकारी) (श्रेणी II) भर्ती नियम, 1973 का और संशोधन करने के लिए निम्नलिखित नियम बनाते है, अर्थात् :-
(1) इन नियमों का संक्षिप्त नाम काविक और प्रशासनिक सुधार विभाग (अनुसंधान अधिकारी श्रेणी-II) भर्ती (संशोधन) नियम, 1984 है।
(2) ये राजपत्र में प्रकाशन की तारीख से प्रबृत्त होंगे।
2. काविक और प्रशासनिक सुधार विभाग (अनुसंधान अधिकारी श्रेणी-1) भर्ती नियम 1973 की अनूठी में स्तम्भ 6 में विद्यमान प्रविष्टि के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् :-
“30 वर्ष

1. (1) These rules may be called the Department of Personnel and Administrative Reforms, (Research Officer Class II) Recruitment (Amendment) Rules, 1984.
   (2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Schedule to the Department of Personnel and Administrative Reforms (Research Officer Class-II) Recruitment Rules, 1973, in column 6, for the existing entry, the following shall be substituted, namely:-
   ’30 years
   (Relaxable for Government servants upto 5 years in accordance with the instructions or orders issued by the Central Government).’

साः काः- नि: 866—राजपति, संविधान के अनुच्छेद 148 के खण्ड (5) के साथ पवित्र अनुच्छेद 309 के नरसुक द्वारा प्रथम सच्चियों का प्रयोग करते हुए, भारतीय लेखा परीक्षा और लेखा वित्तीय में सेवा कर रहे व्यक्तियों के संबंध में भारत के निर्वाचक और महालेखापरीक्षक से परामर्श करने के पश्चात् केन्द्रीय सिविल सेवा (छुट्टी) नियम, 1972 का और संशोधन करने के लिए निम्नलिखित नियम बनाते है, अर्थात् :-
1. (1) इन नियमों का संक्षिप्त नाम केन्द्रीय सिविल सेवा (छुट्टी) (पहला संशोधन) नियम 1984 है।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रबृत्त होंगे।
2. केन्द्रीय सिविल सेवा (छुट्टी) नियम, 1972 (जिन्हें इसमें इसके पश्चात् उक्त नियम कहा गया है) में नियम 18 का तंत्र किया जाएगा।
3. उक्त नियमों के नियम 19 में —-
(क) शीर्षक के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् :-
“राजपत्रित और अराजपत्रित सरकारी सेवकों की चिकित्सीय प्रमाण-पत्र पर छुट्टी की मंजूरी।”
(ख) उपनिवेश (1) और उसके पीछे के दिग्गज के स्थान पर निम्नलिखित रखा जाएगा, अर्थात् :-
“(1) चिकित्सीय प्रमाणपत्र पर छुट्टी के लिए दिए गए आवेदन के साथ, यदि यह—
(i) किसी राजपत्रित सरकारी सेवक द्वारा दिया गया है तो किसी प्राविकृत चिकित्सीय परिवारक या किसी रजिस्ट्रीकृत चिकित्सा स्वदेशीरी द्वारा प्रबन्ध 4 में दिया गया चिकित्सीय प्रमाणपत्र होगा।
(ii) किसी अराजपत्रित सरकारी सेवक द्वारा दिया गया है तो किसी प्राविकृत चिकित्सीय परिवारक या किसी रजिस्ट्रीकृत चिकित्सा स्वदेशीरी द्वारा प्रबन्ध 4 में दिया गया चिकित्सीय प्रमाणपत्र होगा।
जिसमें क्या संबंध स्पष्टतः बीमारी की पढ़ाई और बीमारी की समस्या अवश्य बताई गई होगी।
दिग्गज: अराजपत्रित सरकारी सेवक के मामले में, किसी रजिस्ट्रीकृत आयुर्वेदिक मुनानी या हस्तलिखित चिकित्सा स्वदेशीरी द्वारा या दाद संबंधी ज्यामियों की दवा में किसी रजिस्ट्रीकृत वैव चिकित्सक या किसी अर्जेनिक चिकित्सा अधिकारी द्वारा दिया गया प्रमाणपत्र जो स्वीकार किया जा सकेगा परन्तु यह तब जबकि सेवा प्रमाणपत्र, उसी प्रावधान के लिए उस राज्य सरकार द्वारा जिसमें केन्द्रीय सरकारी सेवक बीमारी पड़ता है या उत्थार के लिए जाता है, उससे अपने कार्यवासियों की वाक्य स्वीकार्य हो।”

1. उक्त नियमों के प्रबन्ध 3 में-
   (i) “मेरे विचार से, सरकारी सेवक के लिए चिकित्सीय बोर्ड के मक्का हानिरी होना आवश्यक है/नहीं है।” शब्दों का तंत्र किया जाएगा।
   (ii) दग्गज-1 का तंत्र किया जाएगा।
   (iii) दिग्गज 2 में “चिकित्सीय बोर्ड शब्दों के स्थान पर चिकित्सीय सर्जन/खाक सर्जन/प्राविकृत चिकित्सीय परिवारिक” शब्द रखे जायेंगें।

हुए कोयला खान भविष्य निधि स्कीम, 1948 का सौर संशोधन करने के
लिए निम्नलिखित स्कीम बनाती है, अर्थात्—

1. (1) इस स्कीम का संक्षिप्त नाम कोयला खान भविष्य निधि
   (मंसीयन) स्कीम, 1984 है।

(2) यह राजपत्र में प्रकाशन की तारीख को प्रयुक्त होगी।

1. कोयला खान भविष्य निधि स्कीम, 1948 में :—

(क) विद्यमान पैरा 65% के स्थान पर निम्नलिखित पैरा
रखा जाएगा, अर्थात्—

“65% निवास-गृह (फ्लैट के रूप के लिए या किसी निवास-
गृह के जिसके अन्तर्गत इस प्रयोजन के लिए समुचित
स्थल का भर्जन भी है, संनिर्माण के लिए निधि से
अधिम।

(3) आयुक्त या जहां आयुक्त द्वारा ऐसा प्राधिकृत किया गया हो,
वहां उसका प्रयोगस्य कोई अधिकारी, ऐसे प्ररूप में जो आयुक्त
द्वारा विहित किया जाए, सौर इस पैरा में विहित तत्वों
के प्रयोग रहते हुए, किसी सदस्य द्वारा लिए गए आवेदन पर
निधि में सदस्य के जमा खाते में रकम से निम्नलिखित के
लिए प्रपतिदेव भविष्य भंजूर कर सकेगा :—

(क) निवास-गृह या कोई ऐसा फ्लैट जिसके अन्तर्गत अन्य व्यक्तियों
के साथ प्रयुक्त स्वामित्व वाले किसी सदन में या कोई फ्लैट भी

पति / पत्नी द्वारा स्वामित्व वाले किसी स्थल पर निवास-गृह
से संनिर्माण के लिए या ऐसे स्थल पर
सदस्य या पति / पत्नी द्वारा पहले से ही प्रारूप का पति
बए किसी निवास-गृह के संनिर्माण को पूरा करने या सापे
रखने के लिए ;

या

(घ) सदस्य या सदस्य के प्रति / पत्नी या संयुक्त सदस्य सौर यदि
पत्नी द्वारा स्वामित्व वाले विद्यमान गृह से संनिर्माण से
परिवर्त्तय करने के लिए।

hereby makes the following rules further to amend the De-
partment of Company Affairs, Offices of the Regional Direc-
tor Registrar of Companies and Official Liquidators (Group
‘D’ posts) Recruitment Rules, 1969, namely:—

1. (1) These rules may be called the Department of Com-
   pany Affairs, Offices of the Regional Director, Registrar of
   Companies and Official Liquidator, (Group D Posts) Recruit-
   ment (Amendment) Rules, 1984.

(2) They shall come into force on the date of their
publication in the Official Gazette.

1. In the Department of Company Affairs, Offices of the
   Regional Directors, Registrar of Companies, and Official
   Liquidators (Group D Posts) Recruitment Rules, 1969 in
   rule 7, after the existing proviso the following shall be in-
   serted, namely:—

   28 के स्थान पर निम्नलिखित नियम को प्रतिस्थापित किया जाएगा,
   प्रयोग “28. प्रावधान विभागों में सेवा कर रहे व्यक्तियों के लिए
   उपासित छुट्टी

(1) (क) किसी शिक्षक, प्रधानाचार्य, मुख्याध्यापक, मुख्यालयाध्यक्ष,
प्रयोगशाला शहादेय श्यवा किसी विद्यालय में कार्य कर रहे
बाहरमैन के छुट्टी खाते में प्रत्येक कलेवर वर्ग की पहली
जनवरी और पहली जुलाई को पांच पांच दिनों की भी नियम
से उपासित छुट्टी सचिव रूप से जमा की जाएगी।

(ख) यदि किसी अध्यापक, प्रधानाचार्य, मुख्याध्यापक, मुख्यालयाध्यक्ष,
प्रयोगशाला शहादेय श्यवा किसी विद्यालय में कार्य कर रहे
किसी वाहरमैन ने किसी धर्म वर्ग के दौरान प्रसाधारण छुट्टी
ली हो और/श्यवा उसकी अनुपस्थिति की किसी धार्मिक
अकार्य दिन माना गया हो तो उसने धर्म वर्ग की शुरुआत के
उसके छुट्टी खाते में जमा की जाने वाली छुट्टी में प्रतिबद्धता
5 दिन की सर्त के अधीन रहते हुए, उस तरह की छुट्टी और
या अकार्य दिन की धार्मिक का 1/30वां भाग का
दिया जाएगा।

(ग) जिस धर्म वर्ग में किसी शिक्षक, प्रधानाचार्य, मुख्याध्यापक,
पुस्तकाध्यक्ष, प्रयोगशाला शहादेय श्यवा किसी विद्यालय में
कार्य कर रहे वाहरमैन की नियुक्ति की जाती है वह सेवा के
नहीं रहता है, उस धर्म वर्ग के दिन उस सेवा के प्रत्येक वर्ग
किए गए माल के लिए 5/6 दिन/हिसाब ने छुट्टी जमा करने
की अनुमति होगी जिसे उसने उस धर्म वर्ग में की थी/शेयर
की संभावना है जिस धर्म वर्ग में उसे नियुक्त किया जाता है
वह सेवा में नहीं रहता है।

(2) उप-नियम (I) के उपबन्धों के अधीन रहते हुए प्रावधान
विभाग में सेवा करने वाला सरकारी सेवक (सैनिक अधिकारी
से चिंता), उस वर्ग में, जिसमें वह पूरे प्रावकाश का उपयोग
कर लेता है, किए गए कर्तव्य की बाबत किसी उपासित
छुट्टी का हकदार नहीं होगा।

(3) (क) जिस वर्ग सरकारी सेवक प्रावकाश के किसी भाग का
उपभोग करता है, उस वर्ग की बाबत वह 30 दिन, या यदि
वह नियम 26 के उपनियम (I) के अपवाद से शामिल है तो
45 दिन के ऐसे अनुपात के बराबर उपासित छुट्टी का हकदार
होगा, जो उपभोग के किए गए प्रावकाश के दिनों की संख्या
का पूर्ण प्रावकाश से है: परन्तु ऐसी कोई छुट्टी ऐसे सरकारी
सेवक को, जो स्थायी नियोजन का स्वाधिकृत/नियोजन में नहीं
है, उसकी सेवा के प्रबन्ध वर्ग के बाबत अनुबंध नहीं होगा।

(ख) यदि किसी वर्ग में सरकारी सेवक किसी प्रावकाश का उपयोग
नहीं करता है तो उसे नियम 26 के अधीन उस वर्ग की बाबत
उपासित छुट्टी अनुबंध होगी।

स्वप्नोकरण: उस नियम के प्रायोजन के लिए ‘वर्ष’ से वह कलेवर वर्ग
सचिवित नहीं है जिसमें कर्तव्य किया जाता है बल्कि किसी प्रावकाश विभाग
में वास्तविक कर्तव्य के बारह माल परिचित है।

टिप्पणी-1. जब तक कि किसी उच्चतर प्राधिकारी के तापरेखा या
विशेष आदेश द्वारा ऐसे प्रावकाश या प्रावकाश के भाग का
उपभोग न करने की अपेक्षा नहीं की जाती तब कि वह सबका
जाएगा कि प्रावकाश के हकदार किसी सरकारी सेवक ने प्रावकाश
या प्रावकाश के किसी भाग का उपयोग कर लिया है।

परन्तु यदि ऐसे आदेश द्वारा वह पन्द्रह दिन से अधिक के प्रावकाश
का उपयोग करने से निवारित कर दिया जाता है तो वह सबका जाएगा
कि उसने प्रावकाश के किसी भाग का उपयोग नहीं किया है।

टिप्पणी-2 यदि किसी प्रावकाश विभाग में सेवारत सरकारी सेवक कर्तव्य
का एक पूर्ण वर्ष पूरा करने से पूर्व छुट्टी पर बता जाता है तो
उसे अनुबंध उपासित छुट्टी, छुट्टी पर जाने से पूर्व की वास्तविक
कर्तव्य की धार्मिक के दौरान पहले बाल प्रावकाश के प्रति निर्देश
से नहीं बल्कि उस प्रावकाश के प्रति निर्देश से संबंधित की
जाएगी जो उस तारीख से, जिसको वह कर्तव्य का पूर्वजल वर्ष
पूर्ण करता है, प्रारम्भ होने वाले वर्ग में वृद्धि।

(4) प्रावकास, इन नियमों के अधीन किमी की आकार की छुट्टी,
के साथ जोड कर भवना उसके जय में लिया जा सकेगा।

परन्तु एक साथ लिए गए प्रावकास और उपजित छुट्टी की कुल
सर्वथा चाहे उपाजित छुट्टी अन्य छुट्टी के साथ या शिलाकर उसके जय
में ली गई है वय नहीं, सरकारी सेवक को सौम्य और एक बार में यमुसेन
बाल से अधिक नहीं होती।

(5) पिछले चर्च वर्ष की समाप्ति पर सरकारी सेवक के खाते में
इन नियम के अधीन जमा की गई छुट्टी इन मई के अधीन
रहते हुए अगले चर्च वर्ष में घर्षवीय की जाएगी कि इस तरह
से घर्षवीय की गई छुट्टी तथा चर्च वर्ष के लिए खाते में
जमा की गई छुट्टी 180 दिन की अधिकतम सीमा से अधिक
नहीं होती हो।

2(II) नियम 29 के उपनियम (I) में (मैत्रिक अधिकारी से जिन)
कोष्ठकों और सब्सों के स्थान पर (मैत्रिक अधिकारी से भिन्न)

G.S.R. 788.—In exercise of the powers conferred by the
proviso to article 309 read with clause (5) of article 148 of
the Constitution and after consultation with Comptroller and
Auditor-General in relation to the persons serving in the
Indian Audit and Accounts Department, the President hereby
makes the following rules further to amend the Central
Civil Services (Leave) Rules, 1972, namely :-

1. (1) These rules may be called the Central Civil Ser-
   vices (Leave) (Second Amendment) Rules, 1984.

(2) They shall come into force on the date of their publi-
cation in the official Gazette.

1. In the Central Civil Services (Leave) Rules, 1972,

(i) for rule 28 the following rule shall be substituted,
namely :-

1. Earned leave for persons serving in Vacation De-
   partments.

(1) (a) The leave account of a teacher, principal, headmaster, librarian, laboratory assistant or a waterman working in a school shall be credited in advance with Earned leave in two instalments of five days each on the first day of January and July, of every calendar year.
(b) If a teacher, principal, headmaster, librarian, Laboratory Assistant or a waterman working in a school has availed of extraordinary leave and/or some period of absence has been treated as dies-non during a half year the credit to be afforded to his leave account at the commencement of the next half year shall be reduced by $1 / 3$ th of the period of such leave and/or dies-non subject to a maximum of 5 days.
(c) The credit for the half year in which a teacher, principal, headmaster, librarian, Laboratory Assistant or a waterman working in a school is appointed/ceases to be in service shall be allowed at the rate of $5 / 6$ th day for each completed month of service which he had rendered or is likely to render in the half year in which he is appointed/ceases to be in service.
(2) Subject to provisions of sub-rule (1), a Government servant (other than a military officer) serving in a Vacation Department shall not be entitled to any earned leave in respect of duty performed in any year in which he avails himself of the full vacation.
(3) (a) In respect of any year in which a Government servant avails himself of a portion of the vacation he shall be entitled to earned leave in such proportion of 30 days or 45 days when governed by the Exception to sub-rule (1) of rule 26, as the number of days of vacation not taken bears to the full vacation:

Provided that no such leave shall be admissible to a Government servant not in permanent employ or quasi-permanent employ in respect of the first year of his service.
(b) If, in any year, the Government servant does not avail himself of any vacation, earned leave shall be admissible to him in respect of that year under rule 26.

Explanation.-For the purposes of this rule, the term ‘year’ shall be construed not as meaning a calendar year in which duty is performed but as meaning twelve months of actual duty in a vacation Department.

Note 1.-A Government servant entitled to vacation shall be considered to have availed himself of a vacation or a
